Howard 500 Luzerne Road Queensbury NY 12804 Re: Notice of Violation - Order to Remedy for Violation of Subdivision Modification 14- 2005 for Lot 18 (Parcel ID 308.6-2-18). Dear David W. Howard: This letter serves as a "Notice of Violation-Order to Remedy" for the apparent violation of your approved Subdivision Modification for Lot 18. Specifically, during a complaint investigation on July 10, 2020, it was discovered you have removed trees outside of the approved clearing limits including a portion of the 20-foot "No Cut Zone" along your south property line with the complainant. You are hereby directed to apply for a Subdivision Modification for Lot 18 for the aforementioned unapproved changes by August 17, 2020. Should you require additional time to make application, provide a written request to the Zoning Administrator prior to the August 171h deadline date. Should you choose to revegetate the area in question, to avoid a review by the Planning Board, you will need to provide a replanting plan by August 17, 2020 to be reviewed by the Zoning Administrator. Additionally, the berm you have installed will need to be stabilized, and that portion of the berm within the "No Cut Zone" will need to be revegetated. Failure to act as directed by this official order will result in an appearance ticket being issued to you for Queensbury Justice Court.
