This letter is written as an inquiry as to determine whether or not it is appropriate to utilize area designated as
landscape buffer located between residential and commercial uses for on-site wastewater disposal. This concerns
the proposed development of lot 455 on T.wicwood Lane within the Twicwood Subdivision.
To the west the property is bordered by the Sutton's property for which the 50'buffer is required The woody
vegetative growth along the west propertyline.extends to the'east approximately 37'consistently along the-property
line(See attached Wastewater Disposal System Design Plans—Half Size). The remaining 13'of'.buffer"is
presently devoid of woody vegetative growth and is planned to be lawn area.'. No cutting would be required to locate
the proposed wastewater disposal:system 37'.from the west property line and provide the minimum 20' setback from
the residence to the leaching system.
The 20'minimum setback for residence to leaching system Cannot.be provided if the 50'no disturbance buffer is to
"be maintained We are.seeking.the Planning Department's interpretation of the town code in this regard;is it
allowable to construct a wastewater disposal-system within a landscape buffer that requires no additional clearing?
A great deal of difficulty would existbecause of the existing topography and space available if the wastewater
disposal system was to be relocated elsewhere on the property.
