1980-08-20 J¡5 MINUTES of the public hearing of the Zoning Board of Appeals '- held August 20, 1980 at 7:30 p.m. There were present: Kirkham Cornwell, Chairman Theodore Turner, Secretary Daniel S. Griffin Sjoerdje Richardson Charles Sicard R. Case Prime Mrs. Sue Goetz, League of Women Voters being members of the Board. Board member A. Mather Reed was absent. Staff, Stephen Lynn present. Minutes of July 16, 1980 were approved on motion by Theodore Turner, seconded by Charles Sicard. VARIANCE #675, NORTH COUNTRY IMPORTS, INC. - to place three (3) free-standing signs in lieu of the one (I) permitted free-standing sign on the property situated at 47 Miller Hill. Mr. Kenneth Lendrum present on this variance. Mr. Lendrum felt this an unreasonable request from Subaru and asked that variance request be disapproved. League of Women Voters urged disapproval. Motion by Charles Sicard, seconded by Theodore Turner to deny this variance. Motion carried unanimously. RESOLVED: Application for Variance #675 denied in concurrence with Queensbury and Warren County Planning Boards. The request is in direct violation of our strong Sign Ordinance. VARIANCE #676, RICHARD O. MEAD - to place a tree nursery with pump and tool house in R-3/M-l Zones on the property situated at east side of Ridge Road. Mr. Richard O. Mead present on this variance. Mr. and Mrs. Joseph Miller, 381 Ridge Road - Mrs. Miller has no objection to nursery, requests hedgerow be left in tact. f~. Miller requests '~ 50 foot buffer zone. Mr. and Mrs. Charles LaPolt, 380 Ridge Road - t-j-¿ August 20, 1980 Page 2 '--- Mr. LaPolt concerned with increased traffic on Ridge Road and setting precedent if variance is granted. Mrs. LaPolt asked Mr. Mead to describe access road and amount of traffic. Letter from Mrs. Richard Firth, 1 Meadow Drive against variance. Letter from Dr. James Glendening, 374 Ridge Road in favor of variance request. Queensbury Beautification Committee recommends approval. Motion by Daniel Griffin seconded by Mr. Sicard to approve this variance with stipulation. Motion carried unanimously. RESOLVED: Application for Variance #676 is granted in concurrence with the Queensbury and Warren County Planning Boards, with the stipulation that the land will be used as as tree farm and nursery only, and that a 50 ft. buffer will be maintained between the residents and the nursery. VARIANCE #677, CARON BERNARDO (CLEVERDALE ANTIQUES) - to place an additional free-standing sign on a parcel in a C-l Zone on the property situated at Route 9L and Cleverdale Road. Ms. Bernardo present on this variance. It was suggested by the Warren County Planning Board thåt it be brought to the owner's attention that the complex now qualifies as a shopping center. League of Women Voters recommends approval of this variance if three already existing signs at this complex are removed. Motion by Theodore Turner, seconded by Charles Sicard to table this variance request for further information. Motion carried unan- imously. RESOLVED: Application for Variance #677 is tabled for further information. ',,-- 11 August 20, 1980 Page 3 VARIANCE #678, JAMES DUBIN AND FRANCIS DILLON, JR. - to construct a dwelling on a non-conforming lot with 18 ft. setback in lieu of the required 30 ft. setback in R-1 Zone on the property situated at the corner of Assembly Point Road and Sunset Lane. Mr. and Mrs. Dillon present on this variance, with Mr. John F. Matthews, Builder. Mrs. A1exanderson, Assembly Point, spoke against variance. Stated that Mr. Veeder, original owner, said nothing would be built on this piece of property. Nothing in writing - only deed I restriction on property is easement for pipe line. Mr. Frank Adamo, Jr. spoke against location of proposed home. Mr. Manual Pisari, ) Assembly Point, spoke against variance. Mrs. Doris Hopper, Assembly Point, asked if she could build house on a non-conforming lot she owns. Si tuation not the same as Mr. Dillon's and did not relate to Mr. Dillon's request. Mrs. Ninette Lipstein, Assembly Point, spoke in favor of variance - Mr. Dillon's house would enhance area and increase property values. Mrs. Barbara Heisner - Dillon's should make house smaller. Mr. Herb Heisner asked what type of home would be built and how high. Mrs. Rita Laraia opposes variance - houses too close together. The Warren County Planning Board felt this was a local issue for the Town's sole consideration. The Queensbury Planning Board split vote, 3 for and 3 against. Motion be Charles Sicard, seconded by T. Turner to approve this variance. Motion carried unanimously. RESOLVED: Variance #678 is granted as reasonable use of land, as it is a pre-existing non- conforming lot, with the following stipu- lations: House size 26 ft. by 46 ft. Front setback 30 ft.
