Recommendation of Director of Purchasing to accept the bid of Glens Falls
Business Machines...All items bid upon, less amount of delivery time
Supervisor Borgos-Noted that we could not order before this because of
lack of storage space, now we are ready to move in and time is imperative
for the delivery of furniture.
RESOLUTION TO ACCEPT BID
RESOLUTION NO. 233, Introduced by Mr. George Kurosaka who moved for its
adoption, seconded by Mrs. Betty Monahan:
WHEREAS, the Town of Queensbury has constructed a new addition to the
Queensbury Town Office Building and at the same time has constructed an
Activity Center for the Residents of the Town of Queensbury, and
WHEREAS, due to the new construction and the remodeling.of the various
offices in the Town, new furniture is required, and
WHEREAS, the Town Board recommended that we advertise for bids for new
furnishings for the new Activity Center and remodeled Town Office Building,
and
WHEREAS, such bids were advertised for in the proper newspaper and
WHEREAS, four companies submitted bids and they were received and opened
at the specified time and place by the Director of Purchasing/Town Clerk
Darleen M. Dougher,a and
WHEREAS, Miss Dougher has recommended that the bid be awarded to Glens
Falls Business Machines of Dix Avenue, Glens Falls, New York 12801
and stated the following
A. The lowest bidder-Charlies Furniture of Glens Falls did not
bid on the complete package, not all furniture that was bid met
the specifications
B. The next lowest bidder-Ralph Shapiro of Glens Falls did not bid
on the complete package, and the date of delivery was not satisfactory

NOW, THEREFORE BE IT
RESOLVED, that the Town Board award the bid to Glens Falls Business Machines
of Glens Falls in the amount of $46,949.19 noting that Glens Falls Business
Machines was the third lowest bidder but the only bidder to bid on complete
package and that date of delivery was an important criteria in the acceptance
of the bid, and be it further
RESOLVED, that this will be paid from surplus funding.

