Regular monthly meeting of the Queensbury Zoning Board of
Appeals held April 18, 1984

Present: Mr. Griffin, Mr. Turner, Mr. Sicard, Mr. Muller and
Mr. Mills
Absent: Mrs. Goetz
Acting as chairman for this meeting was Mr. Sicard
Motion by Mr. Turner, seconded by Mr. Griffin, all voting
affirmatively
RESOLVED THAT the minutes of the meeting conducted Feb. 15, 1984
are hereby approved.
Approved.
Motion by Mr. Mills, seconded by Mr. Turner, all voting
affirmatively
RESOLVED THAT approval of the minutes of the March 21, 1984
meeting be postponed until the May meeting.
Approved.
VARIANCE NO. 894 - William P. Hunt -
Acting Chairman, Mr. Sicard, asked if Mr. Hunt was present, he
explained that this was held over from the last meeting. Mr.
Hunt was not present to explain his situation.
Motion by Mr. Sicard, seconded by Mr. Þ1uller all voting
affirmatively
RESOLVED THAT the Queensbury Zoning Board of Appeals hereby denies
VARIANCE NO. 894 for lack of information that was requested by
the Zoning Board of Appeals at the meeting conducted March 21,
1984.
Approved.
(Affirmative vote Yes to deny)
VARIANCE NO. 904 - Great Bay Seafood Restaurant
To place addition for cooler with less than the required set-
back. Represented by Mr. Hotmer.
Representative explained the need for this addition and why
it is being planned. He also explained that this will be a
walk-in cooler.
Queensbury Town Planning Board recommended approval along with
the Warren County Planning Board
Motion by Mr. Muller, seconded by Mr. Mills, all voting
affirmatively,
RESOLVED THAT the Zoning Board of Appeals approve Variance No. 904

as he has demonstrated the practical difficulty in that there
is no other place to put the cooler and that there will be no
adverse affect on the neighborhood.

VARIANCE NO. 905 - Ralph G. and Kathryn L. Brown - to con-
struct an attached garage with less than required IS ft.
setback in single family residential zone.
Mr. Brown was present.
Mr. Brown explained that the house is in the middle of the lot
20' from the side. He would like to put the addition on the
side of the house where the neighbor is 65' away. He would
like a I-car garage.
Chairman asked if anyone on the board had any questions.
Mr. Mills asked if the telephone pole was on the property line
and Mr. Brown said yes.
Mr. Griffin asked the width of the planned garage and Mr.
Brown said 14'.
Meeting opened to the public
No one present for or against application.
Town Planning Board recommended approval.
Public hearing closed.
Motion by ~1r. Griffin, seconded by Mr. Turner, all voting
affirmatively
RESOLVED that the Zoning Board of Appeals approves Variance
No. 905 as it is a reasonable request and the practical diffi-
culty has been shown as far as placement of the garage and
there is no significant impact on the neighborhood.
Approved.
VARIANCE NO. 906 - L. Thomas Warner, King George Cabins to
place a pool in the front yard of tourist cabin facility in
Highway Commercial zone.

Mr. Warner explained the reasons why he needs to put the
pool in the front area instead of the rear. The main reasons
for this were that there are trees and power lines to the
rear.
The Town Planning Board suggested that the pool be turned side-
ways on the property.
Chairman Sicard asked Mr. Warner if he was agreeable with this
suggestion and he he was.
Mr. Turner added that with the lay of the land he does seem to
have a problem.
The Public Hearing was opened and closed.
Town Planning Board recommended approval with the stipulation
that the pool be turned with the long dimension parallel
to Route 9.
Warren County also recommended approval.
Motion by Mr. Mills, seconded by Mr. Muller, all voting
affirmatively
RESOLVED THAT the Queensbury Zoning Board of Appeals approves
Variance No. 906 based on the difficulty of location with
respect to trees and power lines and the pool to be turned
with long side parallel to Route 9.
Approved.
VARIANCE NO. 907 Amerada Hess Corp.
To place additional signage on front and side of Hess Mart
building in Highway Commercial IS Zone.
Represented by Mr. Hoover.
Mr. Hoover reminded the Board that previously they had approved
3 signs and they would like to add 5 more.
After discussion about where the signs would be placed, the
general feeling among the members present was that they already
had adequate signing.

