1981-10-21 100 MINUTES Queensbury Zoning Board of Appeals Wednesday, October 21, 1981 7:30 P.M. Present: Kirkham Cornwell, Chairman Theodore Turner, Secretary R. Case Prime Charles Sicard Daniel Griffin Susan Goetz Stephen Lynn, Staff Mack Dean, Staff League of Women Voters Absent: Sjoerdje Richardson Mr. Sicard made a motion to approve the minutes of the September 16, 1981 meeting, seconded by Mrs. Goetz. Motion carried unanimously. VARIANCE No. 729 - Emmanuel J. Maille~ north side of Luzerne Road To operate an auto repair shop in existing garage in an R-4 Zone on the property situated at the north side of Luzerne Road. Mr. Maille present. Mr. Maille submitted pictures of his property to the Board and noted that he is unemployed, taking care of and support- ing two children. He stated there would be no signs and no painting. He will be doing light body and engine work. Mrs. VanDusen, east side adjoining property owner presented petition signed by 32 people against granting of variance. Neighbors afraid of junk yard. The Queensbury Planning Board recommended disapproval of this variance. Motion by Mr. Sicard, seconded by Mr. Turner to approve variance with conditions. Mrs. Goetz voted no, remainder of Board voted yes. Motion carried. RESOLVED: The Board granted this variance because of the unique situation of 300 ft. plus from the road. This variance is for one year to October 1982 at which time the-- Board will review. There is to be no more than 3 registered vehicles in the yard at any time and no signs. VARIANCE No. 730 - Smitty's Tire & Auto Service, north side Corinth Rd., east of pinewood Rd. To place a 24 sq. ft. double-faced, free-standing sign with no setback from property line on the property situated at north side Corinth Road. Mr. Donald Smith and Mr. Robert Platt (Signs of Progress) present. The Board felt that Mr. Smith had not explored all the alternatives for sign placement. Mrs. Goetz asked Mr. Smith to have something in writing regarding placement of State signs required for his business. /~' /0/ Page Two October 21, 1981 '-- The Warren County and Queensbury Town Planning Boards recommended approval of this variance. Motion by Mr. Sicard, seconded by Mr. Cornwell to table this variance to November 18, 1981 meeting for more information. VARIANCE No. 731 - Garden Time, Inc., Aviation Rd. and Carlton Dr. To use and expand existing gas station for Flowershop and Garden Shop in an R-4 Zone on the property situated at the north side of Aviation Rd., corner of Carlton Dr. Mr. Harry Troelstra present. Mr. Troelstra submitted plans for his garden shop, to be a branch of his present business located on Quaker Road. Mr. Gordon Harrington of 2 Carlton Drive spoke in favor of this variance. Mr. Turner read the recommendations of the Queensbury Beautification Committee. Motion to approve variance offered by Mr. Sicard, seconded by Mr. Prime. Motion carried unanimously. RESOLVED: The Board granted this variance as the lot is not a desirable piece of residential land. Under the new zoning it will be Highway Commercial. Also, approval is in concurrence with Queensbury and Warren County Planning Boards. VARIANCE No. 732 - J. Koke & Associates, Inc., Minnesota Avenue To expand a non-conforming use l~ss than 50% with 12 ft. 5 inch side setback in lieu of the required 50 ft. setback between residential and light industrial use on the property situated at Minnesota Ave. Mr. John Koke present. Mr. Koke is leasing property from Richard Sears. He would like to add a loading dock so that tractor trailers would not have to block the street when unloading. If variance is allowed, Mr. Koke plans to purchase building from Mr. Sears and in- vest in upgrading the building. Mr. and Mrs. Charles Adams of Hudson Falls, owners of property adjacent to Sears property spoke against granting of variance. Mr. and Mrs. Robert Hughes, Mr. and Mrs. Arvin Jabot (children of the Adams') also spoke against. They are basically against the business because of the tractor trailers. Mr. Adams brought up the question of the legality of the addition to the building by Mr. Sears, whether or not he had a building permit or was granted a variance, also the length of time the building had been vacant before Mr. Koke leased it. Motion by Mrs. Goetz, seconded by Mr. Sicard to table variance until November meeting to check on history of building. Mr. Jabot noted that a petition had been submitted to the Building Department opposing the variance. Motion carried unanimously. The Board tabled to November 18, 1981 meeting to check history of this building. / () :J. Page Three October 21, 1981 '-- VARIANCE No. 733 - Mobil Oil Corporation, south side of Corinth Rd (Main Street) To place a 53x48 inch, double faced price sign on an existing light pole on the property situated at Corinth Road east of Northway (I-87) Mr. Robert Stewart, Esq. present. Mr. Stewart submitted pictures of area and signs of competitors. His client wants to have the same size sign as competitors. Motion by Mr. Turner, seconded by Mr. Griffin to grant variance. Motion carried unanimously. The Warren County and Queensbury Planning Boards concurred. RESOLVED: The Board granted this sign Variance with the following stipulations; 1. Sign not to exceed 10 sq. ft. to advertise product and price. 2. Setbacks per application. 3. Sign to expire August 1986. Motion to adjourn offered by Mr. Sicard, seconded by Mr. Turner.
