MINUTES of the public hearing of the Zoning Board of Appeals held
September 17, 1980 at 7:30 p.m.
There were present:
Kirkham Cornwell, Chairman

Charles Sicard
being members of the Board. Board member A. ~~ather Reed was absent.
Staff, George Liapes present.
Minutes of Au~ust 20, 1980 were approved. Hotion by Mr. Sicard,
seconded by ~~r. Turner.
VARIANCEf;677 CARON BERNARDO (C1everda1e Antiques) - No one
appeared on this sign variance. No action taken by the Board.
SPECIALPEæUT#92,Leonardo Lorobardo - to place a Miniature
qo1f course in a C-3 Zone on the property situated on the west side
of Route 9 north of Route 149.
Hr. LoMbardo present on this variance. Mr. Lombardo submitted
a new set of plans showin~ parkina for 35 cars. The trees are to
remain in front with screening in back and sides. Mr. George Stark,
owner of the ~~ohican Motel, Route 9 questioned the quality of the
proposed golf course. He had no obj ection. ~"otion by ~~r. Sicard,
seconded by ~~rs. Richardson to grant special perMit. ~~otion carried
unanimously.
RESOLVED: Application for Special Permit #92 be approved
in concurrence with 0ueensbury and Warren County
Planning Boards. Board findinas attached.

SPECIAL PERMIT NO. 92
Leonardo Lombardo, Route 9 north of Route 149
THE BOARD FINDS:
1. The use is one specifically enumerated in the district.
2. Such use will not be prejudicial to the character of the
area.
3. The Board determines that there is appropriate provision
for access facilities adequate for the estimated traffic
from public streets and/or highways and that there are
pedestrian walkways so as to insure public 5afety and to
avoid traffic congestion.
4. That there are full adequate parking areas and off-street
loading spaces, in conformity with the proposed parking
requirements of the zoning ordinance of the Town of, Queens-
bury and all other related ordinances.
5. That suitable planting or screening has been required as
follows:
Tree to remain in front with screening in
back and sides.
6. That such use is of the same general character as, or will
not be injurious to, the surrounding neighborhood or
district.

VARIANCE #679 CliffOrd FUller - to place an addition to a
dwelling with 21 ft. setback in lieu of the required 30 ft. setback
on the property situated at 12 Carroll Street.
Mr. Fuller present on this variance. Motion by ~-trs. Richardson,
seconded by Mr. Griffin to grant this variance. Motion carred unani-
rnously. All Board members visited site.
RESOLVED: Application for Variance #679 be approved in
concurrence with the Queensbury and Warren
County Planning Boards as it is a reasonable
modification of the house.
VARIANCE #680 Helen F. Cuttinq - to place an addition to a dwell-
ing with 25 ft. front setback in lieu of the required 30 ft. setback
in R-4 Zone on the property situated at Sunnyside Road.
~-tr. Cutting present on this variance. Motion by Mr. Griffin,
seconded by Mr. Sicard to qrant this variance. Motion carried unani-
mously.
RESOLVED: Application for Variance #680 be approved in
concurrence with the Queensbury and Warren
County Planninq Boards as it is a reasonable
extension of a preexisting building.
VARIANCE #681 Pyramid Company of Glens Falls - to place a 75 ft.
high, oversize pylon sign on the property situated at the south side
of Aviation Road.
No representative of the Pyramid Company present on this variance.
Mr. A. Lanfear of Birch Lane spoke against variance request. He also
pointed out that liqhting on Cinema siqn is not turned off at 11:00
p.m. League of Women Voters read statement opposing variance request-
it would violate sign ordinance. Mr. Mike Muller, attorney represent-
ing Charles Wood Enterprises spoke aaainst variance as being an un-

reasonable request.

Mr. Cornwell spoke on the incompleteness of the application. He
'-
discussed Variance #414 of November 1975 (Pyramid Mall) at which
time they (Pyramid Mall) said they would never again ask for a
non-conforM~ng sian. Mr. Turner made a motion, seconded by ~~r.
Turner to deny this variance request. Motion carried unanimously.
RESOLVED: The Board denied this variance for reasons
given by Queensbury and Warren County Planning
Boards and with the stipulation that they can
appear per Section 9.704 of the Zoning Ordinance.
The reasons given by Planning Boards for denial
are as follows:
1. Sign oversize and too hi~h.
2. There is means to advertise on the Northway
via Department of Transportation'ID signs.
3. This variance violates all the standards of
the sign ordinance.
