Regular monthly meeting of the Queensbury Zoning Board of
Appeals was held Wednesday June 15, 1983 at 7:30 P.M.
Present: Mrs. Goetz, Mr. Griffin, Mr. Turner (Late), Chairman
Cornwell, Mr. Sicard, Mrs. Richardson and Mr. Mills.
The first order of business was the approval of the minutes of
the meeting held May 18,1983. Two minor corrections were
mentioned
Motion by Mr. Sicard, seconded by Mr. Griffin, all voting
affirmatively
RESOLVED the minutes of the meeting conducted May 18, 1983 are
hereby approved subject to corrections.
Approved.
Interpretation No. 20 - Edward P. Carr, Jr. for Paul Knox III
Assembly POint Road - problem with boundary line of property.
Mrs. Goetz asked when the owner was aware of a problem.
Mr. Carr said that this came up upon survey.
Mr. Sicard asked who did the survey with Mr. Carr answering
that Mr. Knox had it surveyed by Rist-Frost.
Mr. Carr mentioned that Mr. Knox is really trying to clear
up the title to his property for the future.
Mr. Mills concerns were that title would be clear if the Board
acted on this.
Mr. Sicard mentioned the definition of subdivision of land
"sale of a small amount of land to correct the boundary line.
The remaining parcel would not lose its building rights
Mr. Carr mentioned that Mr. Knox is concerned that if he does
this for the Tre110s that what he has left has full rights.
Motion by Mr. Sicard, seconded by Mrs. Goetz, that the Queensbury
Zoning Board of Appeals finds that the sale of 1550 sq. ft. by
Paul Knox III to G. Tre110 would be a minor adjustment of boundary
lines as provided in section 2.020-100 and the remaining parcel
building rights of Mr. Knox will be preserved.
All members voted yes.
Approved.
VARIANCE NO. 831 - Joyce Stock (Heidelberg Inn) South side
Quaker Road, Glens Falls, NY
Area Variance - Sign Variance.

Ms. Stock mentioned that the sign is advertizing the Heidelberg
Inn. It would be on Warren County property and she has their

permission to have the sign on County property. The sign will be
a lighted sign.
The Queensbury Town Planning Board recommended approval and
also mentioned that this will expire in 1986.
County Planning Board took no action.
Motion by Mrs. Goetz, seconàed by Mr. Sicard, all voting
affirmatively, it was
RESOLVED that the Queensbury Zoning Board of Appeals hereby
approves Variance No. 831 as a practical difficulty has been
established and that the sign does not have to conform in 1986.
Approved.
VARIANCE NO. 832 - Paul F. Vesterby (88 Acres), north side
West Mountain Road.
Chairman noted that the application would appear to be an extention
of a previously non conforming use. We have to consider the
affect on the neighborhood.
The question was asked as to how big the greenhouse is in
relation to what he already has.
Mr. Vesterby answered that in relationship to his buildings it
is about the size of his main building but probably a little
smaller.
Mrs. Goetz asked where the additional parking would be.
Mr. Vesterby said the parking will be across the road and to the
left of the proposed greenhouse.
Ferne Hall, a neighbor on the south, mentioned that this will
be two (2) businesses under Mr. VanDusen's name.
Mr. Vesterby interjected that he leases the land from Mr. VanDusen.
Chairman Cornwell asked if there would be two (2) signs and
Mr. Vesterby answered that there would be just one (1) sign.
Chairman then asked if there would be any other accessory
buildings.
Mr. Vesterby said that there may be on the end of the greenhouse
for an auxiliary backup system for the heating system.
The Queensbury Town Planning board recommended approval of the

Motion by Mr. Mills, seconded by Mr. Sicard, all voting
affirmatively, it was
RESOLVED that the Queensbury Zoning Board of Appeals hereby
approves Variance No. 832 based on a pre-existing non conforming
use and that it does not change the character of the neighborhood.
Approved.
VARIANCE NO. 833 -Dr. & Mrs. James Glendening, West side Ridge
Road -
Mrs. Glendening was present and represented herself.
Chairman asked when the property was purchased.
Mrs. Glendening said they purchased it in 1976. The lot is
adjacent to ther property and they purchased it because it was
there and the neighbor who owned it wanted to sell. The present
problem came about when we went to sell the permit. She stated
that they wanted to sell the lot but preserve the row of trees.
The problem is the square footage required for dwellings now.
It was important to the area that the trees be preserved.
The Queensbury Town Planning board recommended approval.
Motion by Mrs. Richardson, seconded by Mr. Griffin all voting
affirmatively, it was
RESOLVED THAT the Queensbury Zoning Board of Appeals hereby
approves Variance 833 based on the fact that it was a pre-existing
lot and it is beneficial to save the trees (hedge).
Approved.
VARIANCE NO. 834 - John F. Daley, Jr., Lady Slipper Drive
Mr. Daley said that he would like to build a 2-car attached garage
with a 7 ft. side setback in lieu of the required 10 ft minimum
and a total of 30 ft. for both sides. This was planned under the
old ordinance.
The Queensbury Town Planning Board recommended approval.
Motion by Mr. Sicard, seconded by Mr. Mills, all voting affirmatively
it was
RESOLVED that the Queensbury Zoning Board of Appeals hereby approves
Variance No. 834 based on conforming with the old ordinance
when the house was started.

