Pursuant to your recent request, the above permit is hereby
amended and extended to December 31, 1989 to enable completion of the
project. The project description has been amended to read: "Construct
a "U" shaped 26 'x34 ' rock filled timber cribbed dock on Lake George as
shown on the attached sketches. " .
This letter is an amendment to the original permit and, as such,
is incorporated into the original permit . All original special permit
conditions remain in effect for the duration of this permit extension.

19. All necessary precautions shall be taken to prevent contamination of any waterway by

concrete, or any other deleterious materials associated with the project.
20. Stone used for filling must be clean and shall not be less than 6 inches in diameter.
Completed cribs shall be of the "open-sided" type construction and provide for at least
40% unboarded water contact area to the rock fill .

22. Heavy equipment including bulldozers, backhoes, payloaders, etc. , shall not be driven

23. This permit is conditional on the permittee obtaining, if appropriate, a grant of
easement through the Office of General Services for lands under the water.
24. A DEC permit sign is to be conspicuously posted at the work site, protected from the
weather, for the duration of the project.
25. The permittee shall require that any contractor, project engineer, or other person
responsible for the overall supervision of this project reads, understands, and
complies with this permit, including all special conditions to prevent environmental
degradation.
26. The Fire Control Office noted on the letter attached to this permit shall be contacted
at least 48 hours prior to commencement of activities authorized by this permit.
Notification must be made on weekdays (excluding holidays) between 8:30 a.m. and 4: 30 p.m.
-Based upon a review of your request for water quality certification pursuant to Section
401 (a) (1) of the Clean Waters Act of 1977 (PL 95-217) (The Act) , the Department hereby
certifies that any discharges in to the navigable waters of the United States caused by
the project will camply with the applicable Federal effluent limitations or other limita-
tions - 7 or standards under Sections 301, 302, 306 & 307 of The Act,

Dear Mr. Knox:
Enclosed is your permit which was issued in accordance
with the applicable provisions of the Park Commission' s rules
and regulations ( 6 NYCRR 645 & 646 ) and Environmental Conservation
law. Please review the general and special conditions included
on the permit; these are intended to minimize any environmental
disturbances associated with your project.
Please note that it is the responsibility of the permittee
and the permittee ' s agent to comply with all permit conditions .
Further, the permit is valid only for •the activity expressly
authorized. Work beyond the scope of the permit shall be considered
as work without a permit . The notice enclosed with the permit
must be displayed in a conspicuous place near the project site
during the entire period of construction and must be suitably
protected from the elements . Any failure to comply with these terms
may be treated as a violation of ..Environmental Conservation law.

PART OF THIS PERMIT.
GENERAL CONDITIONS
1 . All activities authorized by this permit must be in strict
conformance with the approved plans submitted by the permittee
or the permittee ' s agent as part of the permit application .
2 . The permitee has accepted expressly, by the execution of the
application, the full legal responsibility of all damages , direct
or indirect, of whatever nature, and by whomever suffered, arising
out of the project described herein and has agreed to indemnify &
save harmless the State from suits, actions , damages and costs of
every name and description resulting from the said project .
3 . The permittee is responsible for keeping the permit active by
submitting a renewal application, including any forms , fees or
supplemental information which may be required by the Commission ,
no later than 30 days prior the expiration of construction authorization .
4 . The permittee is responsible for obtaining any other permits ,
approval:. , land easements , and rights-of-way which may be
required for this project .

ADDITIONAL GENERAL CONDITIONS
4. The permittee is responsible for obtaining any other permits,
approvals, land easements and rights-of-way which may be required for .
this project.
5. This permit shall not be construed as conveying to the applicant '
any right to trespass upon the lands or interfere Stith the riparian
rights of others in order to perform the permitted work or as
authorizing the impairment of any rights, title or interest in real or
personal property held or vested in a person not a party to the
permit.
6. Any modification of this permit granted by the Commission must be
in writing and attached hereto.
7. That the State of New York shall in no case be liable for any
damage or injury to the structure or work herein authorized which may
be caused by or result from future operations undertaken by the State
for conservation or improvement of navigation, or for other purposes,
and no claim or right to compensation shall accrue from any such
damage.
8. Granting of this permit does not relieve the applicant of the
responsibility of obtaining any other permission, consent or approval
from U.S. Army Corps of Engineers, U.S. Coast Guard, New York State
Office of General Services, New York State Department of Environmental
Conservation, Adirondack Park Agency or local government which may be
required.
9. All necessary precautions shall be taken to preclude contamination
of any wetland or waterway by suspended solids, sediment, fuels,
solvents, lubricants, epoxy coatings, paint, concrete, leachate or any
other environmentally deleterious materials associated with the
project.
10. There shall be no unreasonable interference with navigation by the
work herein authorized.
11. All scrap or unused construction materials shall be removed from
the ice and/or waters of Lake George.
12. Disturbance to the bed and banks of Lake George shall be kept to
the minimum necessary to complete the project.
SPECIAL CONDITIONS
13. No commercial use, as defined in 6 NYCRR 645-2.1 (8) & (9) , of the
permitted dock, wharf, or mooring, is authorized.
14. No part of the dock shall extend more than 40 feet from the mean
low water mark and no part of the dock may extend more than 100 feet
from the mean high water mark.
15. Every dock or wharf constructed shall have a minimum setback of
twenty feet from the adjacent property line extended into the lake on
the same axis as the property line runs onshore where it meets the
lake, or at a right angle to the mean high water mark, whichever
results in the greater setback.

ADDITIONAL SPECIAL CONDITIONS
16. No application for modification to the size, shape, or configur-
ation of the wharf may be granted without a variance.
17. Cutting or clearing of vegetatian for wharf construction or access
shall be limited to an area not to exceed five (5) feet running
north to south along the frontage of the property. Vegetatian
along the remainder of the property's frontage shall be left in
its natural state.
18. Upon written request of the current permittee to the Park Commis-
sion the Commission will issue a modification to the permit esta-
blishing William Bernard, who has entered into a legal agreement
to purchase the subject parcel , as the permittee.
19. The permittee has modified his original proposal , reducing the
proposed overall width from 38 feet to 26 feet. Upon completion
of construction, the permittee will provide to the Commission as
built plans of the wharf showing all dimensions and property
setbacks.
ITEM OF FACT
1. At their December 05, 1988 meeting, the Commissioners approved
by majority vote the granting of a variance from 6 NYCRR 646-1.1(c)
(7) (ii) and authorized the issuance of this permit.
