BOARD MEMBERS PRESENT SUPERVISOR JOHN STROUGH COUNCILMAN ANTHONY METIVIER (arrived during discussion items at 3:54 p.m.) COUNCILMAN HARRISON FREER COUNCILMAN GEORGE FERONE COUNCILMAN TIMOTHY MCNULTY TOWN OFFICIALS Chris Harrington, Water Superintendent & Director of Wastewater Stuart Baker, Senior Planner SUPERVISOR STROUGH called meeting to order… RESOLUTIONS RESOLUTION APPOINTING ROBERT MOREHOUSE AND WILLIAM NEVILLE AS PART-TIME SCHOOL CROSSING GUARDS RESOLUTION NO.: 282, 2021 INTRODUCED BY: Mr. George Ferone WHO MOVED FOR ITS ADOPTION SECONDED BY: Mr. Harrison Freer WHEREAS, two (2) part-time School Traffic Officer (Crossing Guard) positions exist within the Town of Queensbury and the Town Board wishes to make appointments to such positions, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby appoints Robert Morehouse and William Neville as Part Time School Crossing Guards to work according to the Queensbury Union Free School District’s calendar/schedule, effective on or about September 1, 2021 at the current rate of pay for the position(s), subject to the Town successfully completing background checks as reasonably necessary to judge fitness for the duties for which hired and/or drug and/or alcohol screening, and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor and/or Town Budget Officer to complete any forms and take any actions necessary to effectuate the terms of this Resolution. th Duly adopted this 30 day of August, 2021, by the following vote: AYES : Mr. Freer, Mr. Ferone, Mr. McNulty, Mr. Strough Special Town Board Meeting, 08-30-2021, MTG # 27 794 NOES : None ABSENT: Mr. Metivier RESOLUTION AUTHORIZING INSTALLATION OF CROSSWALK ON PARKVIEW AVENUE RESOLUTION NO.: 283, 2021 INTRODUCED BY: Mr. Harrison Freer WHO MOVED ITS ADOPTION SECONDED BY: Mr. Timothy McNulty WHEREAS, Vehicle and Traffic Law §1660(a)(14) allows Town Boards to regulate the crossing of Town roadways by pedestrians, and WHEREAS, The Town Board believes there is a need for a crosswalk on Park View Avenue just north of Dixon Avenue to provide safe passage for kids walking to and from Kensington Elementary School, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes the installation of a crosswalk crossing Park View Avenue just north of Dixon Avenue for the reasons stated above, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Town Budget Officer to make the necessary budget adjustments to effectuate this Resolution, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town Highway Superintendent, Town Budget Officer and Town Counsel to take any and all actions necessary to effectuate all terms of this Resolution. th Duly adopted this 30 day of August, 2021, by the following vote: AYES : Mr. Ferone, Mr. McNulty, Mr. Strough, Mr. Freer NOES : None ABSENT: Mr. Metivier Discussion held before vote: Special Town Board Meeting, 08-30-2021, MTG # 27 795 COUNCILMAN MCNULTY-Questioned whether we are being consistent. There was a woman on Assembly Point that requested a crosswalk and the town’s response was crosswalks don’t do much and can actually cause problems. What is the difference? COUNCILMAN FREER-That was Tony’s view, not the Town’s view. SUPERVISOR STROUGH-That was my view and Dave Duell’s view. Some crosswalks are not appropriate in some places. Assembly Point Road is already a narrow road because of the configuration and the speed limit is 25 that most people do not even do. Dave thought people need to be cautious, look both ways and a crosswalk isn’t needed there. In contrast to that, you have Parkview Avenue which is widely used by students getting from the Broad Acres, Dix Court, Hughes Court and that whole neighborhood feeding into Kensington Road School District. The public has been asking for at least crosswalks here and sidewalks too but it is very difficult to put the sidewalks in after the fact. I think putting in a crosswalk here does serve a purpose of making the drivers more cautious to the pedestrians crossing in this case. Vote