MINUTES of the public hearing of the Queensbury Zoning
Board of Appeals held October 15, 1975 at 7:30 P.M.
There were present:
George Kurosaka (Acting chairman)
Charles Sicard
Richard Sanderspree
Sjoerdje Richardson
being the rœmbers of the Board. There was a correction to the
minutes of the September 17 neeting. On page 6 of the minutes,
the third paragraph, the words lithe present" were added making
it read as follOW's: The Town of Queensbw::y Planning Board rec-
orrnended approval with the stipulation that they raise level of
the parapet a minimum of 18" to erect sign not above the present
parapet line. On a notion by Charles Sicard, seconded by Sjoerdje
Richardson, the minutes were approved as ærended.

variance #410 - Edward J. Barrett (Hertz Rentals) Corner
Dix Avenue and County Line Road - R-4 Zone, to enlarge a non-
conforming use on the property situated at the corner of Dix Ave-
nue and County Line Road.
The variance was tabled from the last rœeting waiting clar-
ification from the TOW'll Attorney as to when the property was ac-
quired and if the lot was all one parcel.
Both the Town Planning Board and the Warren County approved.
Charles Sicard made a notion that Variance #410 be approved
and that it rœets all of the requirements. This was seconded by
Richard Sanderspree. Unaninous .
Variance #415 - Margaret L. Waite, North Side of Dix Ave.-
o
R-4 Zone, to enlarge a nonconforming use in an R-4 zone on the
property situated at the north side of Dix Avenue.

This application was tabled from the last rœeting waiting
an interpretation from the town attorney since she already has
had one increase and to find out what they use for the original
corrputation for expansion.
Mrs. Waite was present and a letter was read from the town
attorney stating that the 1971 enlargerœnt was less than the 50%.
However, the proposed new addition would succeed the aJIDunt of
feet allowed to her. Mr. Kurosaka explained to Mrs. Waite that
she could enlarge under a Use Variance but would have to prove
a substantial hardship. Right nOW', she could only build a build-
ing 18 x 36 I which she stated would be too small.
Mr. Wayne White, County Line Road, whose wife operates a
beauty shop was present and opposed this application.
Frank Ronk - Opposed.
Mr. Sicaril explained that the measurerœnts were corrputed
by the town attorney.
Mrs. Waite agreed to table this application for another
nonth so either Mr. Liapes our Mrs. Boynton could go down and
measure all of the buildings to be used for the rorrputation.
Variance #414 - Pyramid Corcpany of Glens Falls, Aivation
Road, C-3 Zone, to place oversized signs less than the required
setbacks and oversized facia signs on the property situated at
Aviation Road.
Mr. Robert Stewart, Attorney was present saying he was
asking for a rehearing of the sign application and was repre-
senting Cinema Center. Mr. Stewart stated this application was
approved as long as the larger plylon sign be reduced in size
and layout to confo:rm to the sign on the westerly end. He is

asking for a rehearing to see exactly what the language of the
zoning Board really net, especially the 'WOrd (·Layout. II He fur-
ther stated the The Cinema Center did not know hOW' to proceed
wi th a sign of this size. He felt that last tiIœ, he didn· t
fully explain the whole situation due to the many things on
the agenda and felt pressed for tiIœ. He explained that a the-
atre business is not like any other business. They need to have
a sign or noone 'WOuld knOW' what was playing, or in this case,
noone would even know they were in the Mall. The sign needs to
shOW' three things: The narœ of what's playing, the stars and
the tiIœ that the novie is to be shown. A sign of 3 (7" would
on! y allow one line of 6" letters.
Mr. Stewart said that the Cinema Center could do three
things:
1) Cinema could appeal.
2) Reargurœnt to be brought before the board.
3) They run three separate theaters and could have three
standing signs.
Mr. stewart pointed out that they would not want to
appeal and 'WOuld rather not have three separate sign so ask
that the board reconsider this application.
Mr. Sumner Gotleb of Cinema Center spoke regarding the
sign. He stated that Cinema Center had already cut their sign
down considerably.
Mr. Hoffman of Signs of Progress spoke saying that an a"
letter is not big enough and needed to be 10" letters for
people to sèe the sign that far back frcm the road.
Mr. Bruce Keenan of Pyramid asked the board to recon-
sider the application also.

Mr. Colin Gray objected to any change in the sign.
Mr. Stewart said he did not knOW' exactly what the board
could do, but it was his understanding that the board could
al tar, æœnd or change their decision if they wanted to. He
asked if the town attorney could be contacted to clarify the
board I s situation in this matter.
Mr. Sicard told Mr. Stewart that as long as Mr. Fi tz-
gerald was part of the original decision, that there should
not be any change without his being part of it.
The board decided to hold a special meeting so Mr.
Fi tzgerald could be contacted. This was tabled until that
rœeting could be held.
NEW BUSINESS:
Variance #418 - Raynond Deyette, West Side Michigan
Avenue, R-4 Zone, to place an addition on dwelling 18 ft. fran
front property line in lieu of the required 30 ft. setback on
the property situated at the west side of Michigan Avenue.
There were no appearances for or against this appli-
cation.
The Town of Queensbury Planning Board approved.
Sjoerdje Richardson nade a rrotion that Variance #418 -
Raynond Deyette be approved. This was seconded by Charles
Sicard. unanim:>us.
Variance #419 - Vincent J. Ottavio, Route 9 north of
Route 149, to place a nobile hone in a Com:œrcial Zone C-3
on the property situated on the east side of Route 9 north of
Route 149.

Mr. Ottavio stated the trailer would be for his father

who is in ill health. It would not be visable from Route 9.
A letter was read from Lew CUddeback stating no opposit-
ion as long as the trailer could not be seen from Route 9.
George McDowan and Peggy Krowskowski both with business-
es on Route 9 opposed the application.
John VanDusen with a business also on Route 9 was not
opposed if it is not visible from Route 9.
The Town of Queensbury Planning Board approved and the
Warren County concurred with the Town Planning Board.
Sjoerdje Richardson made a notion that Variance #419 -
Vincent J. ottavio be disapproved. This was seconded by
Charles Sicard. The voting: 3 - disapproval
1 - approved
Variance #420, The First National Bank of Glens Falls,
Quaker Road, C-2 Zone, to place a 390 sq. feet sign in lieu
of the required 50 sq. feet on the property situated at Quaker
Road.
Those present representing the bank were. William T.
Clark, President, Bob Dehayes, Lyle Grego:ry and Mr. George
Clark, Architect for the bank.
A letter from the League of Woman Voters was read in ob-
jection to the sign.
Colin Gray also in objection.
Attorney John Lerœry who had cone before the board re-
presenting George Boychuck of Mark Plaza and Long John Silver
was present and said he was concerned about the uniformity of
signs. Asked the board what prescients to set for other clients.

Mr. Leme:ry was in opposition to this application stating
the board should be fair to all referring to his two clients
that the board had turned down.
The TCMn of Queensbury recamœnded approval of a 280 sq.
ft. sign (40 ft. by 7 ft.) Warren County approved.
Mr. George Clark, architect stated the bank had already
reduced the sign of their sign from the size originally re-
quested which was over 350 square feet. He said the sign
would have been made of bronze-type individual letters attach-
ed to the wall facing Quaker Road and would have been lit from
the ground. He further stated that the 280 square feet sign
'WOuld take up less than 10 per cent of the building.
Richard Sanderspree nade a notion that Vairance #420-
First National Bank of Glens Falls be approved as it is in con-
fOrrraIlce with the two planning boards. This was seconded by
George Kurosaka.

Mr. Sicard stated he thought Mr. Lerœry' s conplaint was valid.
