Dear Dr. Cohen:
This letter will serve to document items discussed during our meeting today
regarding the above-referenced property.
As discussed, your proposal to divide the interior of the current Silverwear store
into three individual tenant spaces for retail occupancy is an allowable use for
the building with regards to both the New York State Building Code and the
Town of Queensbury code. While you did not offer any specific uses for
consideration, it was generically offered by you that your intended use of the
building would be for . retail/mercantile uses. Further, we discussed the
possibilities for the establishment of a restaurant in the structure and the need for
significant improvements-to the fire safety systems, building construction as well
as a detailed review by the Planning Board prior to any such operation. The
same information would, most likely, be applied to any change in use.
As discussed, each individual tenant space must be reviewed and permitted
separately each time a new tenant occupies a space and each tenant may
apply for such permitting. It is our recommendation that you, the property
owner, participate in the permitting process, as you are ultimately responsible for
the operation of the property and your attention to these details could help
avoid complications. Further, while each tenant would be allowed a wall sign
subject to the requirements of Chapter 140, only one freestanding sign, which
may be shared by the tenants, is allowed for the property.
