RESOLUTION AUTHORIZING ADVERTISEMENT OF BIDS
FOR COOLING TOWER/AIR CONDITIONING EQUIPMENT
RESOLUTION NO.: 153, 2009

WHEREAS, the Town of Queensbury Facilities Manager wishes to advertise for
bids for the replacement of a cooling tower/air conditioning equipment at the Town of
Queensbury Office Building Complex as will be more clearly specified in bid
specifications to be prepared by the Town's Facilities Manager, Town Engineer and/or
Town Purchasing Agent, and
WHEREAS, General Municipal Law § 103 requires that the Town advertise for bids
and award the bids to the lowest responsible bidder(s) meeting New York State statutory
requirements and the requirements set forth in the Town's bidding documents,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the
Town's Purchasing Agent to publish an advertisement for bids for the replacement of a
cooling tower/air conditioning equipment at the Town of Queensbury Office Building
Complex in the official newspaper for the Town of Queensbury, and
BE IT FURTHER,

RESOLVED, that the Town Board further authorizes and directs the Purchasing
Agent to open all bids received, read the same aloud and record the bids as is customarily
done and present the bids to the next regular or special meeting of the Town Board.
Duly adopted this 27th day of April, 2009, by the following vote:

Discussion held before vote: Director of Building and Grounds Chuck Rice reviewed for
the Board the aging air-conditioning equipment, noting that repair work on twenty three
year old equipment would be very expensive. Will be contacting Dan Ryan for his
review of the existing equipment before it is let out to bid.
DISCUSSION: EDC WARREN COUNTY -CONTRACT REQUEST
Supervisor Stec-Queensbury and EDC have had a contact since inception until last year it
was for a total sum of a hundred and twenty eight thousand dollars a year, last years
budget was a hundred thousand. EDC has expressed concern about that at the time
however we agreed to wait until early '09 to discuss that, and that is why this meeting.
Representative of EDC-Had budgeted for a hundred and twenty thousand we think that is
a reasonable number for the amount of work that we have done in Queensbury given the
industrial park and other things that we do. Hope that the Town will restore twenty
thousand back into our budget and we can work on a long range plan with you
forecasting our budget for the following year.
Councilman Montesi-Do you generate revenue?
Representative of EDC-Yes -through membership and in the future to generate revenue
thorough land sales.
Councilman Brewer-How many lots do you have in inventory for sale?
Representative of EDC-There are eight one owned by QEDC.
Representative of EDC-The key point is creation of jobs and sustaining jobs. Sixty
percent of our operation is funded through the County and Town. Warren County
provides $340,000.
Councilman Brewer-What is your total budget?
Representative of EDC-Sixty to seventy thousand in private sector funds, total budget
five hundred thousand. Operating budget, used for funding studies, doing engineering
and development of the Industrial Park through HRLDC a companion organization.
Trying to create capital so we can do the next project.
Representative of EDC-Not is a rush to sell land but we are in a rush to get the right
companies in here.
Councilman Brewer-What will happen without the twenty thousand?

