Pursuant to the instructions of Supervisor Stec, I am hereby providing to you the septic variance application for
Martha Schmulbach. At this time, Ms. Schmulbach currently has an application for Site Plan Review before
the Planning Board for her proposed 609 square foot second floor addition to her existing residence. It was
brought to our attention during this review that due to the fact that her existing well and existing septic system
are within 100 feet of each other, that her parcel is deemed non-compliant under Chapter 136 of the Town of
Queensbury Sewers and Sewage Disposal Regulations. As a result, Ms. Schmulbach hired an engineer to install
a brand new septic system on the property which would be compliant. Unfortunately, when we looked into this,
her immediately adjacent neighbor who just recently installed a well, installed it in anon-compliant location
within 100 feet of her existing septic system. As a result, and due to the small size of her parcel, there is
nowhere on her lot that she could place a compliant system.
Due to these circumstances, Ms. Schmulbach is forced to apply for the following variances from Appendix A
of Chapter 136 of the Town of Queensbury Sewers and Sewage Disposal Regulations:
(1) 20 feet of relief from the 100 foot separation requirement for the well and the septic system;
(2) 5 feet of relief from the 20 foot separation requirement for the dwelling and the septic system; and
(3) 9 feet of relief from the 10 foot separation requirement for the property line and the septic system
requirement.
We would like to discuss these variances with the Board on August 28~' as well as the possibility of obtaining
a waiver from the existing test pit requirement. Ifthere is anything further needed in order to maintain our spot
on the August 28, 2006 Town Board's Workshop agenda, please contact me.
