1986-08-26 t TOWN BOARD MEETING AUGUST 26, 1986 TOWN BOARD MEMBERS Mr. Frances Walter - Supervison Mr. George Kurosaka- Councilman Mr. Stephen Borgos - Councilman Mr. Ronald Montesi - Councilman Mrs. Betty Monahan - Councilman TOWN COUNSEL:Wilson Mathias PRESS: Glens Falls Post Star PLEDGE OF ALLEGIANCE LED BY: Councilman Ronald 1.4ontesi MEETING OPENED: 8:20 P.M. i SUPERVISOR WALTER-Introduced John Banta and Greg Hill from the Adirondack Park Agency. JOHN BANTA-Director of Planning with Adirondack Park Agency...Stated that Greg Hill is the director of the new Lake George Office. Stated that they were here to discuss the local Planning Assistance appropriation the Agency administers and remind the Town that the local assistance appropriation of the Park Agency is $160,000.00 to be allocated among the local governments with the Adirondack Park for Planning Assistance for development of local land use programs, through this appropriation the agency provides administrative assistance as well. The local assistance appropriation is provided at the Towns discretion that is it is a voluntary relationship and does not involve any mandate from the Agency other than the general objectives for statutory purposes. Also stated that they have been working with the Warren Planning Office and less formally with the Supervisor of the approved local land use program to begin to establish what is called a inter municipal agreement for land use planning in the basin. That would be a special allocation of assistance to the Lake George Basin of $50,000.00 to be shared jointly by those five towns that have approved the program. '± The short term objective would be to take a detailed survey that has been recently completed by the Soil Conservation Service and do what is called a soil potential analyses. In short what ,_- the Soil Conservation Service does is take a fairly technical document and turn it in to practical advise in terms of the costs of septic system, foundations, for the Zoning Administrator and Planning Board. To establish computerized permit tracking systems so that people can actually get advise on both the State and local permits. SUPERVISOR WALTER-Advised the Town Board that she sat in on a meeting with Mr. Banta several weeks ago where they took a couple of hours going through this draft and that was by virtue being Town Supervisor of the Town thats in the Lake George Basin joined by Hague, Bolton, and Lake George Supervisors. Asked if the Town Board had any questions they might want to ask Mr. Banta relative to the training program? COUNCILMAN BORGOS-Asked who would administer the funds? JOHN BANTA-The funds would be administered by a fiscal agent of one of the Towns. SUPERVISOR WALTER-Stated that what they were trying to do as far as the Lake George Basin is concerned is to get the Towns around the Lake together and have them talk and agree in getting some standardization. JOHN BANTA-Noted that there was a very large day to day work load of decisions that a Technical Engineer could help with. COUNCILMAN MONTESI-Would this be counterproductive, or should we be putting our effort into a much bigger picture, ultimately the answer is going to have to be sewering of the shoreline? JOHN BANTA-Stated that this is a first step that we can take and the terms of the first program are very neutral with respect to the particular kinds of policy questions you are asking. I don't anticipate the Agency in this particular short term exercise to say that this particular place that needs sewage or this isn't, it certainly advance the information the Town 246 needs to make its own decision on that respect. COUNCILMAN BORGOS-Asked if the Service considers the whole Town in this or just that part of the Town in the Park. JOHN BANTA-Techinical speaking we can only provide assistance for that portion of the Town within the Park. Stated that in setting up the computerized permanent indexes and it should be compatible with the areas of the Town. Added that on the second Resolution which is the one I am trying to sell, you could simple include that in your regular Resolution, just add a declaration of intent and ask that those funds be reserved while conversations go forward to formalize the agreement. SUPERVISOR WALTER-Asked for further input, hearing none the Public Hearing declared closed. 