TOWN CODE CHAPTER 136 – SEWERS AND SEWAGE DISPOSAL

WHEREAS, the Queensbury Town Board is authorized by Town Code Chapter 136 to issue
variances from §136-44 “Connection to sewers required” which requires Town property owners
situated within a sewer district and located within 250’ of a public sanitary sewer of the sewer district
to connect to the public sewer facilities within one (1) year from the date of notice, and
WHEREAS, Northeast Power Systems, Inc.’s (NEPSI’s), has applied to the Town Board for
a variance/waiver from Town Code §136-44.1 for an exemption from the Town’s connection
requirements to connect its property located at 66 Carey Road, Queensbury to the West Queensbury
Sanitary Sewer District as set forth in its September 21,2020 application, and
WHEREAS, pursuant to Section 136-44.1(C)(5)(a), in order for the Town Board to consider
the granting of such a variance or waiver, the property owner must be willing to pay the full and usual
sewer rents, assessments and taxes accruing against the property, and

WHEREAS, the requested waiver appears to be based on costs of connection which provides
any waiver shall be for a time period not to exceed two (2) years, and
WHEREAS, the Town Clerk’s Office mailed a Notice of Hearing to the Applicant and the

Town Board conducted a hearing concerning the variance/waiver request on Monday, October 19,
2020,
NOW, THEREFORE, BE IT
RESOLVED, that
a) due to the nature of the variance/waiver request, the Queensbury Town Board determines
that the granting of the variance/waiver would not be materially detrimental to the
purposes and objectives of Queensbury Town Code Chapter 136 and/or adjoining
properties or otherwise conflict with the purpose and objectives of any plan or policy of
the Town of Queensbury; and
b) the Town Board finds that the granting of the variance/waiver is reasonable and would
alleviate unnecessary hardship on NEPSI; and
BE IT FURTHER,
RESOLVED, that the Queensbury Town Board hereby approves NEPSI’s (Applicant)’s
application for a variance/waiver from Queensbury Town Code Chapter 136, §136-44 “Connection
to sewers required” and hereby grants Applicant a two (2) year extension of time or until October

19, 2022 from the requirement to connect its property located at 66 Carey Road, Queensbury (Tax
Map No.: 308.20-1-6) to the Town of Queensbury’s West Queensbury Sanitary Sewer District,
provided that Applicant connect to the West Queensbury Sanitary Sewer District within two (2) years
and no further extensions will be granted and in the meantime, if there is any change in property use,
increase in septic use or additional bathroom facilities added, then such variance shall immediately
terminate unless the Queensbury Town Board reviews and approves a new application for a
variance/waiver, and furthermore, if the septic system has been determined to fail or is modified by
the Applicant, or if ownership of the property is transferred, then the variance is terminated as well
and the property must connect to the West Queensbury Sanitary Sewer District, and
BE IT FURTHER,
RESOLVED, that Applicant shall pay all charges due as if its property was connected to the
West Queensbury Sanitary Sewer District, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes the Town Supervisor, Wastewater Director
and/or Town Budget Officer to take any actions necessary to effectuate the terms of this Resolution.

PICK-UP TRUCK FOR BUILDING AND GROUNDS DEPARTMENT

WHEREAS, in accordance with Resolution No.: 293,2020, the Town of Queensbury’s
Purchasing Agent provided specifications for a 2020 or newer F-350 super duty or equal pick-up
truck for the Building and Grounds Department to replace a year 2012 F-350 pick-up truck with
53,329 miles on it (Town Asset No.: 8967) to the New York State Office of General Services
Procurement Program and also published an advertisement for bids for the Truck , and
WHEREAS, on September 24, 2020, the Purchasing Agent received bid information for
the Truck from the New York State Pro Vehicle Market Place, and
WHEREAS, the Facilities Manager and Purchasing Agent reviewed such bids and have
recommended that the Town Board authorize the bid award to the lowest, responsible bidder,
Main Motorcar, for a 2021 Dodge Ram Pick-up Truck for an amount not to exceed $33,010.26 in
accordance with the New York State Office of General Services Procurement Program Group No.:
40440, Award No.: 23166 and Contract No.: PC68941,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby accepts and awards the lowest,
responsible bid for a 2021 Dodge Ram Pick-up Truck from Main Motorcar for an amount not to
exceed $33,010.26 through the New York State Office of General Services Procurement Program
Group No.: 40440, Award No.: 23166 and Contract No.: PC68941, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs that funding for such
purchase shall be by a transfer of $33,011 from Health Insurance Account No.: 001-9060-8060 to
Vehicles Account No.: 001-1620-2020 and the Town Budget Officer shall amend the 2020 Town

