2.0 PRIVILEGE OF THE FLOOR
TAMMY SULLIVAN-Asked the board for an update on the status of the drainage issues on
Homer Avenue.
REGULAR TOWN BOARD MEETING 07-12-2010 MTG# 25 949
SUPERVISOR STEC-Councilman Montesi and Attorney Mike Hill have met with the five
properties owners involved to try to resolve the issues. It looks like there has been movement
people seem to have agreed on some of these minor matters. From the draft that I saw that has
been past back and forth between the various attorneys involved the things that they were
changing were all relatively minor nature and everyone was agreeing to them. I am hoping to get
the documents signed this week by everyone, in which case we won’t have to go the route of a
district. The project will be cheaper and it will get completed quicker if everyone cooperates and
if avoid the extra hassle of a district formation. It looks a lot more promising in the last several
months, Councilman Montesi will be here in a little bit I will ask him if he can add to it if he
doesn’t get here while you are still here I will make sure he gives you a call.
MS. SULLIVAN-If it does get signed this week when would it go out to bid?
SUPERVISOR STEC-It goes out to bid advertise for a few weeks get it back I would think by
August early September. I think once we get the signatures on the agreements and the easements
then it is a matter of the bid process, which is a couple of weeks to put it out to bid a couple
weeks to hear back from people, a couple of weeks for the engineer to review them and decide
which one is the lowest qualified bidder. At that point it becomes a construction project where
we just get them on the calendar.
MS. SULLIVAN-Is there any consequences that this falls through again.
SUPERVISOR STEC-The consequences are we can head in the district direction, but then I
think we do start running the risk of not getting it done our goal is to have it done long before
snow falls.
PAUL H. NAYLOR, 15 DIVISION ROAD-Spoke to the board regarding the Controller position
at the County you are getting elected to do that job with an elected Treasurer, which it should be
and should stay that way.
PLINEY TUCKER-Spoke to the board regarding delivery of phone books noting they are
thrown at the edge of the road believes there is an Ordinance that deals with this asked the board
to look into getting this stopped.
SUPERVISOR STEC-To speak with Craig Brown and Dave Hatin tomorrow.
COUNCILMAN STROUGH-Has spoken to Counsel regarding this it is time to bring it up again.

WITH TOWN OF QUEENSBURY HOUSING REHABILITATION PROGRAM
RESOLUTION NO.: 252, 2010

WHEREAS, the Town of Queensbury has established a Housing Rehabilitation Program which
provides grants to cover 100% of the cost of rehabilitation up to a maximum of $25,000, whichever is
less, and
WHEREAS, the Town has received grant funds from the New York State Office of Community
Renewal Community Development Block Grant (CDBG) programs to cover eligible project costs, and
WHEREAS, a single family property Case File #6171 has been determined to be eligible for
rehabilitation grant assistance and the owner of the property has requested such assistance, and
WHEREAS, property rehabilitation specifications will be provided to a minimum of three (3)
qualified contractors for bid, and
WHEREAS, the low bid cost to complete the work specified is to be determined but will not
exceed twenty five thousand dollars and no cents ($25,000.00), and
WHEREAS, the low bid cost to complete the work specified will be verified upon receipt of
bidding documents, and
WHEREAS, Shelter Planning & Development, Inc. has overseen the grant process and has
verified that it has been followed in this case and recommends approving these grants, and
WHEREAS, a lien will be filed against the property for the benefit of the Town for a period of five
(5) years from the completion of the rehabilitation,

DISCUSSION HELD BEFORE VOTE:

