OPEN FORUM: 7:45 P.M.
SUPERVISOR WALTER-Announced that this was an organizational meeting for 1987. We have
some old business regarding the closing of the Luzerne Road and a group of residents from
Luzerne Mountain Road are here to speak to Mr. Naylor.
TOM BARROWMAN-Cormus Road, Mr. Naylor did respond to our comments in the newspaper
so what I would like to do at this time is clear up a couple of points with Mr. Naylor...asked
why the road was kept open past the Mahar house?
PAUL NAYLOR-We turn around there and this is a town road it has to be plowed.
TOM BARROWMAN-I found out from the residents who live up there that Mr. Naylor does
plow the road up to their house and on by there. The amount that he plows on by there is 6/10's
of a mile, a 1.2 mile round trip back to the Mahar house. He used to turn around at the Mahar's
house and when I checked with Bill Tucker who takes care of the Keenan Reservoir and he
gets in to check the reservoir by snow shoe or snow mobile. I went up there and checked and
I dare say that on certain occasions that road is kept up much better then what the road is
that we drive on. All the items we complained about at the last meeting were conveniently
taken care of this afternoon, all except the stop sign at West Mountain Road. I would like
to report the day after the storm, a man who has a frontwheel drive got stuck at noon. Mr.
Naylor said he would evaluate the situation this year and if he is at all concerned with what
our feelings are, then the facts we have laid out speak for themselves.
EETTY POTTER-Luzerne Mountain Road-The last two snow storms I made three trys at trying
to get home, the only way I made it home was because a Sheriffs car got stuck in a ditch and
the Town of Queensbury sent a pickup truck to get him out and because the pickup made a
path I made it home. I had to leave my car on the road so I could shovel out my driveway and
the next day the Town of Queensbury plowed it into the grill of my car. I had to shovel snow
out of the grill. At 4 o'clock in the morning I got a call from the sheriff's Department to move
a truck, which belonged to my daughter's boyfriend. He got up and moved it because they
said it was hampering snow removal, but when I went out the next day to plow my driveway
that truck had not been back because the plow went around his truck and after I paid $20.00
to have my driveway plowed, some pickup had taken that snow from the road and placed it
in front of my driveway. This year is not any better because Mr. Naylor closed the road.
JANICE HENKE-Mountain Road- The statement made in the newspaper the last time we had
a meeting, was the reason why there was not adequate plowing and not a turn around was because
Mike's gate which had always been left open and this one time it was closed and there was
no room to turn around. That gate has always been closed in the winter and a call to Mr. Brandt
house confirmed this. The ice on the curve was the cause of an accident after the last storm
when a car hit that piece of ice and skidded across the road hitting a road sign. Everybody
down the mountain had a bare road we were still worrying about getting through the slush.
i Usually the sand and salt is spread on the downhill lane not on the uphill, so it is very difficult
for an ordinary car to come up the mountain. The Conservation Officer who lives on Cormus
Road is the Supervisor for this entire area and he is the one who is called when there is a mill
fire or explosion with hazardous material involvement, or a leak from a hazardous hauler on
the Northway and the Northway has to be closed. His response time is greatly increased due
to the fact that he cannot go.straight down the Luzerne Road anymore and if his response
time is increased as it has been done after one snow storm this winter, and he cannot get out,

