The Queensbury Zoning Board of Appeals has reviewed the following request at the below
stated meeting and has resolved the following:

MOTION TO APPROVE AREA VARIANCE NO. 49-2008 KRISTIN AND JESSE HOWARTH, Introduced
by Joan Jenkin who moved for its adoption, seconded by George Drellos:
10 Bullard Avenue. The applicant wishes to erect a six foot tall stockade fence in a non-
architectural front yard. The relief required, the applicant requests relief from placement and
height restrictions per 179-5-060, specifically one foot in height and a style change. In making
the determination, the Board is considering the following criteria. Whether an undesirable
change will be produced in the character of the neighborhood or a detriment to nearby
properties will be created by the granting of this Area Variance. Minor effects to the
community may be anticipated as a result of this proposal. Further the application has a dense
hedge row that will screen the fence along the north side of the property. Whether the benefit
sought by the applicant can be achieved by some method feasible for the applicant to pursue
other than an Area Variance. According to the applicant, the height and style change will be
made to ensure the safety of the applicant's children. Further, the parcel is located on the
corner of Bullard and Park Place, and as such the configuration of the parcel adds to the need
for a variance. Whether the requested Area Variance is substantial. This variance is
considered minor relative to the Ordinance. The 16.7% relief is considered minor. Whether the
proposed variance will have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district? Any possible physical or environmental impact on

the neighborhood may be considered minor, and according to the neighbor this will be a
positive for them, because they are going to add to it if they can. The difficulty may be
considered self-created as they are concerned and want to protect the safety of their children.
So I move to approve Area Variance No. 49-2008.