8:40 P.M. PUBLIC HEARING-NOTICE SHOWN SUPERVISOR WALTER-Noted that this Public Hearing was to amend Local Law #1, 1981 regarding the defense of Town Officers and employees. Noted the changes made in the Local Law #1 is the word Indemnification and in Section 3 the word Indemnify. TOWN COUNSEL-The law is changing from simply defending to Indemnify. Section 18 of the Public Officers Law permits State and Local governments not only to provide for the defense of the elected officials in case of any possible civil suit but also for the Indemnification SUPERVISOR WALTER-Asked for further input, hearing none the Public Hearing closed. OPEN FORUM: 8:42 P.M. SUPERVISOR WALTER-Asked for public comments? PIERSON MESSIER-586 Dixon Road-Presented a letter prepared by the residents on Dixon Road regarding the speed limit on that road. Also requested a solid line from the beginning of Kensington Court to the end of Dixon Road. Also stated that a stop sign was needed at Midnight and Dixon Road for school children to cross and a flashing light on the corner of Dixon Road and Cottage Hill Road. Stated that there was not enough sheriff patroling done on the road to help keep the speed down. (Letter on file) SUPERVISOR WALTER-Noted that the Town does not set speed limits, the State of New York does that and a few years ago the state was asked to lower the limit and what they did was raise it five miles instead. Doubted that a flashing red light would ever be put in on Cottage Hill. MR. MESSIER-Asked if they might get a caution light? SUPERVISOR WALTER-Asked for what reason? MR. MESSIER-The School buses are coming down Dixon Road and a number of children have to cross the road and with the traffic going as fast as it is now, the children don't have a chance to get across. COUNCILMAN MONAHAN-Asked if it weren't more feasible to reroute that bus route so the children don't have to cross the road? SUPERVISOR WALTER-To put a flashing red light or a caution light for a hour a day is a very expensive proposition. There has to be other solutions available other than this. .J COUNCILMAN MONAHAN-Noted that flashing lights are not the answer. MR. MESSIER-Stated that they really wanted to slow the traffic down. SUPERVISOR WALTER-what we generally do when we have this type of complaint is, we request the Sheriff's Dept. to concentrate and issue some speeding tickets and do that periodically. There is no police department that can put a Sheriff's Patrol or Police Car on every corner but they will concentrate in the areas. MR. MESSIER-Asked if they have a solid line put down the road rather than the passing lines? COUNCILMAN BORGOS-Noted that two of them lived in the same area and said he spoke 247 to Mr. Naylor regarding the solid line. Noted he thought the dotted line increased the speed even though it does help having a line determining the middle of the road. MR. MESSIER-Requested they ask for the 35 mile an hour speed limit again? SUPERVISOR WALTER-We could petition. PAUL NAYLOR-Highway Supervisor-Noted that often times they raise the speed limit so there won't be the bottling up of traffic. MR. MESSIER-How about a petition? SUPERVISOR WALTER-Mr. Naylor is in charge of the solid line and he will make that decision. -�-- As far as 35 miles per hour is concerned we will try to get that lowered. I think as far as the petition is, lets wait till we hear from them and if they turn it down then I will call you and get a petition together and perhaps that will help change their minds. PAUL NAYLOR-Highway Superintendent...Noted that the Town Board had the power to grant above the State of New York on the lines. I think you have to do it by resolution. DAVID KENNY-Lake George...Addressed the sign ordinance...Stated that he thought the Town should upgrade the sign ordinance before enforcing a law that is ten years old. SUPERVISOR WALTER-Stated that there would be no further discussion on the sign ordinance. The law is ten years old and the only reason we are hearing from anyone is because there was quite a long grandfathering time for having signs come into conformence. Noted that there was a problem with a particular sign then the owner has to go for a variance. Said they will be looking at the sign ordinance when we have our new Planning and Zoning Departments as well as all of the other ordinances. Stated that the Town Board is solidly behind the sign ordinance as it is now written and it is going to be enforced. SUPERVISOR WALTER-Asked for further input, hearing none Open Forum closed. RESOLUTION TO APPROVE MINUTES RESOLUTION NO.2U, Introduced by Mrs. Betty Monahan who moved for its adoption, seconded by Mr. Ronald Montesi. ' — RESOLVED, that the Town Board minutes of August 12, 1986 be and hereby are approved. WHEREAS, the Town of Queensbury has been experiencing phenomenal growth for the past twenty years and WHEREAS, the Building and Zoning Department has required additional staff to perform increased daily activities related to zoning, planning, inspection and enforcement and WHEREAS, the Town Board has reviewed the functions of the Building and Zoning Department and recognizes the need for a division of the numerous tasks now being performed within the Department and WHEREAS, the Town Board wishes to address this situation by the creation of a separate department to specifically handle Planning and Zoning matters