RESOLUTION AUTHORIZING INTERMUNICIPAL AGREEMENT
WITH THE TOWN OF MOREAU FOR THE SALE OF WATER

WHO MOVED ITS ADOPTION

WHEREAS, the Town of Queensbury has a water treatment plant which currently has capacity
in excess of its residents’ use, and
WHEREAS, the Town of Moreau wishes to obtain water from the Town’s facility, and
WHEREAS, the Town of Queensbury wishes to supply the Town of Moreau with water from
its facility, and
WHEREAS, the Towns of Queensbury and Moreau have negotiated terms for an
Intermunicipal Agreement for the sale of water, and

WHEREAS, on December 8, 1998, the Town of Moreau adopted a Resolution approving the
Intermunicipal Agreement, and
WHEREAS, a copy of a Draft Intermunicipal Agreement for the sale of water has been
presented at this meeting and the Town Board has determined that such Agreement would be in the
best interests of the Town, its residents, and its Consolidated Water District,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Queensbury hereby approves of an
Intermunicipal Agreement with the Town of Moreau, substantially in the form presented at this
meeting, which Agreement shall be modified to incorporate a provision specifying that this project is
not subject to and is exempt from the State Environmental Quality Review Act (SEQRA) because it is
being taken pursuant to an environmental enforcement action in United States District Court and
judicial decree in that action, for the sale of water from the Town’s water treatment facility, and
BE IT FURTHER,
RESOLVED, that the Town Board of the Town of Queensbury hereby authorizes and directs
the Town Supervisor to execute an Intermunicipal Agreement in form approved by Town Counsel and
take such other and further action necessary to effectuate the terms of this Resolution.
