Description of Proposed Project:
Applicant proposes construction of a 2,796 sq. ft. home with an attached garage and to construct a 750 sq. ft.
detached garage. The second garage will allow for the storage of property maintenance equipment as the project
site is 34.2 acres. The project includes associated site work for house placement, driveway area, septic and well
installation. Site plan review for construction within 50 ft. of 15% slopes. Relief requested for second garage.
Relief Required:
The applicant requests relief for a second garage in the Moderate Density zone -MDR.
Section 179-5-020—garage
The project includes a new home with an attached garage and construction of a second garage. Relief is for
having more than one garage where only one garage is allowed per parcel.
Criteria for considering an Area Variance according to Chapter 267 of Town Law:
In making a determination,the board shall consider:
1. Whether an undesirable change will be produced in the character of the neighborhood or a detriment
to nearby properties will be created by the granting of this area variance. Minor to no impacts to the
neighborhood may be anticipated.
2. Whether the benefit sought by the applicant can be achieved by some method, feasible for the
applicant to pursue, other than an area variance. Feasible alternatives may be considered limited due to
the lot size and the applicant's intent to use the garage for storage of property maintenance equipment.
3. Whether the requested area variance is substantial. The request for relief may be considered substantial
relevant to the code. The relief is for a second garage.
4. Whether the proposed variance will have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district. Minor to no impact to the physical or
environmental conditions in the neighborhood may be anticipated.
5. Whether the alleged difficulty was self-created. The difficulty may be considered self-created.
Staff comments:
The applicant proposes construction of a new home with an attached garage and also proposes a second garage.
The applicant has indicated the second garage will assist with property maintenance as the parcel is 34.2 acres.
The plans show the location of the new home and the proposed second garage.
