MINUTES of the public hearing of the Zoning Board of Appeala
held September 21, 1977 at 7:32 P. M.
There were present:
John Fitzgerald, Chairman
George Kurosaka
Ted Turner
Sjoerdge Richardson
Charles Sicard
Kirkham Cornwell Absent, John Silva
being the members of the Board.
On a motion by Mr. Sicard, seconded by Mr. Fitzgerald, the
minutes of the July 20th meeting were approved as read. On a
motion by Mr. Fitzgerald, seconded by Mr. Sicard, the minutes of
the August 17th meeting were approved.
OLD BUSINESS:
"----
Variance #507 - Mobil Oil Corporation - to erect two
circular canopies over existing pumps less than the required
50 ft. front setback in a C-3 Zone on the property situated
at Route 9 at Exit 20 of the Northway.
The Board:
RESOLVED: Application for Variance #507 be approved as
minimum for reasonable use of the property,
with stipulation that if Mobil Oil Company
abandons the station the pumps and canopies
are to be removed with the signs.
Motion made by Turner, seconded by Sicard. The motion
was unanimous.
NEW BUSINESS:
Variance #509 - Morris L. Cleverley Engineering
(McDonald's) - to vary from the Sign Ordinance on the property
situated at Aviation Mall, Aviation Road.
No one appeared for McDonald's. Susan Goetz from the
League of Women Voters appeared against this variance. She

feels it will set a precedent, is not in conformance with
the Sign Ordinance and no hardship shown.
The Board:
RESOLVED: Application for Variance #509 be denied
in conformance with Queensbury and Warren County
Planning Boards and no hardship shown.
Motion made by Sicard, seconded by Cornwell. Unanimous
decision for disapproval of this variance.
Variance #510 - John L. Heckman - to place an addition
11 ft. from the front property line in lieu of the required
30 ft. front setback and 5 ft. from the side property line
in lieu of the required 10 ft. side setback on the property
situated at Rockhurst Road.

John Heckman was present on this variance. Mr. and
Mrs. Noonan, Mr. and Mrs. Congdon and James Farley appeared
in favor of the variance.
The Board:
RESOLVED: Application for Variance #510 granted as
reasonable for use of the property.
Motion made by Sicard, seconded by Turner. Motion
approved.
Variance #511 - James Hermance - to place a 30 ft. by
40 ft. building to house vehicles and store roofing equipment and
supplies in an R-4 Zone on the property situated at Feld Avenue.
James Hermance app...èd and presented a list of neighbors
who do not object to this variance. (See list attached)
The Board:
RESOLVED: Application for Variance #511 be granted as
reasonable for use of the property.
Motion made by Turner, seconded by Richardson. Unanimous
decision for approval.

Variance #512 - Vincent RUQqiero (Paul E. Cushinq Associates)-
to construct a restaurant on a lot 55.5 ft. wide in lieu of the
required 100 ft. in a C-3Zone on the property situated at the
west side of Route 9.

Jerry Caruso appeared on this variance and requested the
Board look at this property. Mr. Caruso has a restaurnat next
to this property and wanted assurance that there would be no
parking of cars on his property. Judy Freiberger appeared.
She stated that the property next tofuis lot was for sale and
asked why they didn't buy more property.
The Board would like more information on proposed building,
on egress and ingress and also on parking, drainage and septic.
Motion by Sicard, seconded by Richardson to table to
October 19th meeting due to lack of information. Motion
carried unanimously.
Variance #513 - Mar10rie C. Pratt - to change a grocery
store to a restaurant and refrigeration equipment sales and
service in an R-4 Zone on the property situated at the corner
of Boulevard and Quarry Crossing.
James Pratt appeared on this variance. He said that
this variance wasfbr commercial restaurant sales and service.
He also said that sign will be on interior of window. Mr.
Crouse who lives next to this property appeared. Has no
objections except that the equipment will be placed outdoors.
Mr. Pratt assured the Board that materials will not be left
outdoors for any extended length of time.
The Board:
RESOLVED: Application for Variance #513 be granted in
concurrence with Queensbury and Warren County Planning

Variance #514 - Bay-Ridqe Volunteer Fire Company. Inc. - to
place an addition to firehouse with a 25 ft. front yard setback
in lieu of the required 30 ft. setback on the property situated
at the north side of Sunnyside Road.
Clarence Elms appeared on this variance for the Bay-Ridge
Fire Company. Arthur Turnbull, owner of land in the vicinity,
stated he had no objections to this variance.
The Board:
RESOLVED: Application for Variance #514 be granted as
minimum for reasonable use of the property.
Motion made by Turner, seconded by Sicard. Unanimous
decision for approval.
Variance #515 - Our Lady of the Annunciation Church - to
place a 30 sq. ft. sign in læeu of the 6 sq. ft. permitted sign
on the property situated at Aviation Road.
Attorney Michael O'Connor, Father French and Father Kelley
appeared on this variance. Mrs. Virginia Straight appeared and
stated that she had no objections.
The Board:
RESOLVED: Application for Variance #515 be granted in
conformance with Queensbury Planning Board and sign to
meet setback requirements of the Sign Ordinance.