within the Town, NOW, THEREFORE BE IT RESOLVED, that a new department called the PLANNING AND ZONING DEPARTMENT be established to handle all planning and zoning matters in the Town and that the 1986 Town Budget be increased by $9,800. in A2258020.1 and $2,000. in A225820.440, and be it further 248 RESOLVED, that the Building and Zoning Department will hereinafter be called the BUILDING AND CODE ENFORCEMENT DEPARTMENT performing those duties pertaining to building construction, inspections, enforcement of Town Ordinances and Local Laws plus other related activities and that Mack Dean will carry the title " Code Enforcement Officer" and "Buildings Administrator" in the Department, and be it further RESOLVED, that this change will be effective on September 1, 1986. WHEREAS, the Town Board has created a Department of,Planning and Zoning, and WHEREAS, the new Planning and Zoning Department is in need of a professional to carry out the functions of the Department including providing technical assistance to the Town Board, Planning Board and Zoning Board of Appeals, and WHEREAS, the Town Board recognizes the position requires education and experience in the field of land use planning, NOW, THEREFORE BE IT RESOLVED, that the Civil Service position of "Senior Planner" be established in the Town of Queensbury and that the position's annual compensation be included in the schedule of salaries. WHEREAS, the Town Board has formally created the Civil Service position of "Senior Planner" and WHEREAS, the qualifications for the position includes graduation from a regionally accredited four year college or university with a Bachelor's degree in planning, architecture, urban geography, engineering or a field related to planning plus two year's experience in municipal or community or community planning, and WHEREAS, the Town Board has conducted an extensive search for someone able to meet the set requirements, and WHEREAS, Stuart F. Mesinger more than fulfills the criteria for the position, NOW THEREFORE BE IT RESOLVED, that the Town Board hereby appoints Stuart F. Mesinger of Charlottesville, Virginia to the position of Senior Planner effective September 2, 1986 at an annual salary of $20,000. WHEREAS, a map, plan and report have been prepared by Charles H. Scudder, P.E. in the manner and detail as determined by the Town Board of the Town of Queensbury regarding the creation of the Peggy Ann road Water District, and i F WHEREAS, such map, plan and report have been filed in the Town Clerk's Office in the Town, and WHEREAS, the boundaries of the proposed Peggy Ann Road Water Disrict are described in Schedule "A" hereto annexed, and WHEREAS, the improvements proposed consist of the installation of 8 inch water main along Peggy Ann Road, together with other construction and materials as described in the map, plan and report, and WHEREAS, the maximum amount proposed to be expended for the aforesaid improvements is $101,000.00 and WHEREAS, the proposed method of financing the cost of improvements shall not be through the issuance of bonds, notes, certificates or other evidences of indebtedness of the Town of Queensbury, but rather shall be borne by the developers of adjoining land in accordance with the letter of intent annexed and marked Schedule "B, and WHEREAS, the map, plan and report describing the improvements are on file in the Town Clerk's Office for public inspection; and WHEREAS, the costs aforesaid shall be assessed, levied and collected from the several lots and parcels of land within the boundaries of the district heretofore described in the same manner and at the same time as other Ton charges and further pursuant to an agreement ` made in accordance with Section 277 of the Town Law between the Town of Queensbury and Richard E. McLenithan, Harry R. Baker and Thomas J. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mr. Borgos, Mr. Montesi, Mrs. Monahan, Mrs. Walter Noes: None Absent: None RESOLUTION FOR STATE AID FOR ASSISTANCE IN DEVELOPING A LOCAL LAND USE PROGRAM RESOLUTION NO. 219, Introduced by Mr. Ronald Montesi who moved for its adoption, seconded by Mrs. Betty Monahan: WHEREAS, Chapter 53 of the laws of New York of 1986 authorizes State financial assistance to Adirondack Park towns and villages for the implementation of local land use programs developed pursuant to Article 27 of the Executive Law. WHEREAS, development of a local land use program typically includes the following general elements tailored to a community's needs: community survey,natural resource studies, socio-economic 25' studies, community issues and goals, land use plan and regulatory devices. NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby designates the Senior Planner and the Code Enforcement Officer as the development Administrators and Zonings Officers for the purpose of performing the following