taken, resolution approved. RESOLUTION AUTHORIZING CHANGE ORDER NO.: 001 WITH BLUESCOPE CONSTRUCTION, INC. FOR CONSTRUCTION OF HIGHWAY STORAGE BUILDING ON BIG BAY ROAD RESOLUTION NO.: 284, 2021 INTRODUCED BY: Mr. George Ferone WHO MOVED ITS ADOPTION SECONDED BY: Mr. Timothy McNulty WHEREAS, by Resolution No.: 162, 2021, the Queensbury Town Board authorized the: 1) establishment of a Highway Building on Big Bay Road Capital Project No. 238 to establish funding for expenses related to the purchase and construction of a Highway Department Storage Building on Big Bay Road (Storage Building); 2) finalization of a Storage Building design consistent with the Sourcewell cooperative, municipal purchasing program; and 3) purchase and construction of a Rough Order Magnitude (ROM) Storage Building by BlueScope Construction Inc.’s (BlueScope) in accordance with Sourcewell and BlueScope’s April 23, 2021 proposal for the amount of $534,060, and WHEREAS, by Resolution No.: 222, 2021, the Town Board authorized BlueScope’s Revised Proposal/Agreement dated June 3, 2021 for the Storage Building for the amount of $460,702, and WHEREAS, the Town’s Wastewater Director/Water Superintendent has requested certain changes to the Storage Building due to the anticipated intermittent winter time use of the Storage Building and its location downstream of the oil/water separator, and WHEREAS, BlueScope has presented the Town with Change Order No.: 001 dated 19- Aug-21 providing for these recommended changes in the amount of $10,283 bringing the total Contract amount for the Storage Building to $470,985, and WHEREAS, Resolution No.: 162, 2021 was adopted subject to Permissive Referendum and Special Town Board Meeting, 08-30-2021, MTG # 27 796 the Permissive Referendum period has passed and the total proposed Contract amount of $470,985 is for a lesser amount so no additional Permissive Referendum is required, and WHEREAS, the Town of Queensbury will continue to adhere to all New York State bidding requirements, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and approves BlueScope Construction, Inc.’s Change Order No.: 001 dated 19-Aug-21 pertaining to the purchase and construction of a Highway Department Storage Building on Big Bay Road (Storage Building) as described in the preambles of this Resolution in the amount of $10,283 bringing the total Contract amount to $470,985 to be paid for from the Highway Building on Big Bay Road Capital Project Fund #238, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute Change Order No.: 001 substantially in the form presented at this meeting and/or any other needed documentation, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Town Budget Officer to adjust the Project’s appropriations and/or take any other needed actions as necessary to provide for payment, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town Highway Superintendent, Town Wastewater Director/Water Superintendent and/or Town Budget Officer to take all other actions necessary to effectuate the terms of this Resolution. th Duly adopted this 30 day of August, 2021, by the following vote: AYES : Mr. McNulty, Mr. Strough, Mr. Freer, Mr. Ferone NOES : None ABSENT: Mr. Metivier DISCUSSION ITEMS:  Low Impact Development and Comprehensive Land Use Plan – Stuart Baker Special Town Board Meeting, 08-30-2021, MTG # 27 797  ARPA Spending – Chris Harrington (Audio malfunctioned, no more recording at this point in the meeting)  Stretch Code  Comprehensive Safety Management  Occupancy Tax Application  Zoning  Short Term Rental Law  Sunnyside Par 3 – Golf Simulation would be a non-conforming use with current zoning. Change zone to RR-3 and add golf course/range.  Max Oswald/Northway Brewing. Allow outdoor events in CI Zone.  Next Town Board Workshop –Agreed to Wednesday October 13, 2021 at 2 PM  Supervisor Strough gave update regarding EMS Professional Services, noting that Peter Berry and Chris Kostyun from EMR will be working with our rescue squads.
