1984-10-17 3),3 Regular monthly meeting of the Queensbury Zoning Board of Appeals held October 17, 1984. ~ Present: Mr. Behr, Mr. Griffin, Mrs. Goetz, Mr. Turner, Mr. Sicard, Mr. Muller and Mr. Mills. Absent: None The first item before the Board was the approval of the minutes of the September meeting. Mrs. Goetz had a correction to Variance 940 to be added to resolution as follows: so that cars don't have to back on to Ridge Road. Variance No. 944 - as follows: Regarding the display of boats. Spelling of the name Steven Zemanek to be corrected. Motion by Mrs. Goetz, seconded by Mr. Muller, all voting affirmatively, it was RESOLVED THAT the minutes of the September meeting are hereby approved subject to mentioned corrections. Approved. VARIANCE NO. 947 - Terrance L. Collins - to construct an addition to dwelling with less than required side setback in a single family residential zone. Mr. Collins represented himself. Mr. Turner asked where the present septic system was located and Mr. Collins showed its position of a map of property. Mr. Beher asked what he would do with the garage and Mr. Collins said he would leave it as it is now. Public Hearing opened and closed. Motion by Mrs. Goetz, seconded by Mr. Griffin, all voting affirmatively, it was RESOLVED THAT the Zoning Board of Appeals approves Variance No. 947 as the practical difficulty has been shown in the size of the lot which was allowed under the prior ordinance and it will not affect the character of the neighborhood. Lf Page 2 October 17, 1984 VARIANCE NO. 948 - Adirondack Machine Corporation - to construct a storage building for existing light manufacturing business. Represented by Mark Branson ......- Mr. Behr noted that there aren'tmany homes kept as good as this building. Public Hearing opened. Mr. Curtis Mayott resident across the road from the present building said he had no objection to this proposed building. A letter from Ruth Hadley basically had no objection her only concern was would it increas the traffic flow in the area. Warren County Planning Board approved the request. Public Hearing closed. Motion by Mr. Muller, seconded by Mr. Sicard, all voting affirmatively, it was RESOLVED THAT the Zoning Board of Appeals approves Variance No. 948. The applicant has demonstrated a hardship being that although it is zoned residential use in fact it has never been used as residention. Approved. VARIANCE NO. 949 - Masonic Hall Association of Glens Falls - to construct a Masonic Lodge in a Urban Residential zone on the east side of Bay Road norty of Bay Meadows Golf Course. Mr. George Savalle was present to represent the Trustees. Attorney Matusik was representing the present owners of the property in question. The property has been for sale for several years. Mr. Savalle mentioned the present high costs of their building in Glens Falls and that they have sold the building. He mentioned that the new building would be available when not being used by their organization for other community service groups. Mr. Behr questioned Mr. Savalle about proposed parking facilities. Mr. Savalle had a rendering of the proposed building and surrounding area and pointed out to the Board where the parking would be and where the overflow would be. Mr. Behh then asked if the organization could foresee there being parties such as weddings that would create noise. Mr. Savalle said that they have opened there present building to weddings but there has never been any complaints from the area residents as far as noise. '- 32.;- Page 3 October 17, 1984 Mrs. Goetz asked if he could foresee putting up a pavilion to the rear that could be disruptive to area residents. Mr. Savalle said they had no immediate plans for anything like ,~ that and could not see that it would come up in the future. The main purpose of the building is to hold the business meetings of the Temple. We aren't planning a facility as large as the Elk Lodge. Mr. Sicard mentioned the septic system and Mr. Savalle said that he has made his own perk tests none done professionally and the perk rate in the area is very good. Mr. Sicard then mentioned the bike and walking traffic in the area and asked again about the'parking. Mr. Savalle said the parking would be setback against the building. Mr. Mills asked how many cars they would be able to park. Mr. Savalle said they have 35 spaces designated. Public Hearing opened. John Hughes said he would rather see plans for the whole property rather than a small portion. Mr. Griffin asked Mr. Hughes if he was against this proposal and he said he would have to say yes unless he could see the overall plans. The question was asked of Attorney Matusik if there are any known uses at this time for the rest of the property and he said there were no other plans at this time. Mr. Hughes mentioned the reason the property was on the market for so long was the high price asked. Mr. John McNairy residence across from the farm house said he was in opposition. He questioned when the people would be there. Mr. Saville that the meetings are during the evening hours. Letter from the Queensbury Beautification Committee was read. Letter in opposition from H. Y. Bain 7 Bayberry Court read. Mr. Behr noted that he did not think that the four (4) conditions in any way have been proven. The hardship is self-imposed. Motion by Mr.Behr, seconded by Mr. Muller, all voting affirmatively, it was (affirmative-yes vote was to deny) RESOLVED THAT the Zoning Board of Appeals hereby denies Variance No. 949 because no unusual hardship has been demonstrated. _. Page 4 October 17, 1984 3~~ Mr. Muller noted before the vote was taken that he agrees in principle with Mr. Behr. The applicant has not satisfied all four (4) points for a use variance. To grant this would be offensive to the overall plan for that area. '--' Variance denied. VARIANCE NO. 950 - Cool Insuring Agency - to place a free- standing sign on Warren County Right of Way. Represented by Mr. Bird from Crandall Associates. Because Mr. Bird did not have pertinent information regarding the sign it was decided to table until the next meeting. Motion by Mrs. Goetz, seconded by Mr. Muller all voting affirmatively, it was RESOLVED THAT Variance No. 950 be tabled due to lack of information. Approved. The Board would like to see a diagram showing the plans for the sign and a letter from the Warren County Highway department. VARIANCE NO. 951 - Dale and Florence Jarvis - to create two (2) lots each with an existing dwelling with less than the required frontage. Attorney William Nikas represented the Jarvis family. He explained that both Jarvis sons have been paying on the property that their parents purchased and now one son wants to sell and the property bust be separated. Public Hearing opened and closed. Warren County Planning Board approved. Motion by Mr. Sicard, seconded by Mr. Behr, all voting affirmatively, it was RESOLVED THAT the Zoning Board of Appeals approves Variance No. 951 as it is a reasonable use of the lot. The practical difficulty is that the lot pre dated the present ordinance. Approved. VARIANCE NO. 952 - Earl J. Spellburg - to construct new and larger porch addition to dwelling with less than the required front setback. Mr. Spellburg represented himself. Motion by Mr. Sicard, seconded by Mr. Griffin, all voting affirmatively, it was RESOLVED THAT the Zoning Board of Appeals approves Variance No. 952 as this is a reasonable use of the property.
