MINUTES of the public hearing of the Zoning Board of Appeals held
June 18, 1980 at 7:30 P.M.
There were present:
Kirkham Cornwell, Chairman
Theodore Turner, Secretary
Daniel S. Griffin
R. Case Prime
Sjoerdje Richardson
Charles Sicard
being members of the Board. Board Member A. Mather Reed was absent.
Staff, Stephen Lynn present.
On a motion by Charles Sicard, seconded by Theodore Turner the minutes
of April 16, 1980 were approved as read.
On a motion by Theordore Turner, seconded by Charles Sicard the minutes
of May 21, 1980 were approved as read.
In the matter of OLD BUSINESS,
VARIANCE #671 (Revised) THOMAS AND PATRICIA BURKE - to create a non-
confirming lot and construct a new dwelling on the property situated at
Mason Road, Cleverdale, Lake George.
Attorney Robert Stewart present on this variance. The Warren County
Planning Board recommended approval contingent upon increased lot size -
increased to 60'x150'. The Queensbury Planning Board recommended approval
of revised variance based on three stipulations. 1. Barn, boathouse, and
house to be taken down. 2. New house constructed with 50 ft. setback from
Lake. 3. Separate septic systems for lot #13 and #14. A letter was read
from John and Polly Hodgkins, dated 6/17/80 requesting Zoning Law be upheld.
All Board members have made a site inspection. Motion by Charles Sicard,
seconded by Theodore Turner to grant this variance with three stipulations
of Queensbury Planning Board. Motion carried unanimously.
RESOLVED: Application for Variance #671 (Revised) be approved
in concurrence with Warren County and Queensbury
Planning Boards with three stipulations of Queens-
bury Planning Board. 1. Barn, boathouse, and house
to be taken down. 2. New house constructed with
50 ft. setback from lake. 3. separate septic systems
for lot #13 and #14.

In the matter of NEW BUSINESS,
VARIANCE #672, RUSSELL T. GREENE - to enlarge a non-conforming use

over 50 percent in C-3 zone on the property situated at 119 Lower Dix Avenue.
Mr. and Mrs. Greene present on this variance. Mr. Greene displayed plot
plans - existing structure 432 square feet - proposed plan to be 1292 square
feet. Addition to have full cellar, residential use. Mr. and Mrs. Arthur
LaCarte present to be sure this would be a residence. They did not want a
store - perfectly happy if used as residence. A letter was read from Mr.
Joseph Daire of Carol Street stating that he had no objection to the proposed
variance request as long as back yard is kept clean. "This will help bring
more tax money to South Queensbury". Motion by Theodore Turner, seconded by
Daniel Griffin to grant this variance. Motion carried unanimously.
RESOLVED: Application for Variance #672 be approved as
reasonable use of property situated at 119
Lower Dix Avenue. This is in concurrence with
the Queensbury and Warren County Planning Boards.
VARIANCE #673, MEADOW RUN DEVELOPMENT CORPORATION - to strip topsoil in
an M-l Zone on property situated at Big Boom Road.
Attorney Robert Stewart present on this variance. Meadow Run Development
Corporation (Charles Wood) owns property on Big Boom Road which is basically
a commercial area, as yet undeveloped. Mr. Wood would like to use topsoil and
sod from this property for some of his other operations. This application has
been approved by EnCon. Motion by Daniel Griffin, seconded by Sjoerdje Richard-
son to grant this variance with stipulation. Motion carried with Kirkham
Cornwell abstaining.
RESOLVED: Application for Variance #673 to be approved with
the stipulation of the Queensbury Planning Board
as follows: Ground to be replanted as per Department
of Agriculture - to be reseeded with Perennial rye-
grass, 20 lbs. per acre. Warren County Planning Board
recommended approval.
