4.10 4.10 WATER\Water District Extension—Mountain Terrace Estates—Public Hearing Order—SPH—11-16-2020 ORDER SETTING PUBLIC HEARING CONCERNING PROPOSED EXTENSION TO QUEENSBURY CONSOLIDATED WATER DISTRICT TO SERVE A PORTION OF MOUNTAIN TERRACE ESTATES SUBDIVISION AND AN OUT-OF-DISTRICT PARCEL RESOLUTION NO.: , 2020 INTRODUCED BY. WHO MOVED ITS ADOPTION SECONDED BY. WHEREAS, the Town of Queensbury wishes to extend the Queensbury Consolidated Water District (the "Water District") in accordance with New York Town Law Article 12-A to serve four lots of the proposed six-lot Mountain Terrace Estates Subdivision (the "Subdivision") and a separate parcel currently receiving Town water under an "Out-of-District Contract" (the "Parcel'), all located on Luzerne Road (the "District Extension"), and WHEREAS, The Environmental Design Partnership, LLP (EDP) has prepared a Map, Plan and Report (Map, Plan and Report) concerning the proposed District Extension to connect the Subdivision to either the existing 16" Water District water main that runs along Luzerne Road or the existing 6" main in Twin Mountain Drive, all as more specifically set forth and described in the Map, Plan and Report, and WHEREAS, the Map, Plan and Report has been filed in the Queensbury Town Clerk's Office and is available for public inspection, and WHEREAS, the Map, Plan and Report delineates the boundaries of the proposed District Extension, a general plan of the proposed system, a report of the proposed method of operation, the source of water supply and mode of constructing any proposed District Extension improvements, and WHEREAS, the Town Planning Board has indicted that it wishes to be Lead Agency for review of the Subdivision under the State Environmental Quality Review Act(SEQRA) and will conduct coordinated review with the Town Board as an Involved Agency, NOW, THEREFORE, IT IS HEREBY ORDERED: 1. As a SEQRA Involved Agency, the Town Board hereby consents to the Town Planning Board acting as Lead Agency for SEQRA review of the Subdivision and will not make a decision regarding the proposed District Extension until after the Planning Board has made a SEQRA Determination of Significance for the Subdivision. 2. The boundaries of the proposed District Extension are as set forth in the Map, Plan and Report and as follows: Parcel 1: Beginning at the point of intersection of the westerly line of Twin Mountain Drive and the northerly line of Luzerne Road. The proposed District Extension will not include any new water supply development such as water mains, wells or new intake structures or the construction of any additional system storage. The proposed Extension will utilize the surplus capacity in the existing system, so that the only improvements will be the connection of the four new residences to either the existing 16" main that runs along Luzerne Road or the existing 6" main in Twin Mountain Drive. All new installations and taps will be coordinated with the Town of Queensbury Water Department. Maintenance of the existing will be provided by the Town of Queensbury Water Department. 4. The Subdivision developer will pay all new capital costs associated with the District Extension so there will be no cost to the Town or the District for the District Extension. 5. As the Subdivision houses have not yet been built, there is no actual "typical property" for purposes of calculating the estimated annual cost of the District Extension, merely estimates based on what may be built. However, the estimated annual cost of the District Extension to the typical property in the District Extension, which typical property is a typical one family home, for operation and maintenance and other charges (assuming an average water usage) ranges from approximately $480 for a Subdivision property assessed at $270,000 to approximately $510 for a Subdivision property assessed at $375,000. The cost for what is expected to be the typical property ($388,700 based on the current assessed value of a developed parcel in the District Extension ) will be approximately $512 for the Parcel. The cost of hook-up fees and constructing a water service connection from the water main to each new structure and the purchase and installation of a water meter will be paid by either the developer or the builders of the house and included in the total cost of each home. 4 6. A detailed explanation of how the estimated costs of the District Extension were computed is included in the Map, Plan and Report which has been filed with the Queensbury Town Clerk and is available for public inspection. 7. The capital improvements necessary for this service area will be provided and paid for by the Subdivision developer and so there will be no financing required by the Town on behalf of the Water District or any debt service costs related to this District Extension to the Water District. 8. The proposed improvements shall be constructed and installed as specifically delineated in the Map, Plan and Report and in full accordance with the Town of Queensbury's specifications, ordinances or local laws, and any State laws or regulations, and in accordance with approved plans and specifications and under competent engineering supervision. 9. The Town Board shall meet and hold a public hearing at the Queensbury Activities Center, 742 Bay Road, Queensbury, at 7:00 p.m., on Monday, December 7, 2020 to consider the Map, Plan and Report and to hear all persons interested in the proposal and to take such other and further action as may be required or authorized by law. 10. The Town Board hereby authorizes and directs the Water Department to send copies of the Map, Plan and Report to the New York State Department of Environmental Conservation and the New York State Department of Health, together with all documentation required to be sent, along with a letter indicating that the Town Board will be undertaking consideration of the District Extension identified in this Resolution. 