VARIANCE NO. 835 - L. Rae Gillis, Lockhart Road

To use an existing building as dry storage
Chairman asked Mr. Gillis what kind of storage and Mr. Gillis
answered 'just storage'.
Chairman then asked what kind of repair work in the other building.
Mr. Gillis said auto body repair.
Chairman then noted that what you are planning on doing there is
just to recycle the buildings. Would you be requiring any signs.
Mr. Gillis added that possibly something would be needed.
Mrs. Goetz was concerned with just what kind of storage would be
in the building.
Mr. Gillis then answered dry storage only.
Mr. Turner asked if he was contemplating renting space and Mr.
Gillis said no.
Mr. Gannin explained how he planned to do auto body work in the
smaller building.
The Queensbury Town Planning Board recommended approval.
Mr. Sicard recommended that if it were approved it be approved for
the tenancy of Mr. Gannin as owner operator of the auto repair shop.
Motion by Mr. Sicard, seconded by Mr. Turner, all voting affirmatively,
it was
RESOLVED THAT the Zoning Board of Appeals hereby approves Variance
No. 835 is hereby approved for the owner-operator of the auto
repair shop, Mr. Gannin and for household storage for Mr. Gillis.
This variance is to go with the applicant only.
Approved.
VARIANCE NO. 836 - William Threw - South siàe Sherman Ave.
To manufacture concrete products and store equipment on property
situated at the south side of Sherman Avenue.
Mr. Threw was represented by Attorney Robert Stewart who stated
that the property consists of 25 acres. He mentioned planned

Question was asked as to what would be at the plant itself.
Mr. Threw said that he planned to move his equipment which is now
stored on Luzerne Road to this area.
Threw said he would be making concrete products at the proposed plant.
He also mentioned establishing a buffer zone around the area
Mrs. Goetz next asked approximately how many pieces of equipment did
he propose to keep on the site.
Mr. Threw said he has approximately 15 pieces of equipment to store
there.
Mrs. Goetz next asked if ;they could be seen from the road.
Mr. Threw said no.
At this point the meeting was opened to the public.
Mr. Tucker, Sherman Ave. resident mentioned that there was a petition
signed by residents. The concerns of most of the residents involved
increased traffic.
Mrs. Goetz asked if everyone who signed the petition lived within 500 feet.
Mr. Tucker said no but that all had concerns.

QuePDsbury Planning Board recommended approval.

Mr. Turner asked the bOwers of operation with Mr. Threw stating that all
the trucks would leave at 7 and return at 4:30 P.M.

Motion by Mrs. Richardson, seconded by Mr. ~i11s, it was
RESOLVED that the Queensbury Zoning Board of Appeals hereby denies
Variance No. 836 as granting it would change the essential character
of the neighborhood which is residential and the use requested is
heavy industrial, not light industrial.

VARIANCE NO. 837 - William Threw ( Sherman Ave.)
To place a mobile home park on property situated at the south side of
Sherman Avenue west of Leo Street.
Mr. Threw was again represented by Mr. Stewart.
Mr. Stewart spoke regarding the proposed sizes of the lots for each
mobile home.
Chariman asked if there was water to the proposed area.
Mr. Stewart answered that there is town water in the area.
Chairman next asked if there were sewers in the area.
Mr. Stewart said that is being taken care of.
Mr. Stewart was again asked about the sizes of the lots.
Mr. Stewart added that the smallest lot available would be 60 x 150 which
is ample for a mobi1 home. The sizes will vary according to sizes of homes.
Access will be from Sherman Avenue
SHORT RECESS
Meeting called to order after recess.
Mr. Mates, Sherman Ave. resident, was concerned about the additional load
of people and actually very little more tax money for the town.
The tax structure for Mr. Threw was then explained to the group.
The same group of residents who appeard against Variance 836 appeared and
spoke again with basically the same concerns, traffic and noise.
The Queensbury Town Planning Board recommended approval.

Motion by Mr. Mills, seconded by Mrs. Goetz, all voting affirmatively,
it was
RESOLVED that the Queensbury Zoning Board of Appeals hereby denies
Variance No. 837 based on the fact that none of the criteria was
met for hardship
Variance denied. (Yes votes for denial)
Attorney Stewart requested a true transcript of both Variance 836 and
837.
Motion by Mr. Mills, seconded by Mr. Griffin all voting affirmatively,
