THE STORM SEWER SYSTEM AND TO AMEND STORMWATER
MANAGEMENT PROVISIONS OF THE TOWN CODE

WHEREAS, the Town Board wishes to consider adoption of proposed Local Law No.: 2 of
2009 entitled, "A Local Law Adopting Storm Sewer System Regulations and Amending Stormwater
Management Provisions of the Town Code" which Law is intended to establish Town storm sewer
regulations and update the Town's stormwater regulations, as required by New York State, and
WHEREAS, adoption of this legislation is authorized in accordance with New York State
Environmental Conservation Law and regulations and New York State Municipal Home Rule Law
§ 10 and New York State Town Law Article 16, and
WHEREAS, pursuant to the State Environmental Quality Review Act ("SEQRA") the Town
Board has considered the potential effects of the proposed Local Law and has issued a Negative
Declaration, finding that it will not have any significant adverse environmental impacts, and
WHEREAS, the Town Board duly held a public hearing on Monday, February 23rd, 2009 and
heard all interested persons, and
WHEREAS, a copy of the proposed Local Law has been presented at this meeting and is in
form approved by Town Counsel,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby enacts Local Law No.: 2 of 2009
entitled, "A Local Law Adopting Storm Sewer System Regulations and Amending Stormwater
Management Provisions of the Town Code" as presented at this meeting and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Queensbury Town Clerk
to file the Local Law with the New York State Secretary of State in accordance with the provisions of
the Municipal Home Rule Law and acknowledges that the Local Law will take effect as provided by
law.