Representative of EDC-Will have to cut marketing and consulting engineer.
Councilman Strough-Noted he was hoping for a budget to look at, and also it would help
you cause if we met more often. Listed areas to be looked at: 1. Ciba Geigy 2. Exit 18
west side 3. North side of Corinth Road 4. Kmart Plaza -east side of parking lot could
be developed we should change things to allow development 5. Road to connect Quaker
and Light Industrial Area that Macri owns with Queensbury Avenue times are tough
right now so for us to give away money without pushing real hard and asking for a lot in
return, is the right way to go.
Representative of EDC-We can meet at workshops or in smaller groups whatever you
decide just let us know. We have a regular monthly meeting at the County and there is
no reason we can't do something like that with you.
Councilman Brewer-Suggested every quarter
Councilman Strough-We have rezoned South Queensbury to encourage redevelopment.
Supervisor Stec-Requested a current budget for the Board members to look at before a
decision is made.
DISCUSSION: BAY RIDGE VOLUNTEER FIRE COMPANY -OIL SPILL
INSURANCE LITIGATION
Representative of Bay Ridge Vol. Fire Co.-It was a very amicable settlement with
everyone involved, we came out well in it, 97 '/z % return rate on all expenses including
legal fees.
Representative of Bay Ridge Vol. Fire Co.-Total spent $171,567.36 total return
$167,500.00 leaves us a balance of $4,067.00 not covered. We have a bid of $46,000 to
encompass the tank so any oils that drip out of there, there is a true failsafe in place also a
containment system around the boiler systems.
Supervisor Stec-Will contact Town Counsel regarding the previous resolution if it will
cover the proposed expenses on the containment system, or a new resolution will have to
be done.
Representative of Bay Ridge Vol. Fire Co.-Want to make sure that the Town Board is in
tune with what we want to accomplish, by September we need to figure out what we will
do regarding financing of the proposed containment system.
DISCUSSION: QLC BUDGET -LEON STEVES
Supervisor Stec-Each year we have a contact with the Queensbury Land Conservancy
noted that there were some special circumstances on an upcoming project we knew that
you might be asking for more money in the 2009 contract.
Mr. Leon Steves-We put in the original budget for $28,620.00 we had built into that some
help, we have been going along on a volunteer basis all these years and now it is time we
got some help, office help. Last years contact was $6,000.00 Reviewed the history of the
organization. Today our assets are $185,736. based on appraised value. Approximately
$50,000 in the bank. Operating budget last year was $10,657.68.
Supervisor Stec-Amount in the adopted budget $28,620.00 but the Board had questions
regarding QLC and what the funds were to be used for. Was the $28,620 a one time
request or the new permanent number?
Mr. Steves-A permanent number. Appraisals on land were included in that amount. Will
also be seeking grant monies from the State and Federal Government to secure parcels in
the Town.

Councilman Strough-I would rather you hold off on that, not use public money to fund
that it is a pie in the sky kind of thing, I do not know if we should be spending money on
that right now. I do not mind giving you what you need for operating expenses and run
what you originally intended to do which is open space, let the Board work with the City
and maybe get some kind of open space agreement at a minimum expense.
Mr. Steves-In the tentative plan that we set up there is seven hundred acres retained by
the City, their dams and reservoirs the rest of it going to QLC, being a land conservancy
there would be no development next to the reservoirs, we are still under negotiations with
the City.
Supervisor Stec-We are here to discuss your budget.
Representative of QLC-This is a volunteer group, we have two properties that are a great
asset for this community we are moving forward with a web site to broaden our reach to
try to encourage more land owners to be donating land to this corporation.
Councilman Montesi-How many acres do we own?
Mr. Steves-Sixty seven, seventy acres.
Representative of QLC-We have the stewardship to maintain that property to make sure it
is safe and trails are maintained, we are doing this on a volunteer basis. We are now
seeing the need to get some clerical help on a part time basis and would justify the budget
that we are asking for.
Councilman Montesi-I have no problem with the $28,000.
Supervisor Stec-That would be the general day to day operating expenses?
Representative of QLC-Yes
Councilman Brewer-I would support that Dan.
Councilman Metivier-Spoke on the fee attached to subdivision lots, collect fee for Open
Space.
Supervisor Stec-The five hundred dollars that we collect is very old and it is on a very
low side. Historically we have used the fees for Recreation but we can certainly either
increase it or as Tony suggested increase it and say X percent is going to go to the QLC
for open space.
Councilman Strough-Some communities have impact fees on residential development
and that is because residential development ultimately costs all the taxpayers more
money. They do not have impact fees on commercial development because they usually
bring in money. Requested that the Town Board and the QLC meet once a year to
review their program.
Supervisor Stec-Would like to meet around budget time. Noted the funds are in the
budget, will have a resolution regarding their contact at the next meeting.
Councilman Montesi-Would like to see a Town Board Member attend their meetings.
DISCUSSION:
Supervisor Stec-RE: Vic Macri- property he has the site plan approved, the tenant has
changed their proposal and will be back before the Planning Board. The question he had
for the Highway Dept. traffic light will be paid for by the developer the question who will
own the maintenance of it? Walmart wants after the one year warrantee period they want
the Town to take it as a public traffic light. This is being researched our Town Counsel.

Councilman Strough-Before we make up our minds about the traffic light lets sit down
with them, and discuss another access to Queensbury Avenue.
Councilman Montesi-Spoke to the Board regarding the number banners between poles
we need to look into this.
Supervisor Stec-Will be setting up a meeting with the fire companies and MMA in the
near future.
