2010-12-13 SP MTG.# 46 SPECIAL TOWN BOARD MEETING MTG.#46 DECEMBER 13, 2010 RES. 403 7:00 p.m. TOWN BOARD MEMBERS PRESENT SUPERVISOR DANIEL STEC COUNCILMAN ANTHONY METIVIER COUNCILMAN RONALD MONTESI COUNCILMAN JOHN STROUGH COUNCILMAN TIM BREWER Craig Brown-Zoning Administrator ZONING ISSUES 1. MONTRAY ROAD-ZONING CHANGE Attorney John Lapper-Representing the LA Group and Gordon Development-property located behind Sleep Inn on Montray Road the back side of Home Depot including Blind Rock-presently zoned Highway Commercial Moderate-not a good location for commercial development-proposal a transition between Highway Commercial Intensive and similar to the other transition uses like the apartment complexes on the back side of Walmart, we are proposing in exchange for the rezoning is to create a park for Blind Rock with parking spaces etc. Supervisor Stec-Questioned how many units? Attorney Lapper-What the zoning would allow for a PO Zone, eight units per acre. Thirty two units for that area. Supervisor Stec-Attorney Lapper is requesting because the property is on the back side off from Route 9 that commercial use might not be successful there and might be a more objectionable use to the neighbors across the road than a residential use. You see this as an opportunity here to transition the uses. Thirty two units might be a concern for the Board. Councilman Strough-Concerned about the stress on Sweet Road and Montray Road. The densities we can work on, I do like the idea of recognizing the rock with a park. Will that be on public or private domain? Attorney Lapper-We would like to propose a perpetual easement to the town. Supervisor Stec-Concerned with the intersection of Montray and Sweet Road, problematic for dumping traffic on Route 9 from the location of the wood carver no light there. Questioned if the town wanted the park property how would the density be changed? Attorney Lapper-We are at thirty two units if we had to give up two it would probably still be viable after that not so much. Supervisor Stec-Questioned if duplexes were considered? Attorney Lapper-No. Councilman Brewer-Suggested rezoning the whole thing. Supervisor Stec-Noted that the other area has more visibility to be developed commercial. Councilman Strough-An archeological study will need to be done on this site. Councilman Brewer-We would rezone the area on its merits it is not for us to decide how many buildings they can build. Councilman Strough-If you gave us a half acre around the rock and cut out four units I think we are within the realm of something comfortable. Attorney Lapper-We would probably be able to on 4.13 acres keep it to thirty units and give you a little bit less than a half acre it would probably work out. Councilman Strough-As uncomfortable as I am, I am willing to go with twenty eight units and give the town a half acre around Blind Rock. Councilman Brewer-I do not have big issues with thirty units. Councilman Montesi-I think twenty eight is the number with a half acre. Supervisor Stec-If we hold it to twenty eight and something happens in the next few weeks, I would feel more comfortable letting that go office as well. Councilman Metivier-Why don’t you just let them do five, six units. Unknown-Noted that the density calculations have not been done yet, it might yield less than the units requested. Councilman Strough-If they want to come back with an offer after they do the density calculations lets see that. Attorney Lapper-We have to look at the slope issue and drawing a line around Blind Rock and come back and give you the number of units. Supervisor Stec-We will hold this for a separate hearing or we would like to see twenty eight units and how much would be carved out to the town, if you could get that to us by Wednesday morning… Unknown-We could give the town three quarters of an acre easement that would not impact the density, and do thirty units and we would put in the park. Councilman Brewer-If they give us three quarters of an acre easement and we rezone this to office let them worry about how many units they can put in there. Supervisor Stec-I would feel better to know the maximum that would be allowed. 2. CLUTE/FARRONE ZONING MAP CHANGE Attorney Lapper-No sewers in this area, all we can do is two acre lots, on the Luzerne Road piece its zoned industrial proposed to be MDR, the site by the airport is zoned residential…we are talking about swapping a residential zone for light industrial zone; moving the light industrial over by the airport where there are sewers…swapping MDR for Light industrial…showed the Board the concept of an industrial subdivision… Supervisor Stec-Noted these changes will be included in a larger Zoning Code change, time line being thth public hearing on January 24 going to APA in February and February 28 would be the earliest that we could do anything with this. 3. ZONING REVISIONS UPDATE Craig Brown-Led the Councilmen through the proposed revisions 1. change the wording from Clustering to Conservation Subdivision APA questioned the following: 1. Accessory Structure – what if the structure is over a certain size New language – deals with shore line setback 2. Draft calls for a maximum of two hundred square feet of fence within fifty feet of a shore line We increased it from one hundred to two hundred – APA considers fences a structure ours doesn’t … Board agreed to change it back to a hundred… Monday night we will set a public hearing and seeking SEQRA Lead Agency Status and referring it to th APA, Warren County Planning … Public Hearing will be on January 24 that gives a full 30 days to let the th clock run so we can assume SEQRA Status. The 24 we will do SEQRA, close the public hearing to be adopted after it comes back from APA and they will have the SEQRA in hand for their February meeting ththth to be held on the 10 or 11 then at our next regular meeting after that is the 29 of February it could be adopted. Councilman Strough-Requested that the resolution also denotes the tables in the Zoning Code. DISCUSSION – QUEENSBURY VILLAGE Councilman Brewer-Barry Converse owns a trailer park, corner lot is dedicated to a Senior Center the Seniors in the park do not want a center, he wants to change it and needs a Town Board resolution to do so. He is requesting to reduce the size of the lot so he can put in a mobile home. The left over portion of the lot to let the senior’s that park their RV’s , this would only be for use by the residents of the park. Supervisor Stec-Discussed putting a restriction on the lot that no home could be placed on it… Agreed to by the Board … Would like to have a resolution before the Town Board at the next Board meeting after review by Dave Hatin. DISCUSSION – BIKE ROUTES Councilman Strough-Received a letter from Lloyd Mott asking if the Town Board is ready to approve the routes? Spoke on the history of the bike map. Noted that roads cannot receive grants unless they have been designated on an official bike trail map. The Town is not obligated to do anything. Supervisor Stec-Requested a clean map regarding the trails and give this to Pam Hunsinger. DISCUSSION – TOUR LANDFILL Councilman Brewer-Received a call from a man that wants to tour the landfill on Ridge Road, Keith Shearer took him on the tour, the guy is interested in pulling the methane gas out of there and selling back to Nimo. He sent me an agreement and Town Counsel is reviewing it. th Supervisor Stec-I may bring him in on the 27 to speak to the Board on this proposal. DISCUSSION-BED TAX FUNDS Councilman Metivier-RE: Bed tax money for West Mountain - want to make this a year round resort mountain. Requested bed tax money for bus, to run people back and forth from the Great Escape Lodge and shopping etc. he will not charge anyone for the service.
