1976-09-15 91 MINUTES of the public hearing of the Zoning Board of Appeals held on September 15, 1976, at 7:30 P.M. There were present: Jack Fitzgerald (Chairman) Charles Sicard Sjoerdje Richardson Ted Turner being the members of the Board. The meeting was called to order by Mr. Fitzgerald. The Minutes of the last meeting were reviewed, but not read aloud, by the members of the Board and were approved. There was no Old Business. NEW BUSINESS: Variance #455 - Samuel L. Peca, Quaker Road, (Mark Plaza), Zone C-2. To erect a free standing sign . denoting the location of a stereo-hi fidelity store, "Audio Genesis", in an area designated as a "shopping center" . Samuel L. Peca wps present to represent his application. There were no ååher appearances for or against this application. Mr. Peca described the L-shape of the plaza in which his store is at the end of the plaza and lacks roadside exposure and would cause a hardship on his business. His free standing sign, if approved, would be a 3' x 8' metal sign with internally-illuminated '-- plastic faces mounted on a steèl pole of 4" diameter. 92 The sign's edge would be located approximately 47' from Quaker Road property line. Asked by Mr. Sicard, Mr Peca said his sign would be lit the same hours as the other signs in that plaza - dusk to about 9:30 P.M. Mr. Turner made a motion and it was seconded by Mr. Sicard as follows: RESOLVED, that Variance #455 be approved provided the variance be limited to the use by "Audio Genesis" and will be removed when they cease to occupy the premises or ten (10) years from the date of adoption of the new sign or- dinance (July 27, 1976}, whichever is sooner. This approval is in conformance with the Warren County Planning Board and tse Queensbury Planning Board and is predicated upon hardship due to nature of the property. Three (ê) memèe~s approved this application and Sjoerdje Richardson disapproved. Variance #456 - Hil1iam and Maxine Ellsworth, Canterbury Lane, west end of Glen Lake, Zone C-3. To construct an addition to a dwelling 17' from the water liBe in lieu of the required 30'. Porch is needed to protect from sun, mosquitoes, black flies and protect furniture from weather. William Ellsworth was present to represent his application. There were no other appearances for or against this application. '- -2- 93 Mr. Ellsworth had signatures of his neighbors stating their consent to the porch. Mr. Fitzgerald made a motion to approve the application and it was seconded by Mr. Sicard as follows: RESOLVED, that Variance #456 be approved as a reasonable use of the land and in conformity with the Queensbury Planning Board. Approval unanimous. Variance #457 - Fred Champagne, Juniper Drive, (Sunnyside North), Zone R-4. To place a garage 20' front set back in lieu of the required 30' front set back. Fred Champagne was present to represent his '-- application. There were no other appearances for or against this application. The reason for 20' front set back instead of the required 30' is because Mr. Champagne's septic tank is there. Also, if the garage was set back the required 30' a fill would be needed in order to level the ground. A letter was received by the Board from one of Mr. Champagne's neighbors stating her consent to the garage. -3- '-- 1'1 Mr. Sicard made a motion that this application be approved and Mrs. Richardson seconded the motion as follows: RESOLVED, that Variance #457 be approved in conformity with the Queensbury Planning Board as a reasonable use of the land. Approval unanimous. Variance #458 - Jeckel & Sons Equipment Corp., south side of Quaker Road, Zone C-3. To have a free standing sign on the county line property. Attorney John Carusone appeared on Mr. Jeckel's behalf. There were no ather appearances for or against this application. The Queensbury Planning Board approved this application on the condition that the Honda sign would be in a rOWD with the rest of the signs on Quaker Ro ad . Mr. Jeckel was asking for another sign on the building but it was in violation of the sign ordinance and, therefore, withdrew this portion of his application. Mr. Fitzgerald made a motion which was seconded by Mr. Sicard as follows: RESOLVED, that in conformity with the Queensbury Planning Board and the Warren 'County Planning Board this application be approved upon the con6ition that the sign must be in a row with the rest of the signs on Quaker Road and that it be removed no later than ten (10) '.,,,-" -4- 95 years from the date of adoption of the new sign ordinance (guly 27, 1976) ò Three (3) members approved this application and Sjoerdje Richardson disapproved. THE LEAGUE BELIEVES IN STRICT ENFORCEMENT OF THE SIGN ORDINANCE MADE EFFECTIVE AUGUST 14, 1976 viE FEEL ENFORCEMENT IS THE KEY TO SUCCESS OF THIS ORDINANCE.