11. The Town Board hereby authorizes and directs the Water Department to prepare a report identifying any environmental impacts it believes should be considered at the time the SEQRA review is conducted by the Town Planning Board and to provide this information to the Planning Board as SEQRA Lead Agency. 5 12. The Town Board hereby authorizes and directs the Queensbury Town Clerk to duly publish and post this Order not less than ten (10) days nor more than twenty (20) days before the Public Hearing date, as required by Town Law §209-d, and complete or arrange for the securing of two (2) Affidavits of Publication of Notice and two (2) Affidavits of Posting of Notice of the Public Hearing required hereby and to file a certified copy of this Order with the State Comptroller on or about the date of publication. Town of Queensbury,NY 1.0 INTRODUCTION AND PROJECT DESCRIPTION The Town of Queensbury Consolidated Water District is proposing to extend its water service territory to include a portion of Mountain Terrace Estates subdivision on the northern side of Luzerne Road between Twin Mountain Drive and Tuthill Road and an existing residential lot at 741 Luzerne Road (Tax Map Parcel 307.-1-32.2). Generally, it is located along the northern side of Luzerne Road between Twin Mountain Drive and Tuthill Road with 741 Luzerne Road located on the south side of Luzerne Road approximately 550±west of Twin Mountain Drive. The project is a six(6) lot single-family conventional subdivision utilizing frontage along the existing surrounding roads with no new roads being proposed. Four(4) of the lots will have frontage and access exclusively on Luzerne Road. The other two (2) lots will be in the northwest and southeast corners of the property, one entering from Tuthill Road and the other from Twin Mountain Drive. Four(4) of the lots will be served and included in the proposed water district extension. The other two (2) lots will be served by private on-site wells. There is an existing 16-inch water main located on the northern side of Luzerne Road, on the same of the road as the project site and a 6-inch water main along Twin Mountain drive. The four(4) proposed single family lots within this water district extension will be connected to the existing Town water mains. The existing dwelling located at 741 Luzerne Road is already connected to the Town water main along Luzerne Road and is serve by an "Out of District Contract". The project will not include any new water main. All six(6) of the proposed lots will have individual onsite septic disposal systems. This report will identify the boundary of the proposed district extension, will provide information on the current territory, population and water supply, the anticipated demands of the expansion and will address the construction. 2.0 EXISTING WATER DISTRICT The parcels are located immediately adjacent to the west of the existing Town of Queensbury Consolidated Water District. The existing dwellings on Twin Mountain Drive adjacent to the project parcel are within the existing water district. 3.0 PROPOSED DISTRICT BOUNDARIES The proposal would extend the district to include the four(4) lots in eastern portion of the project parcel and the existing parcel at 741 Luzerne Road. No further subdivision or creation of additional residences could occur within the proposed water district extension. Maps showing the existing water district and the proposed district extension is included with this report. 4.0 EXISTING WATER SUPPLY The Town of Queensbury of Queensbury Consolidated provides service to residents in the town and it also serves the Kingsbury Water District, Hudson Falls, Moreau and the Warren-Washington Industrial Park. The system has five(5)water storage tanks with a total storage volume of 5 million gallons. The water source is the Hudson River at the Sherman Island Dam. At the water source is a 15 million gallons per day(MGD)water treatment plant on Corinth Road in the southwest part of the town. This facility draws and treats water from the Hudson River and has a current permitted capacity of 15.0 MGD. 5.0 EXISTING WATER DEMANDS The Town of Queensbury Consolidated Water District currently serves approximately 21,200 people through approximately 9,100 service connections.Additionally, it also serves the Kingsbury Water District, Hudson Falls, Moreau and the Warren-Washington Industrial Park. Mountain Terrace Estates Town of Queensbury,NY Water Department the average water demand for the system was 4.8 MGD and the highest single daily demand was on the order of 12.3 MGD (2013). In 2019 the total water produced for the system was 1,743 million gallons of which more than 1,665 million gallons was delivered to the customers. All services with the water territory are metered. 