Supervisor Borgos-I am very pleased, our original estimate was between
fifty and sixty thousand for this project.
It has brought to our attention that the United Cerebral Palsy Center
wishes to erect a new facility on Dixon Road. Under the law we have a
forty day time period in which to act. There is some concern on the part
of the public that they would like to know more about what is planned.
Paul Dusek-Town Attorney-The facility will be known as the Intermediate
Care facility and residence for developmental disabled children. My understanding
that there will be twelve beds made to look like a single family residence.
The plan is to house six disabled children from the community and six
from Wilton. The children are basically immobile suffering from sever
handicaps I believe all of which you may find in wheel chairs and need
quite a bit of care. It is also my understanding that there will be supervisors
and people on duty around the clock at least two people during the evening
and night hours. Basically the area that they are looking to put this
facility on is a little over four acres and they served notice upon the
town by letter dated May 5, 1988 indicating that they had picked this
site. Under law this Board has the opportunity to review this site and
basically has three options. One, they can approve the site as recommended
by the United Cerebral Palsy Two they can suggest alternate or other
suitable sites or Three they could object to the facility on the grounds
that it would result in a concentration of the facility in that area that
would alter the community in that area. In this particular case we have
learned that there is one further facility which is similar, but not quite _
the same, I believe that mentally retarded children approximately one
mile from this location on Jerome Avenue. We also, with conference with
Mrs. Burke who is an adjoining neighbor in this facility has learned that
she is one of the last residential area in that neighborhood and that
therefore it may impact obviously the community as well.
SUPERVISOR BORGOS-When I initially got this I sent a response back to
Mrs. Cohen indicating that I was interested to hear that they were planning
this but my big concern was traffic problem on Dixon Road, the close proximity
to Half Way Brook and the deep woods in that area. I did not know the
details about the confinement of the children at that point. I then
found out that the children would be severely handicapped and unable to
move on their own but that the law does not provide for the health or
safety being a concern in this sitting, only the concerns that the attorney
just mentioned. No one is objecting to the location of this type of
facility at this point, people are just concerned that perhaps as we are
going through rezoning and looking at where things are and how one particular
use works with another use perhaps the public should have an opportunity
in a public hearing situation to be able to have everything presented
and discussed.
COUNCILMAN MONTESI-This is across from Dixon Heights, there are two houses
that look like duplexes built in that area that is not these two homes? .
i SUPERVISOR BORGOS-No those are west by two lots of the proposed site.
This area will be left with one single family residential structure.
COUNCILMAN MONTESI-With four acres, one of the questions that will have
to be addressed, in no way the Cerebral Palsy on the corner of Aviation
and Moorwood was a detriment but it has grown bigger in a residential
area than we thought, if that is the case what will be the plans for Dixon
Road. Could we be looking at four houses on this parcel, will this have
an effect on the character of the area? That is my question...
COUNCILMAN MONAHAN-Questioned when Cerebral Palsy started being the act
of having housing for Cerebral Palsy people, ARCC has been handling housing
for may types of people not just handicapped. Knowing that Cerebral Palsy
is having a problem raising enough money to fund their daily school activities
and expansion that they planned I just wonder about this new branching
out and whether it is financially feasible. Maybe that is none of our
business but...I am concerned about it as a person that supports that
organization.
SUPERVISOR BORGOS-They indicated in meeting today that money was no problem...Noted
that the photographs from the part of the report that Paul has, shows
the close proximity to the Burke home and that fact that from the proposed
parking lot all the lights from the cars 24 hours a day would go into
their side windows. We have the option of calling a public hearing, and
I personally would recommend that we hold a public hearing. In order
to do the public hearing under the law we have to file a formal objection,
which doesn't mean we are objecting but it will stop the time clock with
in the 40 day time period. -
COUNCILMAN MONTESI-Noted that he would like to call a public hearing in
order to know what their exact plans.
Agreed by the Town Board that we hold a public hearing.
RESOLUTION TO OBJECT TO PROPOSED SITE PLAN
RESOLUTION NO. 234, Introduced by Ronald Montesi who moved for its adoption,
seconded by Marilyn Potenza.
WHEREAS, The United Cerebral Palsy Association of the Tri-Counties, Inc.,
has notified the Town of Queensbury by letter dated May 5, 1988, addressed
to the Town Supervisor, Stephen Borgos, that it has selected a site on
Dixon Rd., in the Town of Queensbury, for the establishment of an intermediate
care facility residence for developmentally disabled children, and
WHEREAS, the Town Board of the Town of Queensbury has concern over the
effect of the placement of the residence at its proposed location and
desires to hold a public hearing concerning the site, and
j WHEREAS, the time in which the Town Board of the Town of Queensbury has
_ to respond to the establishment of the intermediate care facility residence
will expire three days form May 6, 1988, and prior to the time the Town
Board of the Town of Queensbury will have an opportunity to hold a public
hearing and,
WHEREAS, the Town Board of the Town of Queensbury wishes to preserve its
rights to object to the facility on the grounds of its impact in the community
in that location, and upon the grounds that there is another facility
in close proximity thereto until after such time as a public hearing is

held:
NOW, THEREFORE BE IT
RESOLVED, that the Town Board of the Town of Queensbury hereby formally
objects to the establishment of the intermediate care facility residence
at the location proposed subject to reconsideration following the holding
of a public hearing.

RESOLUTION TO HOLD PUBLIC HEARING
RESOLUTION NO. 235, Introduced by Marilyn Potenza who moved for its adoption,
seconded by Ronald Montesi.
WHEREAS, the United Cerebral Palsy Association of the Tri-Counties, Inc.,
has notified the Town of Queensbury by written letter, dated May 5, 1988,
addressed to the Town Supervisor Stephen Borgos, that it has selected
a site on Dixon Rd., Town of Queensbury for the establishment of an intermediate
care facility residence for developmentally disabled children, and
WHEREAS, the Town Board of the Town of Queensbury has concern over the
effect of the placement of the intermediate care facility residence at
the location proposed and desires to hold a public hearing concerning
the site,
NOW, THEREFORE BE IT
RESOLVED, that a public hearing be held on the proposed establishment
of an intermediate care facility residence for developmentally disabled
children on Dixon Rd., Town of Queensbury, by the United Cerebral Palsy
Association of the Tri-Counties, Inc., and that said public hearing be
held on June 28, 1988 at 7:30 P.M. in the Town of Queensbury, Town Office
Building, Queensbury, NY, at which time all persons interested in the
subject shall be heard, and be it further,
RESOLVED, that the Town Clerk of the Town of Queensbury be and hereby
is directed to publish all such notice of said public hearing as is required
by law.
