1985-06-19 ofð -~ Meeting of the Qaeensbury Zoning Board of Appeals held Wednesday June 19, 1985 at 7:30 P.M. Present: Mr. Behr, Mr. Griffin, Mrs. Goetz, Mr. Turner, Mr. Sicard and Mr. Muller Absent: None First item on the agenda was the approval of the minutes of the r.1ay meeting. Motion by Mr. Sicard, seconded by ~1rs. Goetz, all voting affirmatively, it was RESOLVED THAT the minutes of the meeting conducted May 15, 1985 are hereby approved subject to any corrections. , Approved. VARIANCE NO. 999 - Walter Barthel, Pilot Knob road - to reuse existing camps as rental units in Lakeshore residential 1 acre zone. Mr. Barthel was present representing himself along with Attorney Tarantino. Attorney Tarantino spoke about the personal hardship put upon Mr. Barthel and that Mr. Barthel would comply to any stipulation imposed by the Zoning Board. The Board of Health approved with conditions. Warren County Planning Board approved. Michael Hyde, Lake George Association spoke but said they were not opposed to the request. Motion by Mr. Turner, seconded by Mr. Muller, all voting affirmatively, it was RESOLVED THAT the Queensbury Zoning Board of Appeals hereby approves Variance 999 as the hardship has been shown and all items set forth by the Queensbury Board of Health are hereby incorporated in this resolution. Approved. VARIANCE NO. 1000 - Allen's Arts and Crafts - to place a 4 ft. by 10 ft. sign on existing Zayre pylon in Highway Commercial 15 zone on property west side of Route 9 - Zayre Plaza. "- Represented by the owner, Jane L. Burnham. Mr. Behr asked if the sign has to be the size requested and if they have ever considered getting together with the other tenants. ).1 Page 2 Zoning Board June 19, 1985 """", Mrs. Burnham mentioned that no one has ever mentioned getting together as a group. She went on mentioning the Sysco sign which was granted. Mr. Muller brought up the hardship proved by Sysco. Mr. Behr added that this craft shop has been in this location for five (5) years and if everyone in the plaza itself could get together and re-construct and re-design a sign which would include all tenants it would be better than each individual store requesting their own addition to the present pole. Public hearing opened and closed. Warren County Planning Board approved. .Motion by Mr. Sicard, seconded by Mr. Turner, it was RESOLVED THAT Variance No. 1000 be approved, there is no other way and this will be re-assed in July 1986 when compliance of all nonconforming signs becomes applicable. Britton - to expand a nonconforming use in suburban residential 30 zone, property south side of Cronin Road. Represented by Attorney Tarantino - Mr. Tarantino said that this is a concrete block building previously used for light industrial and Mr. Britton is planning to use this just for office space. He mentioned that this is a group licensed in the area of explosive supply. This particular area is not intended for the storage or manufacture of explosives of any kind. There will be a substantial improvement to the building. Mr. BEhr questioned corporate vehicles. Mr. Tarantino said there will be corporate vehicles but no storage of any kind. He introduced Mr. Britton owner of the business. Mr. Britton explained that it is against the law to store explosives on a truck over night, there are very strict laws against this. Mrs. Goetz asked where the trucks would be stored and Mr. Britton answered to the rear of the building there is plenty of room available. .2..1. Page 3 ~ Zoning Board June 19, 1985 Mr. BEher asked if the trucks would have any painting on them to indicate explosives. Mr. Britton explained that by law his trucks have to have it displayed that they have explosives on them. Question was asked if the building would be demolished and Mr. Britton said the building will stay basically the same way it is now all they are doing is to improve it. Mr. Turner questioned the septic system and Mr. Britton said that whatever has to be done will be done. Mr. Turner asked if there was a water problem. Keith Hendry, present owner of the property, said there is a small drainage problem. Mr. Muller asked when the last tenant vacated the property and Mr. Hendry said just a couple months ago. Public Hearing open. Jan Bishop spoke opposed to the request. Brian Clements, northerly side of Cronin Road, questioned the possibility of explosives on trucks there during the day. Mr. Britton said that he couldn't say that there wouldn't be explosives on the truc~at all. The trucks would have no explosives during the night but might stop during the day. Mr. Behr asked if he, Mr. Britton, could live with approval but with no trucks on the premises and Mr. Britton said he couldn't under those conditions. Another gentleman whose name I could not understand also spoke against the request. Queensbury Beautification Committee disapproved. Public Hearing closed. Motion by Mr. Sicard, seconded by Mr. Griffin, all voting affirmatively, it was '-" RESOLVED THAT Variance 1001 be approved as follows,: No trucks to stop at any time with explosives on, must meet with the Queensbury Beautification Committee and abide with any request. VARIANCE NO. 1002 - Amerada Hess Corporation - to construct a storage building at less than the required side yard setback on property 8l Main street, corner of Pine St. Represented by William WolfrQØ - Mr. Wolfrom explained that he is the manager of Real Estate for the Hess Corporation. He also explained the need and use of the new building. He added that there would be no sanatiary facilities in the building it will be used just for storage. Public Hearing opened and closed. Warren County Planning Board approved. Motion by Mrs. Goetz, seconded by Mr. Griffin, all voting affirmatively, it was RESOLVED THAT Variance No. 1002 be approved the practical difficulty is the location of the underground storage tanks and drain field, the necessity to allow for truck turn around and storage is needed and it will not affect the neighborhood character. Approved. VARIANCE NO. 1003 - Glen Bruening to convert seasonal dwelling (unused) to limited water sports retail store in neighborhood commercial 1 acre zone property at Ridge Road and Cleverdale Road. Represented by Attorney Robert Stewart who questioned the need for a variance. He also said there would be no motorized products of any kind mostly sailing boats of all description. Mr. Behr questioned the parking and Mr. Bruening explained where the parking would be in relation to the building. Mr. Bruening also said he is fixing up and painting the small building Warren County Planning Board approved. Public Hearing Opened Frank Munoff questioned the parking. Motion by Mr. Griffin, seconded by Mr. Sicard, all voting affirmatively, it was RESOLVED THAT Variance No. 1003 be approved - there is no adverse affect on the neighborhood, no motorized vehicles for sale or repair, the hardship is the business is not listed under neighborhood commercial. ~,,--/ Approved. 02; '-----' Page 5 Zoning Board June 19, 1985 VARIANCE NO. 1004 - Daniel A. & Virginia Lambert - to construct addition to dwelling with less than required 30 ft. front setback in Urban Residential 10 zone. Property located Twin Channels Road. Mr. Turner asked whey the addition is~~t:nned for the rear and Mr. Lambert said because of the trees: ,!"'""'\ Mrs. Goetz asked why they couldn't go to the side and Mr. Lambert said because of the property line. Public Hearing opened and closed. Motion by Mr. Turner, seconded by Mr. Muller, all voting affirmatively, it was RESOLVED THAT Variance No. 1004 is hereby approved, the lay of the land dictates the location of the addition. application has been made to change the location of the system. geographic The septic At the end of the variance requests for the evening there was discussion regarding Apple Anne's. The dumpster has been moved. The Beautification Committee and the owners are still not getting together. The main area in question is the area in front of the building, the committee wants the blacktop removed and the owner does not agree to do it. They have complied with most of the requests and this should be acted on either for or against now. It was next decided to grant the variance with no conditions. Motion by Mr. Sicard, seconded by Mr. Muller, all voting affirmatively, it was RESOLVED THAT VARIANCE NO.975be granted with no conditions added. Approved.
