Meeting of the Queensbury zoning Board of Appeals held
~ Wednesday, December 18, 1985 at 7 :30 P.M.
PRESENT: Mr. Behr, Mr. Griffin, Mr. Turner, Mr. Sicard and

ABSENT: Mrs~ Goetz
First item on the agenda was the approval of the minutes of
the November meeting~
Motion by Mr. Sicard, seconded by Mr. Turner, all voting
affirmatively, it was
RESOLVED THAT the minutes of the meeting conducted·· N-oV'ember
20th are hereby approved subject to any corrections.
Approved.
VARIANCE NO. 1033 - Mr. Lee Gifford's Mobile Station, south
side of Main Street - to leave existing Mobile sign up until
August when it must come down.

Mrs~ Gifford was there representing her husband Lee.
Mrs. Gifford stated that the sign helps business because of
pricing on it and that Mobile pressures owners to have signs
up.
Mr. Behr asked what hardship would incur without the sign?
Mrs~ Gifford - not much.
Beautification Committee opposes sign.
Warren county planning Board disapproves.
Motion by Mr. Behr, seconded by Mr. Kelley, all voting
negative, it was
RESOLVED THAT the Queensbury zoning Board of Appeals hereby
denies VARIANCE 1033 because no hardship or conformity has
been shown.

VARIANCE,NO. 1045 - Wayne pelak (Imperial Motel) 20 Dorset
place - to construct an addition to existing motel with less
than the re~uired setbacks in plaza 1 Commercial 1 Acre and
Urban Residential 5 zones on the property situated at
Aviation Road - across from Aviation Mall.
Mr. pelak was there representing himself along with Attorney
Davies.
Attorney Davies spoke of the personal hardship and stated
business is now marginal (mostly summer business). With
the addition to the motel they could possibly get some of
the winter ski tours to help business.
Mr. Behr asked if there is any reason why they can't remove
the existing last unit and begin the new unit in it's place,
which would provide for a bigger buffer between the new
units and the residential property.
Attorney Davies stated that it would be a big expense and
not really practical but that Mr. pelak was willing to put
more trees in and that the motel units themselves would act
as a buffer zone.
Mr. Behr did not consider that to be true.

Mr. Pelak stated he was only asking for the best and most
reasonable use of a very expensive piece of property.
Mr. Behr said he, Mr. pelak, knew what he was getting when
he bought the property.
Public Hearing Open.
Mr. Burns, who owns the property in back of the motel stated
that the property lines are wrong. At this time Attorney
Davies assured everyone that the survey was OK'd by Mr. Rich
Keyes.
Mr. Burns is opposed to the placing and height of the
building not the building itself.
Attorney Davies stated the builders plans can be altered to
remove the last unit and build out from there.

Mr. Turner asked if they would like to amend application now
for approval.

Attorney Davies replied yes.
Mr. Burns said he still has a problem with survey lines.
Mr. Britt, who also owns property in back of the motel,
stated he also has problems with the survey. He also stated
he sees no hardship in any way. He objects on all grounds,
particularly the buffer zone problem.
A letter was read from Mr. Troelstrawho runs the Silo next
door. He has no objections to the plan.
Warren county planning Board approved plan with no comment.
Public Hearing Closed.
Motion by Mr. Kelley, seconded by Mr. Muller with the
consideration that pine trees are retained in buffer zone,
vote, one negative \Mr. Behr), all others affirmatively, it
was
'- RESOLVED THAT Variance 1045 be approved as follows: Amend
plot plan #1 and consider plot plan #::¿, retain 17' setback
on one end and 24' on the other, retain buffer zone of
trees, meet with the Queensbury Beautification Committee and
abide with any requests they may have.
Approved.

VARIANCE No. 1046 - Myron S. Rapaport, Burnt Ridge Road off
Old Assembly point Road - to construct addition to dwelling
with 45' setback from lakeshore in lieu of the required 75'
setback from lakeshore Residental 1 Acre Zone on the
property situated on Burnt Ridge Road off Old Assembly point
Road.

Represented by AttgrR~ Roulier who brought blueprints. He
explained that, because of the steep, rocky incline at the
rear of the house, the library addition could only be
located as requested.

Mr. Mike Hyde, Lake George Association opposed this addition
because a similar variance was granted last year for the
same property.

Warren County planning Board approved with no comment.
Motion by Mr. Griffin seconded by Mr. Sicard, all voting
affirmatively, it was
RESOLVED THAT Variance No. 1046 - be approved because the
geographic lay of the land dictates location of the
addition. There is no adverse affect on the neighborhood.

V ARIANCE No ~ 1047 - Earl and Millie Maille, Luzerne Road and
Connecticut Avenue - to construct and operate a laundromat
in urban Residential 5 Zone on the property situated at
corner Luzerne Road and Connecticut Avenue.
Mr. Maille was present representing himself. He stated it
',- would be a 24' x 40' flat roof building holding 10 washers,
10 dryers and 2 big boy washers.
Mr. Behr asked if there would be ample parking for the
facility?
Mr. Maille stated there would and that the entrance would be
off Ohio Street not Luzerne Road.
Public Hearing Open.
Mr. Will Trombley stated he is opposed only if the kids turn
it into a hangout.
Mr~ Maille said the facility would be open from 6:00 A.M. to
10:00 P.M. and he would make sure this did not happen.

Committee.

negative (Mr~ Kelley), all others affirmatively, it was
RESOLVED THAT Variance No. 1047 be approved - there is no
adverse affect on the neighborhood and it is a much needed
facility in this area.
