RESOLUTION CALLING FOR EXECUTIVE SESSION

that the Town Board of the Town of Queensbury hereby moves into an
Executive
Session to conduct interviews to do the engineering work for the Planning Board.

REGULAR SESSION
DISCUSSION: MONTRAY ROAD RE-ZONING
Attorney John Lapper-Reviewed the project with the Town Board. The total density
taking the slope out of consideration would be forty two with the slope would be thirty five.
Supervisor Stec-According to our zoning it would be thirty five unless you get a variance.
Attorney Lapper-Correct.
Supervisor Stec-An apartment or office transition zone is a good fit there.
Attorney Lapper-The builders would build the park and donate it to the town.
Will review process with Craig Brown on the donation of land to the town.
Supervisor Stec-What I like about this now is you have brought this all the way to Sweet Road.
Attorney Lapper-Requested that the Town Board seeks Lead Agent for SEQRA Review
including the density.
Zoning Administrator Brown-You could do that but I would argue that the Planning Board is
more suited to do SEQRA. Noted that there are a lot of site issues here, steep slopes over twenty
percent, stabilization laws that affect the earth moving grading that you might not think about
when you thinking about the rezoning that is my first reaction.
Councilman Strough-I think the Planning Board should do it.
Supervisor Stec-I do not see why we couldn’t do the SEQRA on the rezoning and the Planning
Board does their own SEQRA.
Attorney Lapper-It is not a Type I Action so you do not have to have coordinated review so the
Town Board could do SEQRA for the rezoning.
Supervisor Stec-Questioned if the Town Board initiates this rezoning or the application for this
proposal?
Zoning Administrator Brown-I think it is best if the applicant submits the application for
rezoning.
Sr. Planner Stu Baker-Two points 1. Density – The proposed park land would need to be
subtracted out for density calculations..will look at this closer 2. This would be Type 1 for
SEQRA 179-1506 under Article 15 Amendments to Zoning.
Attorney Lapper-If Stu is right we would have to do a coordinated review –Town Board,
Planning Board and Zoning Board that is a big process.
Supervisor Stec-Work with Craig and Stu on the process …
DISCUSSION: HERCULES BROWN FIELD GRANTS
Sr. Planning Baker-We are putting together a resolution for the Board to approve the signing of
the second contract, we have two different grant contracts, with both signed we put both out for
an RFP.
Supervisor Stec-Stu is working on getting an engineer to do the Dixon/Farr/Aviation Road round
about the engineer money has been approved for 2011 and construction money for 2012.
Discussed a turn lane may be included in the project by Queensbury School.