he had to call a non-supervisory conservation officer,to the oil spill on the Northway. I want
this on record so that the community will be aware that there may well be increased liability
and increased danger to residents in this area because he is not able to get out on occasions
when the road is bad to close off a special area or sometimes to tell the local fire people not
to spray down a hazardous material because if you do that it will explode.
TOM BARROWMAN-I wanted Mr. Naylor to hear directly how we feel the road is being plowed
this year because he did make in a public statement that he was giving this a trial run and
if the residents weren't satisfied with it then he would base his decision on that and re-open
it...but it seems it came out in the paper that the only one Mr. Naylor is talking to on this
decision is he himself and what he feels. If this is the case, I would like to have him respond--� ,
and also if this is the case then we would like to have the Board to tell us what procedures
are involved to get our assessments changed because we have a decrease in our services and
our value is decreased.
COUNCILMAN BORGOS-Mr. Naylor has made some progress, I did drive the road today twice
and did not have a problem.
TOM BARROWMAN-We do feel bad after coming here for several meetings, only to have several
situations corrected the day of the meeting.
COUNCILMAN MONTESI-Said the Town Board passed a Resolution to put the sign up and it
will take a Resolution to take it down.
TOM BARROWMAN-If he is going to wait till spring to make his decision then we are going
to talk, retroactive in our assessments.
COUNCILMAN BORGOS-Former Chairman of Assessment Committee, grievance day is now
May 2nd and there is no harm in going to the assessor ahead of time to talk to him about the
situation, to see if he agree with you that the land in that area is worth less now, then before
this happened. Also said that perhaps a change could be made before you get your new tax
notice. Noted that the Sole Assessor has the right to make a determination one way or the
other and if you don't like that then go to grievance day, and if you don't like their decision
then you can follow a new Quasi Judicial procedure which is rather inexpensive. I spoke with
Mr. Naylor before the meeting regarding the fact that at the end of Cormus Road there is
a barricade or gate and that gate was not always there, when I lived on the Mountain there
was no gate there and the Town for many years plowed and maintained the road past that gate
behind what is know as the Harrington Farm. That gate came in sometime around 1963 but
who put it there, I don't know, noted that he has a photograph showing the gate open. Having 1�0�
lived up there, I like the road open, yes it is slippery, and yes, I have slid off but the fact that
eventually it did get cleared was very convenient so I would like to see the road re-opened.
Maybe the road will have to have some rebuilding done and noted that now the road is serving
the heavy traffic from Luzerne to Glens Falls, perhaps we could ask the county to get involved.
SUPERVISOR WALTER-You have some options on how to go and Mr. Naylor said give it this
year and he will make an assessment as to whether it will be closed next year or not. .... (OLD
BUSINESS BOARD OF HEALTH).. Mr. Bonnabeaux called today to say he has checked the
deed between his property and the road and the property was granted a right a way through
the deed to a Mrs. Beers and Mrs. Zverblis is the daughter of Mrs. Beers and said she will give
him permission to put the drainage field in the right of way, we are waiting for something
in writing regarding this.

FIRST SUPPLEMENTAL BOND RESOLUTION DATED JANUARY 5, 1987 SUPPLEMEN
BOND RESOLUTION DATED SEPTEMBER 12, 1985. A FIRST SUPPLEMENTAL
BOND RESOLUTION SUPPLEMENTING BOND RESOLUTION DATED SEPTEMBER
12, 1985, SUPPLEMENTING THE AUTHORIZATION OF THE ISSUANCE OF $7,000,000.
SERIAL BONDS OF THE TOWN OF QUEENSBURY, NEW YORK, FOR THE CONSTRUN
OF A SEWER SYSTEM IN THE QUAKER ROAD SEWER DISTRICT IN SAID TOWN.
WHEREAS, after a public hearing had been duly called, held and conducted on September
12, 1985, the Town Board of the Town of Queensbury adopted a resolution on September 12,
1985, authorizing and approving the establishment of the Quaker Road Sewer District in said
Town, and the construction of a sewer system therein, and
WHEREAS, such resolution further authorized the issuance of up to $7,000,000.00 serial

