MINUTES of the public hearing of the Zoning Board of Appeals
held July 16, 1980 at 7:30 P.M.

On a motion by Theodore Turner, seconded by Charles Sicard the
minutes of June 18, 1980 were approved as read.
In the matter of NEW BUSINESS,
VARIANCE #674 HENRY AND ALMA HURWITZ - to subdivide a parcel
of property with access by right-of-way to a public road on the
property situated off Gunn Lane, Cleverdale.
Attorney William Bacas, Ray and Jean Nelson, Henry and Alma
Hurwitz present on this variance. This variance is required to
comply with Section 6.201 of the Queensbury ordinance and Section
280a of the Town Law requiring at least 15 foot frontage on a pub-
lic highway. Mr. Bacas - This is not a variance request for a
change of use or change of set back, side line or rear line re-
quirement. The section in question states that unless an owner of
property owns 15 ft. on a public highway in the Town of Queensbury,
then that person or property owner must secure a variance for a
building permit and that is what we seek. The construction that is
proposed is a garage 20' x 20', the erection of a wood patio and to
screen in an existing porch. The proprty has been subdivided and
approved by the APA. In addition Mr. Bacas contends that public
~ road runs to lands of Yanney (map), therefore Hurwitz would be
owners of property on public road and application is academic.

Discussion ensued - Mr. Cornwell stated that the public highway
business was good to know, however, superfluous to the variance
requested. The purpose of the ordinance is so that people who
have landlocked houses have to ask for permission to make sure
they don't overload the access and cause a problem for their
neighbors. Mr. Prime suggested it would be a good idea to put in
the resolution that it "appears that there is public access to the
property". The Queensbury Planning Board recommends approval of
this variance. Motion by Mr. Sicard seconded by Mr. Turner to
grant this variance. Motion carried unanimously.
'RESOLVED: Application for Variance #674 be approved
in concurrence with the Town and County
Planning Boards as it is a reasonable use
of a preexisting right-of-way.