sepcific planning tasks: 1)referrals of variances and other actions, 2) review of code requirements with prospective applicants, 3) assistance to planning and zoning boards, and 4) record keeping at a state shre cost of $9,000.00 RESOLVED, that the Town shall enter into negotiations for an agreement with the development administration staff to undertake the administration of a local land use program, and it is further �- RESOLVED, that Frances J. Walter, as Supervisor is authorized and empowered to negotiate such agreement on behalf of the Town, and it is further RESOLVED, that the Town Board shall review and approve any memorandum of agreement or contract which results from the aforesaid negotiations. WHEREAS, The Town Board of the Town of Queensbury wishes to adopt a local law providing for the defense and indemnification of town officers and employees, and WHEREAS, a public hearing duly published in accordance with the law by the Town Clerk was held on August 26, 1986 at the Queensbury Town Office Building , Bay and Haviland Roads, Queensbury New York at 7:30 P.M. to consider approval of Local Law No.8, 1986, Providing for Defense of Town Officers and Employees, NOW THEREFORE BE IT RESOLVED, that Local Law entitled "A Local Law Providing for the Defense and Indemnification of Town Officers and Employees " is hereby approved and said local law becomes effective upon filing with the Secreatary of State of New York. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mr. Borgos, Mr. Montesi, Mrs. Monahan, Mrs. Walter Noes: None Absent: None LOCAL LAW NUMBER 8, 1986 A LOCAL LAW PROVIDING FOR THE DEFENSE AND INDEMNIFICATION OF TOWN OFFICERS AND EMPLOYEES SECTION 1. As used in the Local Law, unless the context otherwise requires: (a) The term "employees" shall mean any person holding a position by election, appointment or employment in the service of the town, but shall not include a volunteer, any person not compensated for his services or an independent contractor. The term "employee" shall include a former employee, his estate or judicially appointed personal representative. (b) The term "town" shall mean the Town of Queensbury 252 SECTION 2. (a) Upon compliance by the employee with the provisions of section 3 of this local law, the Town shall provide for the defense and indemnification of the employee in any civil action or proceeding in any state or federal court arising out of any alleged act or omission which occurred or is alleged in the complaint to have occurred while the employee was acting or in good faith purporting to act within the scope of his public employment or duties. Such defense shall not be provided where such civil action or proceeding is brought by or on behalf of the Town. (b) Subject to the conditions set forth in this local law, the employee shall be represented by the town attorney or an attorney employed or retained by the Town for the defense of the employee. The Town Board shall employ or retain an attorney for the defense of the employee whenever (1) the Town does not have a town attorney (2) the Town Board determines based upon its investigation and review of the facts and circumstances of the case that representation by the Town attorney would be inappropriate or (3) a court of competent jurisdiction determines that a conflict of interest exists and that the employee cannot be represented by the town attorney. Reasonable attorney's fees and litigation expenses shall be paid by the town to such attorney employed or retained, from time to time during the pendency of the civil action or proceeding subject to certification by the Town Supervisor that the employee is entitled to representation under the terms and conditions of this local law. Payment of such fees and expenses shall be made in the same manner as payment of other claims and expenses of the Town. Any dispute with respect to representation of multiple employees by the Town attorney or by an attorney employed or retained for such purposes or with respect to the amount of the fees or expenses shall be resolved by the court. (c) Where the employee delivers process and a request for a defense to the Town Attorney or the Town Superivsor as required by section 3 of this local law, the Town Attorney or the Supervisor, as the case may be, shall take the necessary steps including the retention of an attorney under the terms and conditions provided in paragraph (b) of this section on behalf of the employee to avoid entry of a default judgment, pending resolution of any question relating to the obligation of the Town to provide a defense. SECTION 3. The duties to defend and indemnify provided in this local law shall be contingel upon (a) delivery to the Town Attorney or, if none, to the Town Supervisor of the original or a copy of any summons, complaint, process, notice, demand or pleading within