bonds to pay the cost of the sewer improvements, the details of said improvements being described
therein, and
WHEREAS, it is desired that such resolution be supplemented to more specifically authorize
the issuance of such serial bonds,
NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Queensbury, Warren County, New York,
that the resolution entitled:
"RESOLUTION APPROVING THE ESTABLISHMENT OF A SEWER DISTRICT IN
THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, TO BE KNOWN
AS THE QUAKER ROAD SEWER DISTRICT, AND FURTHER APPROVING THE
CONSTRUCTION OF THE IMPROVEMENTS PROPOSED THEREFORE.
is hereby supplemented as follows:
Section 1. For the purpose of paying the cost of the construction of said improvements
in the Quaker Road Sewer District in said Town, there are hereby authorized to be issued,
pursuant to the Local Finance Law, serial bonds of the Town of Queensbury; Warren County,
New York, in the principal amount of $7,000,000.00.
Section 2. Subject to the provisions of the Local Finance Law, the power to authorize
the issuance of and to sell bond anticipation notes in anticipation of the serial bonds herein
authorized, including renewal notes, is hereby authorized.
Section 3. The estimated maximum cost of such object or purpose is $7,000,000.00.
The plan of financing the same consists of the issuance of said serial bonds over a period not
exceeding thirty (30) years, which serial bonds are hereby authorized to be issued pursuant
to the Local Finance Law. Therefore, the proposed maturity of the serial bonds will be in
excess of five years.
Section 4. All other matters except as provided herein and in the resolution which this
resolution amends relating to such bonds shall be determined by the Supervisor. Such bonds
shall contain substantially the recital of validity clause provided for in Section 52.00 of the
1 Local Finance Law and shall otherwise be in such form and contain such recitals, in addition
to those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine.
Section 5. It is hereby determined that subdivision 4 of paragraph a of Section 11.00 of
the Local Finance Law applies to such object or purpose and that the period of usefulness thereof
is forty years.
Section 6. The faith and credit of the Town of Queensbury, Warren County, New York,
are hereby irrevocably pledged to the payment of the principal of an interest on such bonds
as the same become due and payable.
Section 7. The powers and duties of advertising such bonds for sale, conducting the sale
and awarding the bonds, are hereby delegated to the Supervisor who shall advertise such bonds
for sale, conduct the sale and award the bonds in such manner as she shall deem best for the
interests of said Town, provided, however, that in the exercise of these delegated powers
she shall comply fully with the provisions of the Local Finance Law and any order or rule of
the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor
shall be a full acquittance to the purchaser of such bonds who shall not be obliged to see to
the application of the purchase money.
Section 8. The validity of such bonds may be contested only if:
(1) Such obligations are authorized for an object or purpose for which said Town
is not authorized to spend money, or
(2) The provisions of law which should be complied with at the date of publication
of the resolution or summary thereof, are not substantially complied with, and an action suit
or proceeding contesting such validity is commenced within twenty days after the date of
such publication, or
(3) Such obligations are authorized in violation of the provisions of the Constitution.
Section 9. This resolution, which takes effect immediately, shall be published in full
in the Post Star, a newspaper of general circulation in the Town of Queensbury and which is
an official newspaper of the Town of Queensbury, together with a notice of the Town Clerk

BE IT RESOLVED, by the Town Board of the Town of Queensbury, acting on behalf

Section 1. For the purpose of paying for part of the cost of construction of a sewer
system in the Quaker Road Sewer District in the Town of Queensbury, New York including
the installation and construction of pipes, hydrants, valves and appurtenances for the collection
of waste water in said district and basic treatment one-time charge for use of the Glens Falls
Treatment Plant, in accordance with proceedings heretofore taken by the Town Board of said
Town, there is hereby authorized to be issued a $675,000.00 Bond Anticipation Note of said
Town.
Section 2. Specific reference is hereby made to a resolution entitled:
"RESOLUTION APPROVING THE ESTABLISHMENT OF A SEWER DISTRICT
IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, TO BE
KNOWN AS THE QUAKER ROAD SEWER DISTRICT, AND FURTHER APPROVING
THE CONSTRUCTION OF THE IMPROVEMENTS PROPOSED THEREFORE"",
and a resolution entitled:

which resolutions authorized the bonds in anticipation of the sale of which the note hereby

Section 3. The amount of bonds to be issued for the aforesaid object or purpose
is $7,000,000.00. Such bonds will be serial bonds.
Section 4. The amount of the Bond Anticipation Note to be issued is $675,000.00.
Such note shall be dated January 5, 1987, and shall be numbered and shall mature April
1, 1987, bearing interest at a rate not exceeding four and one-half (4.5%) percent per annum,
payable at maturity. Such note shall be signed by the Supervisor of said Town and attested
by the Town Clerk of said Town; and both principal of and interest on said note shall be payable
in lawful money of the United States of America at Glens Falls National Bank and Trust Company
in Glens Falls, New York. Such note shall be in substantially the form set forth in Schedule
11
A attached hereto.
Said note shall be payable from the proceeds derived from the sale of said
bonds or otherwise redeemed in the manner provided by Section 23.00 of the Local Finance
Law of the State of New York. The faith and credit of said Town are hereby irrevocably pledged
for the payment of said note and interest thereon.
Section 5. There are no bond anticipation notes outstanding which have been
previously issued in anticipation of the sale of said bonds. Neither is the noted hereby authorized
a renewal note. The period of maturity of such note is herein above set forth. Such note is
issued in anticipation of bonds for an assessable improvement.
Section 6. The Supervisor of the Town Queensbury is hereby authorized to
sell said note at private sale at not less than par and accrued interest; and when said note
shall have been duly executed and sold, the same shall be delivered to the purchaser upon payment
of the purchase price to the Supervisor and the receipt of the Supervisor shall be a full acquittance
to said purchaser who shall not be obliged to see to the application of the purchase money.
Section 7. The validity of such bond anticipation note may be contested only
if:
1. Such obligation is authorized for an object or purpose for which the Town
of Queensbury is not authorized to spend money, or
Z. The provisions of law which should be complied with at the date of the
publication of this resolution or summary thereof are not substantially complied with, and

