SUPERVISOR WALTER-Supervisor Schuyler Martin asked to have a resolution passed allowing
Justice Little to go to the Town of Chester Court to hear a matter...this is rather unusual
because in this case the defendant wishes to be heard in the Chester Court and it is necessary
to pass a resolution to allow one our Justices to travel out of town.
RESOLUTION TO AUTHORIZE TOWN JUSTICE TO PRESIDE IN TOWN OF CHESTER COURT
RESOLUTION NO.37, Introduced by Mr. Stephen Borgos, who moved for its adoption, seconded
by Mr. Ronald Montesi.
WHEREAS, J. David Little has been assigned to hear a matter in the Town of Chester Court
and,

WHEREAS, the Town of Chester has requested approval of the Town of Queensbury to permit
a Queensbury Justice to travel to another Town Court,
NOW, THEREFORE BE IT
RESOLVED, that the Queensbury Town Board has no objection to this request and approves
Justice Little's leaving this municipality to hear a matter in the Chester Town Court.
Duly adopted by he following vote:
Ayes: Mr. Borgos, Mr. Montesi, Mrs. Walter
Noes: None
Absent: Mr. Kurosaka, Mrs. Monahan
SUPERVISOR WALTER-We had at our last meeting two truck bids, one for the Cemetery
Department and one for the Highway Department and there was some question on the bids.
-Ltr. on file from Pine View Cemetery recommending bid be awarded to Queensbury Motors.
-Ltr. on file from Peter Brualt-requesting purchase of old Pine View Truck.
J DISCUSSION
SUPERVISOR WALTER-The question here is Rodney has a certain amount of money budgeted
for a truck and that included a trade in...so he is really looking at purchasing the truck with
trade, in the meantime Peter Brault brought it to my attention that he could never buy a
vehicle for $5000.00 to do the plowing here at the Town Hall and wondered if rather than
taking the trade if he would be allowed to buy the vehicle at $5000.00
COUNCILMAN BORGOS-Asked if he had the money in his budget?
SUPERVISOR WALTER-No, that is the problem.

COUNCILMAN BORGOS-Didn't he just buy a truck from the Highway Department and was
this truck taking the place of that?
SUPERVISOR WALTER-Yes, he would put that truck in an auction.
PETER BRAULT-I would like to put the highway truck in our auction, as it will not hold up
with the work we have to do and make a transfer in funds for the purchase of the Pine View
truck.
COUNCILMAN BORGOS-Why are we buying a new Cemetery truck?
RODNEY MOSHER-PINE VIEW Superintendent, Its the perfect time to trade, if you wait
till the truck is too old there is no trade in value and there is something wrong with the carburetor
and it needs an adjustment, other than that it is sound. We need a truck we can depend on
with all our plowing and moving of dirt.
SUPERVISOR WALTER-I talked with Peter about the value and he assured me that there
was no way we could ever pick up a truck for $5000.00 that was in the shape that this one
is in. In Rod's situation with his capital they are continually updating so that their equipment
is not that old. Asked Rod why the low bid was not taken.
RODNEY MOSHER-Listed the following as not meeting the specifications: (1) front axle
not sufficient, (2) bids did not include automatic locking front hubs, (3) bids did not include
West Coast mirrors, (4) alternator did not meet specification.
RESOLUTION TO ACCEPT BID
RESOLUTION NO. 38, Introduced by Stephen Borgos who moved for its adoption, seconded
by Ronald Montesi.
WHEREAS, Mr. Rodney Mosher, Supt. of Pine View Cemetery did recommend that we advertise
for bids for a 1987 One Ton 4 Wheel Drive Dump Truck, and
WHEREAS, five bids were submitted and received and opened at the specified time and place
by the Director of Purchasing/Town Clerk Darleen Pd. Dougher, and such bids were then turned
over to Mr. Mosher for his recommendation, and
WHEREAS, Mr. Rodney Mosher by letter has recommended that the bid be awarded to Queensbury
Motors of Queensbury, N.Y. in the amount of $19,995.00 being the lowest bid to meet the
specifications, noting that the lowest bidder did not meet the specifications in the following
areas, Front Axle not sufficient, (2) bids did not include automatic locking front hubs, (3)
bids did not include West Coast mirrors. NOW THEREFORE BE IT
RESOLVED, that the financing for such Vehicle is in the 1987 Pine View Budget.

SUPERVISOR WALTER-The Highway Department also has a bid, a letter was presented last
week indicating that they wished to have the Town Board accept Ron Kuba's bid of $ 16, 574.00
not the low bid and we have to know why.
RICK MISSITA- Noted that the engine size noted in the bids of Dave Ball, Chev. and Queensbury
Motors did not meet the specifications of 170 HP. minimum.
RESOLUTION TO ACCEPT BID
RESOLUTION NO.M, Introduced by Mr. Stephen Borgos, who moved for its adoption, seconded
by Mr. Ronald Montesi,
WHEREAS, Mr. Paul Naylor, Highway Supt—for the Town of Queensbury did recommend that
we advertise for bids for a One Ton Cab and Chassis, and
WHEREAS, four bids were submitted and received and opened at the specified time and place

by the Director of Purchasing/Town Clerk Darleen M. Dougher, and such bids were then turned
over to Mr. Naylor for his recommendation, and
WHEREAS, Mr. Naylor by letter has recommended that the bid be awarded to Ron Kuba Ford
Mercury, Inc., Comstock, New York, in the amount of 16,574.00 being the lowest bid to meet
the specifications, noting that the engine size noted in the bids of Queensbury Motors and
Dave Ball Chev.. did not meet the specifications of 170 hp minimum.
NOW,-THEREFORE BE IT
RESOLVED, that the Town Board of the Town of Queensbury hereby accepts the recommendation
of Mr. Naylor as mentioned above, and be it further
RESOLVED, that the financing for such vehicle is in the 1987 Town Highway Budget.

RESOLUTION AUTHORIZING SUPERVISOR TO EXECUTE LEASE FOR NEW CATERPILLAR
950B WHEEL LOADER
RESOLUTION NO.40, Introduced by Mr. Ronald Montesi who moved for its adoption, seconded
by Mr. Stephen Borgos.
WHEREAS, Paul Naylor, Town of Queensbury Highway Superintendent has determined that
a Wheel Loader is required by the Town to efficiently and effectively carry out the programs
of the Town of Queensbury Highway Department, and
WHEREAS, a lease for twelve months of a Caterpillar 950B Wheel Loader has been prepared
and reviewed by the Town Board of the Town of Queensbury, and
WHEREAS, Southworth Machinery, Inc. of Harts Lane, Albany, New York, has offered to
deliver said equipment immediately in order that it may be placed in service, and
WHEREAS, Southworth Machinery, Inc. has represented to the Town of Queensbury that the
proposed agreement is an actual "equipment lease" and does not constitute an
"equity lease," and
WHEREAS, the lease agreement conforms with the provisions contained in the General Municipal
Law Section 103 and the rules of the State Comptroller, and has been approved by Wilson
S. Mathias, Counsel to the Town Board,
NOW,THEREFORE BE IT RESOLVED, that the Supervisor of the Town of Queensbury is hereby
authorized to execute the equipment lease for one new Caterpillar 950B Wheel Loader in
the form annexed to this resolution, and
BE IT FURTHER RESOLVED, that a copy of this resolution together with the executed lease
agreements be forwarded to Southworth Machinery, Inc.