Mr. Raymond Palmer, a resident of Pine Street, concerned about
the traffic problems now and what would be created later. Aslo
asked if any of the signs would be lighted.
Mr. Hoover explained the signs would be lighted but not too
bright.
The Town Planning Board recommended approval as the total number
of signs is well below what is allowed.
Warren County Planning Board also recommended approval.
The question was asked of Mr. Hoover if any of their stations
lowered the density of their lighting at night and he said
none that he knew of.
Mr. Muller interjected that this is a lot of signs being asked
for here tonight. His feelings were that these additional
signs would be an adverse affect on the character of the
neighborhood.
After discussion between members the following resolution
was offered:
Motion by Mr. Mills, seconded by Mr. Muller, all voting
affirmatively
RESOLVED THAT the Queensbury Zoning Board of Appeals approves (
Variance No. 907 with conditions either/or of the following:
1. 3 signs on facade
or
2. 3 signs on building 4 x 5
Approved.
VARIANCE NO. 908 - Richard Sears, Tree Experts
To construct storage building for tree service business in
Urban Residential 10 zone. Represented by Mr. Sears.
Chairman Sicard asked Mr. Sears what, if anything, else other
than his equipment would be stored in the building.
Mr. Sears answered that possibly some boats along with his
equipment would be in the building.
Chairman then asked if you could see the building from the main
road and Mr. Sears said absolutely not.
Mr. Griffin asked if the concrete building in the area now was
his building and Mr. Sears said it was.

The Queensbury Planning Board recommended approval.
Public Hearing opened.
Mr. Edward Leahy, General r1anager of the Sheraton Motor Inn
stated that they had no objections to the proposal after
having it explained as to just where the property was located.
Mr. John Sperry, Dixon Road mentioned that there would be no
adverse affect to the neighborhood whatsoever.
Public Hearing closed.
Motion by Mr. Mills, seconded by Mr. Griffin, all voting
affirmatively
RESOLVED that the Queensbury Zoning Board of Appeals approves
Variance No. 908 as it is a pre existing non conforming use
and no adverse affect on the neighborhood with no additional
traffic.
Approved.
VARIANCE NO. 909 - Joseph E. Ramsey -
To construce an addition for storage area to service station
with 12 ft. side setback in lieu of required 20 ft.
Chairman explained where the proposed addition would be to
the existing building.
All members felt that the practical difficulty has been shown.
Mr. Turner mentioned also that this is needed because of the
vandalism in the arenin particular to his property.
Town Planning Board recommended approval as did the Warren
County Planning Board.
Motion by Mr. Muller, seconded by Mr. Turner, all votin
affirmatively,
RESOLVED THAT the Queensbury Zoning Board of Appeals approves
Variance No. 909 as the practical difficulty has been shown as
the existing building could not be moved, because of vandalism
done to property the addition will take care of the storage of
the vehicles on premises. The existing building couldn't be
enlarged or moved and request is reasonable for area.

VARIANCE NO. 910 - Frank Cottone - Tri-County Kitchens
To construct a 30 ft. by 50 ft. addition with less than
50 ft. side setback from a residential use in Highway
Commercial 15 zone.
Mr. Cottone was present.
Mr. Cottone explained that there would be fencing on each
side of the proposed building addition.
Chairman asked him how high the fence would be and he mentioned
the fence would be about 6 ft. high.
Mr. Mills asked if there was any flack from the residents in
the area.
Mr. Cottone answered that neighbors from across the road came
over and told him that he has improved the area since his
operation has been there.
Mr. Dean, Building Inspector, interjected that his office had
received a call from a neighbor stating there was no problem
with the addition.
The public hearing was opened and closed.
Town Planning Board recommended approval along with the Warren
County Planning Board.
Motion by Mr. Griffin, seconded by Mr. Muller, all voting
affirmatively
RESOLVED THAT the Queensbury Zoning Board of Appeals approves
Variance No. 910 as it would improve the appearance of the
property, and the practical difficulty to do anything else has
been shown and there would be no adverse affect on the
neighborhood.
Approved.
Motion by Mr. Mills, seconded by Mr. Muller, all voting
affirmatively,
RESOLVED THAT the meeting adjourn.