authorized funding to the Lake George Regional Chamber of Commerce & Convention and Visitor’s
Bureau (LGRCCCVB) and the Agreement between the Town and LGRCCCVB for tourism

promotional and marketing campaign and consultation services through June 30, 2020, and

WHEREAS, the Town of Queensbury wishes to again enter into an Agreement with

LGRCVB for provision of such services from November 1, 2020 through October 30, 2022, and
WHEREAS, such promotion and marketing services will promote the Town of Queensbury
and its hotels and motels, restaurants, stores and other businesses, thereby benefiting the general
economy of the Town and all of Warren County, and
WHEREAS, by prior Resolution, the Queensbury Town Board provided for the Town’s
receipt of occupancy tax revenues from Warren County in accordance with the Local Tourism
Promotion and Convention Development Agreement (Agreement) entered into between the Town
and Warren County, and
WHEREAS, the Agreement provides that specific expenditure of the funds provided under
the Agreement are subject to further Resolution of the Queensbury Town Board, and
WHEREAS, the Town Board wishes to provide $37,000 total in funding to the LGRCCCVB
for general tourism promotional and marketing campaign and consultation services through October

30, 2022 ($18,500 for 11/1/20-10/30/21 and $18,500 for 11/1/21-10/30/22) with occupancy tax
revenues received from Warren County, and
WHEREAS, a proposed Agreement between the Town and LGRCCCVB has been presented
at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves and authorizes funding to
the Lake George Regional Chamber of Commerce & Convention and Visitor’s Bureau
(LGRCCCVB) and authorizes the Agreement between the Town and LGRCCCVB substantially in
the form presented at this meeting and authorizes and directs the Town Supervisor to execute the
Agreement with the Town to provide $37,000 total in funding to the LGRCCCVB through October

to Capital Reserve Fund #64,

WHEREAS, by Resolution No.: 273,2020, the Town Board authorized an advertisement for
bids for the purchase of a 2015 or newer Heavy Haul Truck/Tractor for the Town Highway
Department as described in bid documents/specifications prepared by the Highway Superintendent
and/or Purchasing Agent, and
WHEREAS, following such advertisement of bids, the Purchasing Agent opened and
reviewed all received bids on September 2, 2020, and
WHEREAS, the Town wishes to fund the purchase of a truck by funds the Town receives
through the New York State Consolidated Local Street and Highway Improvement Program
(CHIPS), but CHIPS requires that purchases be used only for new trucks/equipment, and
WHEREAS, the Town Highway Superintendent has therefore requested that the Town Board
reject the received bids and authorize the purchase of a new International Truck using CHIPS funds,
and
WHEREAS, by Resolution No.: 104,2020, the Town Board authorized adoption of Local
Law No.: 4 of 2020 entitled, "A Local Law Authorizing the Award of Contracts on the Basis of
Best Value”, which Local Law authorizes the Town to award contracts which would otherwise be
subject to the "lowest bidder" rule on the basis of “Best Value”, as defined in §163 of the New
York State Finance Law, as determined by the Town Board upon the recommendation of the
Purchasing Agent and the Department Manager, in this case, the Town Highway Superintendent,
which would include the specific factors to be applied in determining Best Value reflecting,
wherever possible, objective and quantifiable analysis, and
WHEREAS, Sourcewell is a cooperative, municipal purchasing program that specifically

competitive bidding and Best Value criteria, and
WHEREAS, the New York State Legislature adopted legislation allowing any political
subdivision in New York State to “piggyback” off an existing County/State Bid and therefore in this
instance, the Town of Queensbury wishes to piggyback with Sourcewell for a 2019 International
Model LT625 6x4 Truck (Truck), and

