The minutes of the December 16, 1981 meeting were approved on a motion
by Theodore Turner, seconded by Charles Sicard. Motion was carried
unanimously.
NEW BUSINESS:
Variance No. 6 - Alice H. Urband - Old Pilot Knob Road on Lake Geor e
to place a dwelling with 10 t. front setback and 20 ft. rear setback
in lieu of the required 30 ft. front and rear setbacks on the property
situated at Old Pilot Knob Road.
Alice H. Urband was present for this variance.
Mrs. Urband presented a map on which her property is located. She
explained and pointed out where the 2 existing camps are situated and
where the third is to be constructed. Mr. Ed Willis (property owner)
was present to speak in favor of this variance stating that he sees
no problem and that it will be animprovement.
A letter was read from Harold Hayward, a neighbor, who speaks in
favor of the variance.
Mr. Scoville was also present to speak in favor.
Everyone on the Board, except Mr. Turner has visited the site.
Motion by Charles Sicard to approve, seconded by Theodore Turner.
Motion carried unanimously.
Resolved: The Board granted this area variance in
concurrence with the Queensbury and Warren
County Planning Boards. Cottage marked on
application to be removed, will be removed
within 6 months after occupying proposed 3
bedroom residence.

Variance No. 737 - George R. Pensel - Rte. 149 approximately 400 ft.
east of Route 9 - to operate a Boat Sales, Service and Storage with
manufacturing of boat covers and tops on parcel of property zoned
~- C-3 and R-3 on the property situated at Route 149 approximately
400 ft. east of Route 9.
Mr. William Millington, attorney, was present to speak on Mr. Pensel's
behalf. Mr. George R. Pensel and Mr. Duane Peacock (Owner of property)
were also present.
Mr. Millington presented a map of the Duane and Mildred Peacock
property. Much discussion arose on use of C-3 and R-3 zoning.
It's primary use will be for boating business but he wants the right
to have cars too. The Zoning Board sees no problem in keeping the
used car business.
The storage of boats, both new and those of citizens who wish winter
storage and such, will be under canvas for the present time. Manu-
facturing of boat canvas and other related jobs will be in the
existing building.
There were no speakers for or against the variance.
Motion by R. Case Prime to approve, seconded by Sjoerdje Richardson.
Motion carried unanimously.
Resolved: The Board granted this use variance due to
hardship of lot being divided by split
zoning and previous use of the property.
No activity to take place within 34 ft.
of Route 149.
Variance No. 738 - AMG Industries - 53 Luzerne Road - Glens Falls
to place an addition with 17.71 ft. front setback in lieu of the
required 40 ft. front setback in M-l Zone on the property situated
at 53 Luzerne Road.
Mr. Curt Dybas of Paul E. Cushing Associates was present to represent
AMG Industries.
All members of the Zoning Board have visited the site.
New addition is to house office functions. It is presently used
for manufacturing and operations of heavy equipment. Present
building is 10,000 sq. ft.- addition will add 460 sq. ft.
There were no speakers for or against this variance.
A letter from the Beautification Committee was presented and exerpts
were read. They spoke of approval with various beautification
suggestions.

Motion carried unanimously.

Resolved: The Board granted this area variance in
concurrence with Queensbury and Warren
County Planning Boards. There will be no
adverse affect on the neighborhood.
Interpretation N0.9 - Malcolm Mitchell - Route 9L Dark Bay
Interpretation as to whether or not Mr. Mitchell's property is
contiguous of lots on both sides of highway. It is divided by
Route 9L.
Mr. Robert Stewart of Caffrey, Pontiff, Stewart, Rhodes & Judge,
was present on Mr. Mitchell's behalf explaining brief history of
the property. Mr. Stewart discussed the situation of Mr. Mitchell's
house being on one side of Route 9L and the future dock is to be
located on the other side. He stated when Mr. John Matthews (hired
to built dock) went in to the Building Inspector's office to apply
for a standard building permit for the dock, questions arose on
past dock building for John Mason and Maryanne Krupsak. He said
the Building Inspector indicated some similarity to the building
of Mr. Mitchell's dock.
Mr. John Matthews was present to speak on the construction of the
dock and locations.
It was also noted that no cutting of trees, etc. is to be done.
Mr. Frank DeSantis, representing Dark Bay Association, was present
with a map of both sides of the road. It is his opinion, in
agreement with the Town Attorney's letter of one year ago, that the
property is not contiguous and a variance would be needed.
The need for a variance or no need for a variance was discussed at
length with much questioning focused on the contiguousness of Mr.
Mitchell's property for construction of U-shaped dock.
Exerpts were read from the letter in which the Town Attorney states
the need for a variance on this type of property.
Result: A Variance is required. The following vote
was taken:
