RESOLUTION DECLARING EMERGENCY

' WHEREAS, it has been brought to the attention of the Town,af,Queensbury 8oar-0,, :Health
that the Reservoir Park Sewer District has been experiencing septic system failure causing
raw sewage to flow on the ground, in or near,individual homeownersibackyards. and
WHEREAS, based upon personal inspection by at least one Board Member, letters and oral
communications received, it is the judgment of the Town of Queensbury Board of Health that
the Reservoir Park Sewer failure is detrimental to the public health and ts,an,emergency situation
which must be immediately addressed by the Town of Queensbury, and
WHEREAS,
pursuant to Section 308 of the Public Health Law, the Town of Queensbury Board
of Health may make orders for the suppression of nuisances and concerning all other matters
r in its judgment detrimental to the public health.

RESOL VED, that the Reservoir Park Sewer failure and the situation resentl existin J

Reservoir Park Sewer District is detrimental to the public health and comprises an emergency
situation which must be immediately addressed, and

k. RESOL VED, AND ORDERED, that the Town of Queensbury through the Town Board of the
Town of Queensbury, immediately make arrangements to resolve the Reservoir Park Sewer
failure by repair or otherwise.

WHEREAS, the Reservoir Park Sewer District has been experiencing septic system failure,
and
WHEREAS, the Town of Queensbury Board of the Health has found that the Reservoir Park
sewer failure is detrimental to the public health and has ordered that the some be immediately
addressed by the Town Board, and
WHEREAS, it is the opinion of the Town Board that an emergency exists which affects the
health of the inhabitants of the Reservoir Park Sewer District and which requires immediate
action by the Town Board of the Town of Queensbury,
WHEREAS, pursuant to Section 103 of the General Municipal Law, the Town of Queensbury
has the power to Jet contracts for public work without competitive bidding when an emergency
exists concerning the health of the inhabitants of the Town,
NOW, THEREFORE BE IT
RESOL VED, that this Town Board of the Town of Queensbury hereby finds that an emergency
situation exists and that the health of the inhabitants of the Reservoir Park Sewer District
requires that the Town Board of the Town of Queensbury takes immediate action to let and
contract for the public work, and
BE IT FURTHER,
RESOLVED, that the Town Board of the Town of Queensbury hereby retains the services of
W.W. Maille to engage in a repair of the Reservoir Park Sewer District system such that the
expulsion of raw sewage upon the surface of the ground is eliminated and to generally repair
the system so that it is properly functioning, and
BE IT FURTHER,
RESOL VED, that the cost of repair shall be paid for by the use of serial bonds or bond anticipation
notes, the some to be authorized by resolution at a future date.