6.0 PROPOSED FACILITIES AND FLOWS The municipal water which will serve the expanded district is proposed to be provided by the Queensbury Consolidated Water District. The proposed Mountain Terrace Estates project will add four(4)single family dwellings to the service territory.The existing dwelling at 741 Luzerne road is already served by the district via an"Out of District Contract"and has not been included in the proposed flow. Based on the typical water usage for a 4-bedroom single family dwelling the average daily water usage will be on the order of 110 gallons per day per bedroom and 440 gallons per day per dwelling. The proposed four(4) lot single family project will have an average demand on the order of 1,760 gallons per day. The peak daily demand of the proposed extension is anticipated to the twice the average daily flow or 3,520 gallons per day. Based on the existing system data for 2019 the proposed extension would increase the average daily water demand to 4.8018 MGD with a highest single daily water demand on the order of 12.3036 MGD. Each of these figures are well below the current permitted treatment capacity of the system of 15 MGD.The average daily demand is also within the existing storage tank capacity of the system, 5 million gallons. 7.0 PRESSURE, FLOW AND NEW INFRASTRUCTURE The proposed dwellings in the district extension will connect to an existing 16-inch water main that runs along the northern side of Luzerne Road, a town road, on the same side of the road as the project site or from the existing 6-inch water main in Twin Mountain Drive, a town road. The proposed extension will not include any new water supply development such as water mains,wells or new intake structures. Likewise, the project does not include the construction of any additional system storage. This extension is proposed to utilize the surplus capacity in the existing system. According to The Town of Queensbury and recent pressure tests the static water pressure in the existing 16-inch main near the proposed project is on the order of 45-49 psi. This pressure was at Hydrant 4615 which is at an elevation of approximately 540 ft while the finished floors of the buildings are proposed at elevations varying from 496 ft to 545 ft. Based on these elevations it is anticipated that the static water pressures at the buildings will be between 45 and 62 psi. Although the 45 psi is lower than the typical operating pressures in the Water District the pressures exceeds the minimum pressure requirements of the 10 State Standards. Town will not be responsible for the construction of any Town owned pumping stations. The fire flows within the existing water mains in front of the project site are estimated at 1,822 gpm at 20 psi. 7.98.0 COST ESTIMATES Capital Costs The formation of the Water District Extension associated with this Water District Extension are to be financed by the developers of Mountain Terrace Estates. No new water supply facilities are proposed with this extension. There are no improvements proposed with this Water District Extension resulting in no capital cost of improvements. The cost for the water services and hook up fees are shown in the"Hook-up Fee"section and will be paid by the developer. Operation and Maintenance Costs The lots included in this water district extension will pay for the maintenance of the facilities via their Queensbury Consolidated Water District and ad valorem tax and water use fees. Town of Queensbury,NY homeowners will be billed for their respective water usage per current/standard rates of the district. The current rates for 2020 are $30.00 for the first 8,000 gallons plus $2.20 for each additional 1,000 gallons. Assuming 440 gallons per household per day, the quarterly bill per household would be$100.73 . Hook-up Fees All new individual water taps will be made by the Town of Queensbury Water Department at the time of the individual dwellings being constructed. The current cost of a tap and meter is$1,550 incudes the W copper piping, curb stop, and curb box and meter. The installation of the W copper piping to from the curb stop to the dwelling will be installed by others during the house construction phase and is estimated to be$800 - $1,000 depending on the length of the service. The total cost per service is estimated to be $2,350 to $2,550 so a total of$9,400 to$10,200. All associated hook-up costs and fees will be paid by the developer or builders of the house. There is an equity buy-in to the Queensbury Consolidated Water District of$350 per lot for a total of$1400 to be paid by the developer. The Developer will also pay all legal and administrative fees incurred by the Town associated with the district extension and subsequent consolidation. That fee is estimated to be$1,850. As the houses have not yet been built, there is no "typical one or two family house property" that has an assessed value that approximates the assessed value of the mode of the benefited properties situated in the extension that will be required to finance the cost of the proposed improvements. Furthermore, as the developer will pay all costs of the improvements there will be no municipal debt service to be paid by the benefitted properties for this extension. Section 9.0—Annual Costs—discusses the estimated annual cost for potential properties within the subdivision and the property currently receiving water on an out-of-district basis. This estimated cost includes ad-valorem taxes and estimated metered water use. "9.0 ANNUAL COSTS The taxable assessed value of the properties in the subdivision is estimated to be range from$275,000 to $375,000 per finished residence. The other two(2)lots will be in the northwest and southeast corners of the property,one entering from Tuthill Road and the other from Twin Mountain Drive. In addition to the subdivision,a water district extension is required. The Town of Queensbury Consolidated Water District is proposing to extend its water service territory to include a four of the proposed lots of Mountain Terrace Estates subdivision on the northern side of Luzerne Road between Twin Mountain Drive and Tuthill Road and an existing residential lot at 741 Luzerne Road(Tax Map Parcel 307.1-32.2).
