`. QUEENSBURY BOARD OF HEALTH
SUPERVISOR WALTER - Stated that a letter was received from Mr. William Morton desiring
to have a meeting with the Queensbury Board of Health pursuant to Section 4.040 of the
Sanitary Sewage Disposal Ordinance of the Town of Queensbury.
RESOLUTION TO SET PUBLIC HEARING ON APPEAL OF ISSUANCE OF PERMIT FOR
DISPOSAL SYSTEM.
RESOLUTION NO. 1, Introduced by Mr. Stephen Borgos, who moved its adoption, seconded
by Mrs. Betty Monahan.
WHEREAS, the Town Board of the Town of Queensbury is by operation of Law the local board
of Health for the Town of Queensbury, and as such, is authorized under §4.040 of the sanitary
sewage disposal ordinance to hear appeals of actions of the Town Enforcement Officer, and
WHEREAS, William B. Morton, by letter dated June 20, 1986 filed an appeal of the decision
to issue a septic permit to Terrance Frederick for property on Meadow Lane, and
WHEREAS, procedural due process requires notification of the proceeding to the affected

parties.
NOW, THEREFORE, BE IT
RESOLVED, that a public hearing be held concerning the appeal as described in the attached
letter that said public hearing be held at 7:30 p.m. in the meeting room of the Town of
Queensbury Office Building, Bay & Haviland Roads in the Town of Queensbury, Warren Coupty,
New York on the 26th day of August, 1986, at which time all persons interested in the subject
thereof will be heard, and be it further
RESOLVED, that the Town Clerk be- hereby directed and authorized to mail a copy of this
resolution to Mr. Morton and Mr. Frederick.

Ayes: Mr. Kurosaka, Mr. Borgos, Mr. Montesi, Mrs. Monahan, Mrs. Walter
Noes: None
Absent: None
TOWN COUNSEL - Stated that there were no requirements of publications on this appeal,
notify parties involved, Mr. Fredericks, owner of property and Mr. Morton by registered mail.
