1977-07-20 I~~ MINUTES of the public hearing of the Queensbury Zoning Board of Appeals held July 20, 1977, at 7:30 P.M. There were present: John Fitzgerald, Chairman George Kuroaaka Sjeordje Richardson John Silva Kirkham Cornwell Ted Turner Absent: Charles Sicard being members of the Board. The meeting was called to order at 7:36 P.M. by John Fitzgerald, Chairman. On a motion by Ted Turner, seconded by Kirkham Cornwell, the minutes of the June meeting were approved as read. OLD BUSINESS: Variance #498 - Antoinette and Herman Heber Two letters were read - one from Mr. Eddy (as citizen) in favor and one from Mr. Sicard who was absent.. His letter stated that he voted affirmatively. Mr. Norman Benack was present stating the exit on Ridge Rd. was a good idea '-- because of heavy traffic on Quaker Rd. He also questioned the M-l Zone. The Board: Motion made by Ted Turner to approve Variance #498. This motion was seconded by John Silva. Variance #498 received unanimous decision for approval. John Fitzgerald abstained. RESOLVED: 1) Heber's use of the land was more restrictive than the zone required and thus was a reasonable use of the land. NEW BUSINESS: Variance #500 - Atlantic Richfield Company - to erect a canopy to cover gasoline pumps 35 1/2 ft. from front property line in lieu of the required 50 ft. front setback on the property situated at 52 Aviation Road. Richard Smith was preseatas attorney. Sjoerdje brought up the point of too many signs at the pumps. It was not in compliance with sign ordinance of 25% plated glass coverage. Mr. Bodenweiser - fire marshall - was brought in to explain about no smoking signs and stated that there was no authorization for seven of them. 1'f7 -2- Mr. Liapes stated that they had two sign permits & must remove non-conforming signs. Public Appearances: Wayne Judge was present as attorney for the owner of the Blacksmith Shop. He stated the camopy would block the Blacksmith Shop's sign and may hurt business. He also stated how he felt the place was in poor taste. Mr. Smith argued with Mr. Judge to protect Atlantic Richfield Company. The Board: Mr. Fitzgerald suggested that they table the Variance until the Zoning inspector looked at it for more information. This motion received unanimous decision. Mr. Kurosaka abstained. Variance #501 - Noreen J. Kahn - to place a Bake Shop in a detached building with sign on canopy in an R-4 Zone on the property situated at the north side of Luzerne Road. Noreen Kahn was present. She stated that there would be no baking on the premises and there would be retail sales only. It would be run by her family only. Queensbury Planning Board approved and The Beautification Committee stated '-- that no action be necessary. Ther e were no public appearances for or against. The Board: Motion made by George Kurosaka to approve Variance #501. This motion was seconded by Ted Turner and received unanimous decision for approval. Boychuk - to place an addition to a commercial building in an R-4 Zone with a 10 ft. rear setback on the property situated at Mark Plaza, Quaker Road. Mr. Boychuk was present. A pU8lic appearance was made by Mrs. Margaret Prime - town cemetary commission. She was concerned with the boundaries. She came to see a map but was not objecting. Mr. Boychuk explained that it would be strickly storage building with no loading platform. The Warren County and Town Planning Boards approved and the '-, Beautification Committee stated no action'necessary. The Board: --- RESOLVED: ¡'-II -3- Motion made by Ted Turner to approve Variance. #502. This motion was seconded by John Silva. Unanimous decision for approval.
