Dear Mr. Kambar:
This is to advise you that the above referenced permit application for the modification of your
wharf at the referenced parcel has been denied by the Commission. The Commission's findings
which form the basis for the denial are as stated in the Commission resolution #2001-50, a copy of
which is enclosed. The Commission determined, in part, that the application and accompanying
documents fail to support a finding that limiting the size of the dock at the site would impose a
hardship as defined in 6NYCRR 645-8.
You are afforded opportunity for a hearing. Under the Commission's permit hearing
regulations a hearing officer is appointed by the Commission to conduct an adjudicatory proceeding,
complete a public record and prepare findings of fact, conclusions and recommendations, which are
referred back to the Commission for action. The hearing is the applicant's opportunity to present
evidence and testimony which supports a conclusion that the permit and variance should be granted.
Strict rules of evidence are not imposed, however, statements are sworn and witnesses are subject
to cross examination.
It should be noted that pursuant to 6NYCRR 645-6.14, a portion of the costs of a hearing, if
one were held, would be your responsibility, including items such as the publication of required
notices and any necessary stenographic transcriptions. If you wish to be represented by counsel,
you would also be responsible for your attorney's fees.
If you desire that a hearing be held, you must submit a written statement to that effect to the
Commission within 15 days of the date of this letter. If you have any questions regarding this matter,
please contact this office.
In addition, the Commission has afforded you until June 1, 2002 to remove the north pier of
the current wharf from its current location. An inspection will be scheduled on or about June 1, 2002
to determine compliance with this order. The pier may be replaced as authorized by Consent Order
00-04-001. Enclosed is a sketch showing the dock authorized by this Consent Order based on the
current survey.