SUPERVISOR STEC-Not long ago there was a motorcycle that was seized it went to Town Court the DA’s
Office was involved it was a motorcycle that had bad VIN numbers. The vehicle identification numbers had
either been allegedly tampered with they weren’t matching up correctly there were concerns about the status
of the motorcycle. For whatever reason the DA’s Office decided not to pursue the matter it went to Town
Court and ultimately wasn’t prosecuted so Judge Muller was all set to say fine then its dismissed let’s return
the motorcycle to the owner. Apparently the Department of Motor Vehicles took exception to the perspective
because we are not pursing this anymore doesn’t mean that the Judge should order the motorcycle returned.
The motorcycle owner said it’s my property I should be given it back. I talked with the Attorney General’s
Office today he shared with me his frustration about the case and I spoke with Cathy Radner. The reason
why we need special Counsel is Miller Mannix does a lot of the Town code enforcement work in front of
Judge Muller and Judge McNally. So, we can’t on the one hand be in there prosecuting stuff and then
defending him it will create a conflict of interest at, two hundred and fifty dollars an hour we’re on the path of
protecting the Judge’s interest in this case. What happened the owner of the motorcycle when told by
Department of Motor Vehicle no we are not releasing the bike he pushed for Judge Muller to fine the
Department of Motor Vehicles in Albany in contempt of court. They went and talked to the Attorney
General’s Office who represents them legally and the Attorney General’s Office slapped an Article 78
Petition to basically have Judge Muller stop him from preventing him from holding the Department of Motor
Vehicle in contempt of court. Now, the Town has gotten dragged into this and from what I have gathered
from talking to our Attorney and the Attorney General’s Office that this could have been avoided if the bike
owner had said, fine I will pay the twenty five dollars to get new vehicle numbers. There are a lot of people
that aren’t very happy with the way the world works these days and are very principled in the way that they
look at things and maybe have a lot less patience for government than in the past, I don’t suggest why I think
that why the owner was thinking what he was thinking. The bottom line is that he didn’t pay twenty five
dollars to get the bike back it was along the lines of why should I have to pay anything to get my property
back its my property so he has dug his heels in. I think Judge Muller; I don’t want to put words in his mouth
I haven’t talked to him about it. The impression I get is his position is as Town Justice he is well within his
right to say give the bike back. Although, I can tell you the conversation that I had with the Attorney
General’s Office today that they don’t think that he has that authority. I think that is what this case is about
for them is what is the Town Court’s authority is. The good news is that in my ten and a half years on the
Town Board I have never seen anything this bizarre involving the Department of Motor Vehicles the
Attorney General’s Office and the Town Court. What frustrates me and I know it frustrates other board
members here is that right or wrong for twenty five dollars this could have gone away it’s not going away and
now the Town is posed to spend two hundred and fifty dollars an hour on our end yet alone what the State of
New York and the Attorney General’s Office is going to paying on their end. So you have government
spending money fighting another government over something if everyone was rational in what’s important
here it could have all been resolved for twenty five dollars then we wonder why New York State is in the
mess that it is.
COUNCILMAN MONTESI-Can I give the guy twenty five bucks.
SUPERVISOR STEC-Cathi Radner’s suggestion look I’ll give them twenty five dollars it is just another one
of those things we have both been here before about how the world works. One, it has moved beyond that
now as far as the Attorney General’s Office it isn’t about the twenty five dollars anymore it is about winning
this ….Macho battle with the court. I wanted to do that to work in here that Queensbury is bilingual this is
what this boils down to …Macho between the Attorney General’s Office and Town Court. Literally more
less this is what I got from the phone conversation I had today that this has involved into a no we’re right and
we’re going to show you that we’re right so now everyone is going to start spending money on something
that could have gone away for twenty five dollars. The other part is that Cathi explained to me that
somebody, anyone, a nice donor out there in the room or a Town Board member can’t just pay the twenty
five dollars for the guy it doesn’t work that way either. This guy has to say yes he has to want to do that and
apparently he doesn’t. I haven’t talked to him I don’t know him all I know is that all of a sudden the
Attorney General’s Office slaps what amounts to a restraining order of sorts on the Town Judge to tell him
not to hold the Department of Motor Vehicles in contempt of court only in New York. We’re frustrated we
are kind of obligated to stick up for the Judge although, I am going to look into as I talked to the board
members, I mean if the Judge changed his mind then this could go away, too. Basically there are three
parties here that are in a position to if anyone of them had….
COUNCILMAN MONTESI-If the Judge changed his mind, but the guy would owe twenty five bucks to get
his motorcycle.
COUNCILMAN BREWER-Then it becomes between Motor Vehicle and this this fellow.
COUNCILMAN STROUGH-I don’t think the taxpayer is going to be happy knowing that this could have
been settled for twenty five dollars and we’re paying an Attorney two hundred and fifty dollars.
SUPERVISOR STEC-I made that clear to the Attorney General, I said I will talk about this tonight with my
board. I said the board is going to ask questions the Press is going to be there this in not going to read well.