SUPERVISOR. WALTER-We have just been through one year under the Ward System and suprisingly
enough we all survived. It was a busy year in 1986, we constructed and opened the Gurney
Lane Swimming Pool, record numbers in which Queensbury residents participated in recreation
programs. We also acquired more acres of park land including the 28 gift acresfrom the County
of Warren. We created our Local Development Corporation and we made the purchase of our
Industrial Park. With the approval of the State Comptroller, the Towns first large sewer district,
construction began in September. We also had a part in creating a new Department in our
Town that of Planning and we staffed it. After that Planning Department was formed it was
followed by a lot of amendments, regulations, ordinances and we are looking to tightening
up on some building. Another first for Queensbury was the sale of water to another municipality
j and at that same time in the Water Department we had a substantial increase in our own customers
and we also constructed a storage tank of two million gallons for reserve supplies while the
fellows added additional pipe lines. Nighteen miles of paving plus drainage work was done
by our Highway Department. We saw the first computerized budget in the Town and I would
say that these are the highlights. Referring to the Town Board noted that we have accomplished
a lot in your first year and I can honestly say we are still within our budget and have ended
the year in black. For 1987 although it is the beginning a new year but it is really a continuation
of our two year terms and I think all of us are more then enthusiastic about getting out to
bid on an expansion of the Town Office Building. We are in need of new office and storage
space. The design is now being undertaken by Saratoga Associates and we hope by September
1st, to see us all organized in our own new work space and less crowded conditions at the Town
Office Building. We are looking forward to some professional design work on two large tracks
of land, Ridge Road and Gurney Lane Parks and hopefully we can phase construction of those
parks into both active and passive facilities for town residents. We will look for a change
in the Lake George Law, although we do not have too much control over that, hopefully the
State Legislature will work on that and that will enable us to begin engineering work for sewering
of North Queensbury. We have told our new Town Planner one of his tasks, is going to be a
thorough review of the Town's zoning and we hope that he will come back to us with an early
report in the spring and through that we will probably have some additional amendments and
ordinances. We will look at, and deal with, the tremendous growth in the town and also the
environment, full scale construction of sewer district with laterals and the pumping station
and we are hopeful that the first customers by the end of the year will be able to hook into
the Glens Falls sewage treatment plant. We are going to find out about the outcome of our
two and one half year assessment re-evaluation project and that is one, we know, will make
the tax burden a fair one to all the town members in the Town of Queensbury. We are also
looking to building an activity center for senior citizens and other homeless groups that have
been turned away because of lack of space in the Town Office Building. We can look to further
progress with our computer as the Water Department is going to utility billing that they will
be able to do in their department. I think that we will make the same commitment at the
beginning of the year 1986 and in 1987 to continue to improve on municipal service and also
to add some recreation opportunities in the town. I think that this year you might want to
get out your appointment calendars because we have a lot of meetings and a lot of work ahead
of us, 1987 should show a great deal of accomplishment. That is my annual organizational
meeting statement.
COUNCILMAN MONTESI-You hit on almost everything I took pride in being a part of as being
a part of this Board. Things that we did very early on were difficult decisions as a new Board
member, we all agreed but it was a tough move to go through the ordinances. The Trailer
Park Ordinance, and establishing zones, and I think we did something for the betterment of
our community. I think the fees we established for the recreation, $250.00 per lot, was the
right decision. We have had Thirty-three million dollars worth of building permits issued this
year and that shows the kind of growth in our environment that is ever present.
JIM MCLAUGHLIN-Landfill Superintendent, asked if they were going to get rid of the septic
trucks a the landfill.
._ SUPERVISOR WALTER-Hopefully...The Department of Environmental Conservation will have
to approve going into the city treatment plant for our septic haulers. Our contract with the
city allows that they will take that, it is only Encon that said that they can't and that's why
we are. I think that we can look for some relief from that area shortly. They did not want
us to dump into the old plant, they felt that it could not handle it.
COUNCILMAN BORGOS-One of the major things I think we resolved was to establish the ban
on all open burning.
