in his sewage disposal system and any other location will destroy attractive
trees 0 Motion by Sinnott. seconded by Kirkpatrick and carried to approve
as practical difficulty shown,
3. Variance Il58 e Schoenhoff - Bay near Farm~TooMarket .. Wishes to operate
a service and repair station and used new car lot for foreign cars in a C-l
zone. Schoenhoff answered questionso Kushner pointed out that the C...l zone
was intended for neighborhood shopping. Kirkpatrick expressed the boards
feeling that this was not a compatible use with the area" Motion by Kirk-
patrick, seconded by Norton and carried to reject as not in conformity with
the area or u~e intendedo
4" Variance 1159 .. Mechanick - Luzerne Road ... R-3 "" Wishes to operate an auto...
mobile business.. Motion by Monahan. seconded by Sinnott and carried to
disapprove as not compatable with the area or use.
50 Kushner pointed out that if applicants fai a different use is appropriate
in a zone where this is not allowed, they should apply for a zone change
rather than a variance..
6" Reviewed Sleight I 7-69 - Mountain View Subdivision. Motion by Van Wirt,
seconded by Kirkpatrick to give preliminary approval to the first sectionÞ
7" Discussed Sleight 16-69 "" Evergreen Section 130 This was given preliodnary
approval September 9, 19690
80 Discussed Whalen Subdivision on Ridge Road with Whalen.. He will submit latera
9.. Wilson - Glen Lake .. appeared to discuss use of his land for four-family
dwellings where the ordinance permits only one and two family units. His
application for an apartment house on this site was denied by this board and
the Zoning Board of Appealse He presented a proposal for 2 or 3 story
and a half units of 4 apartments eacho He asked us to work with him in
obtaining the variance he needs 0 Kushner t Norton, and others explained that
this could not be due within the framework of the ordinance 0 It was stated
he could build 2 family units but he felt this was not economicalo Keller
pointed out tbat the desire to make economic gains did not constitute a hard-
ship in the definition of the ordinanceo It was pointed out that the only othc
alternative within the ordinance was to request a change of zone but his
property was too small to permit this" He referred to Clifton Park and Glen=
ville where court action was used in a similar case