COUNCILMAN MONTESI-What happens if we don’t pass the resolution?
COUNCILMAN STROUGH-I think we are obligated to legally support Judge Muller.
SUPERVISOR STEC-Right.
COUNCILMAN STROUGH-Only now the situation has surfaced maybe Judge Muller now realizes or I
don’t know maybe he doesn’t have the power.
COUNCILMAN BREWER-I disagree with you John. I think it’s a shame that we even had to make a
resolution to pay two hundred and fifty bucks an hour if he can change his mind to make this go away then I
think that is what he has to do.
COUNCILMAN STROUGH-If you read the emails I have been just an unhappy as you are about this, but I
do think we have an obligation.
COUNCILMAN BREWER-I understand that, but if it’s something that simple.
SUPERVISOR STEC-Is it the role of the Town Board to tell the Judge. Before we read about it in the paper
it is ridiculous and it’s not the Town Boards fault.
COUNCILMAN STROUGH-It is a fight between the motorcycle owner and the DMV.
SUPERVISOR STEC-That we are getting dragged into as the Town.
COUNCILMAN STROUGH-Which, could have been solved for twenty five dollars.
COUNCILMAN BREWER-Right, but as an Officer of the Court if he can get us out of this for no cost then
do it.
SUPERVISOR STEC-He may say, look I am right I should be independent of the Attorney General muscling
me around.
COUNCILMAN BREWER-I understand that.
SUPERVISOR STEC-It is over twenty five dollars and the principals involved and depending on whom you
talk to out there.
COUNCILMAN STROUGH-It is not like we can wait until week for this because what is it Friday….
SUPERVISOR STEC-We have an answer date back before our next Town Board meeting, which is why we
kind of put this together relatively quickly. I will talk to Attorney Reichenbach and I will talk to Cathi
Radner on whether or not it is appropriate for the Town Board. Judge Muller reads the paper he will read
about it tomorrow is it appropriate for me or any of us to pick up the phone and say, geez Judge would you
reconsider.
COUNCILMAN BREWER-No, I would never do that.
SUPERVISOR STEC-That’s what I am saying he is going to read about it in the paper. Again, I have not
talked to him about it and he might be right as rain. He may say that the Attorney General’s Office is off
their rocker I have every right.
COUNCILMAN MONTESI-If you vote no then Plan B has to go into effect.
SUPERVISOR STEC-If you vote no on this I have no idea how he is going to be defended in court.
COUNCILMAN STROUGH-We have a legal obligation to defend him in court.
SUPERVISOR STEC-I think we do more to follow on this I am sure this is going to be an opportunity.

some restrictions in the Town Code under Residential Design Requirements, Waterfront
Residential Design, and Shoreline Alternation. Many other States, Counties, areas of the
country are adopting more prevalent banning of phosphorus noting it is not a complete
ban. Read the health effects regarding the use of pesticide on the shoreline. Asked if
Councilman Metivier would like to work with him regarding this noting they could take
this model code and develop a draft for the Town Board.

Thanked Supervisor Stec for the time schedule regarding the budget

Great letter that Supervisor Stec wrote regarding the possible garbage collection districts
asking the vendors their opinion.

Spoke regarding the Building Departments monthly report noting they are still on the
plus side by two and a half million with all that is going on. The month of June we did a
million nine in building permits verses three million four last near not sure what
happened last year that boosted that. We do have other things coming along like Exit 19
Diner, Wal Mart.

Accolades to Highway Superintendent Mike Travis who is a great guy to work with.
When folks call in Ward Two and say, my sidewalk is all broken up Mike is the first one
out there with me. We make a decision to repair that if it’s a small job if it’s a big job we
have done some engineering work on it. When, I talk to Mike about paving the shoulder
wider on Meadowbrook Road to accommodate all the folks that is a September job it is a
real pleasure to work with a highway guy that understands some of our needs and
concerns.

We have only received one nomination for the Beautification Award for this year people
please if you are driving around and see someone’s yard that is exceptionally beautiful
please feel free to nominate them you can email any of your Councilman at Ward One,
Two, Three, or Four at queensbury.net. and we will get them to the Beautification
Committee.

The Main Street Project is coming along this first years work is essentially all the Town
infrastructure water, sewer, underground utilities. They are just about done with water
and sewer and have a good jump on the underground electrical utilities everyone has
done a good job in trying to make this project go as smoothly as possible for everyone
last I heard it was on schedule.
?
Saturday morning at Crandall Park at the Victory Peace Monument there was the fourth
panel of the veteran’s names dedication. What is noteworthy I thought on a Saturday
morning after record heat, but it finally broke a little bit there were a few hundred people
there it was a nice event and the American Legion Post 233 out of Glens Falls has been

working on this project for a while. They are going to go around to the back of the
monument now with smaller panels if people want to continue to add names of love ones
to the monument that will grow until they run out of room. They did finish the front four
panels on the granite slabs behind the monument. It was a very nice event, but more
importantly we have about eight hundred names on the panels from people from the area
that have served.