WHEREAS, such Truck is available through H. L. Gage Sales, Inc., for the amount of
$111,797 as set forth in H. L. Gage Sales, Inc.’s quote dated September 25, 2020 presented at this

WHEREAS, the Town Board concurs with the analysis and finds that this purchase meets the
Town’s Best Value criteria and therefore wishes to reject the received bids and authorize the
purchase of the new truck by using funds to be reimbursed to the Town through CHIPS,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby rejects the bids the Town received in
connection with Resolution No.: 273,2020 for the purchase of a 2015 or newer Heavy Haul
Truck/Tractor for the Town Highway Department, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby approves and authorizes the Town Highway
Superintendent’s purchase of a 2019 International Model LT625 6x4 Truck (Truck) from H. L. Gage
Sales, Inc. as set forth in H. L. Gage Sales, Inc.’s quote dated September 25, 2020 substantially in the
form presented at this meeting and in accordance with the cooperative, municipal purchasing
program Sourcewell, for the total amount of $111,797 to be paid from CHIPS Capital Expenses
Account No.: 004-5112-2899, contingent upon the Town being reimbursed for such total amount
through the New York State Consolidated Local Street and Highway Improvement Program
(CHIPS), and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs Town Budget Officer to
increase revenues in Chips Revenue Account No.: 004-0000-53501 by $111,797, increase CHIPS
Capital Expenses Account No.: 004-5112-2899 by $111,797, amend the 2020 Town Budget, make
any adjustments, budget amendments, transfers and/or prepare any documentation necessary to
effectuate payment, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor and/or
Town Highway Superintendent to sign any and all documentation needed and the Town Supervisor,
Highway Superintendent and/or Budget Officer to take such other and further action as may be

in bid specifications to be prepared by the Water Superintendent and/or Purchasing Agent, and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder(s) meeting New York State statutory requirements and
the requirements set forth in the Town’s bidding documents,

7.0 TOWN BOARD DISCUSSIONS
COUNCILMAN METIVIER (WARD I)- Spoke regarding the recent purchase of
Highway vehicles. To clarify for the public, these vehicles were purchased with funds the
Town receives through the New York State Consolidated Local Street and Highway
Improvement Program (CHIPS).
COUNCILMAN FERONE (WARD III)-
Also spoke regarding recent purchase of Highway vehicles. There was a lack of
understanding concerning where the funds were coming from. Its was thought
these funds were coming out of the general fund and tax money; it’s not. It’s
money that we get from the State and if we don’t use it, we lose it.
The Halfway Brook Trail is looking good and the bridge is now complete.
Advised residents in the area that the Town put in this trail and is spending money
to beautify the area so please don’t use the watershed property as a dumping
ground.
Spoke regarding the fire siren on Aviation Road. Noted that he and Supervisor
Strough met with the Volunteer Fire Company President and current Fire Chief.
While their members voted to keep their siren running, they are being sensitive to
the neighbors in the area. Supervisor Strough has offered to get our engineering
folks involved to see if they can make some recommendations on that. We are
trying to find a solution to that.

On Tuesday, October 6 was our first Queensbury Road Safety Committee
meeting. A number of safety issues were discussed.
COUNCILMAN FREER (WARD II)-
Explained that he is on quarantine at his home because he traveled and the
Governor’s restrictions on returning from Colorado, which was not on the list of
quarantine states when his plans were made, but is now.
Spoke regarding questions and feedback he receives on sidewalks/repairs.
COUNCILWOMAN MAGEE (WARD IV)-
Commented on the Kindness Rocks Project at Hovey Pond.
With regards to Councilman Ferone’s comments on dumping garbage on Town
property, has a meeting on Friday with National Grid and the Queensbury Land
Conservancy at Sheriff’s Department to discuss some misuse of land off of
Corinth Road. Will report back after meeting.
SUPERVISOR STROUGH-
Spoke regarding speed radar signs. Currently, they are on Sweet and Dixon Roads
in sleep mode collecting data. They will soon be fully activated. A study will be
conducted to see if the behavior of drivers change when it goes from sleep to full
activation mode.
Received comments from the public that the sound quality of these meetings is
not very good. Advised we are getting new microphones and StoredTech will be
working to install a new sound system.