five days after he is served with such document and (b) the full cooeration of the employee in the defense of such action or proceeding and defense of any action or proceeding against the Town based upon the same act or omission, and in the prosecution of any appeal. Such delivery shall be deemed a request by the employee that the Town provide for his defense pursuant to this local law, unless the employee shall state in writing that defense in not requested. SECTION 4. The benefits of this local law will inure only to employees as definded herein and shall not enlarge or diminish the rights of any other party nor shall any provisions of this local law be construed to affect, alter or repeal any provisions of the Workers' Compensation Law, SECTION 5. The benefits of this local law shall be entended to an employee of a negotiating unit for which an agreement has been negotiated pursuant to Civil Service Law, Article 14 only if such agreement expressly so provides. SECTION 6. The provisions of this local law shall not be construed to impair, alter, limit or modify the rights and obligations of any insurer under any policy of insurance SECTION 7. As otherwise specifically provided in this local law, the provisions of this local law shall not be construed in any way to imprair, alter, limit, modify, abrogate or restrict any immunity available to or conferred upon any unit, entity, officer or employee of the Town or any right to defense provided for any governmental officer of employee by, in accordance with, or by reason, any other provision of state or federal statutory or common law. SECTION 8. The provisions of this local law shall apply to all actions and proceedings ---.r specified herein which have been commenced, instituted or brought on or after the effective date of this local law. SECTION 9. (a) The Town shall indemnify and save harmless its employees in the amount of any judgment obtaned against such employees in a state or federal court, or in the amount of any settlement of a claim, provided that the act or omission from which such judgment or claim arose occurred while the employee was acting within the scopoe of his public employment or duties; provided further that in the case of a settlement the duty to indemnify and save G c1eJ harmless shall be conditioned upon the approval of the amount of settlement by the Town Baord. (b) Except as otherwise provided by law, the duty to indemnify and save harmless prescribed by this subidvision shall not arise where the injury or damage resulted from intentional wrongdoing or recklessness on the part of the employee. (c) Nothing in this subdivision shall authorize the Town to indemnify or save harmless an employee with respect to punitive or exemplary damages, fines, or penalties, or money recovered from an employee pursuant to section fifty-one of the general municipal law; provided, however, that the Town shall indemnify and save harmless its employees in the amount of any costs, attorneys' fees, damages, fines or penalties which may be imposed by reason of an adjudication that an employee, acting within the scope of his public employement or duties, has, without willfulness or intent on his part, violated a prior order, judgment, consent decree or stipulation of settlement entered in any court of this state or of the United States. (d) Upon entry of a final judgment against the employee, or upon the settlement of the claim, the employee shall serve a copy of such judgment or settlement, personally or by certified registered mail within thirty days of the date of entry or settlement, upon the Town Supervisor; and if not inconsistent with the provisions of this section, the amount of such judgment or settlement shall be paid by the Town. SECTION 10. This local law shall take effect immediately upon filing in the office of the Secretary of State. SECTION 11. Local law Number 1 of 1981 for the Town of Queensbury shall be repealed as of the effective date of this Local Law. WHEREAS, Thomas Flaherty, Water Supt. for the Town of Queensbury did recommend that we advertise for bids for materials and WHEREAS, Two bids were submitted and received and opened at the specified time and place by the Director of Purchasing/Town Clerk Darleen Dougher, and such bids were then turned over to Mr. Flaherty, Water Supt. for his recommendation, and WHEREAS, Mr. Flaherty by letter has recommended that the bids be awarded to Vellano Brothers Inc. as follows: Fire Hydrants - 86-4 Resilient Wedge Valves - 86-5 Cast/Ductile Iron Fittings - 86-6 Valve Box Extensions - 86-7 Valve Boxes - 86-8 NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby accepts the bids as mentioned above and be it further 254 RESOLVED, that the financing for such materials is included in the 1986 budget. Non-Col attached $46,936.00 Rensselaer, New York Valley Equipment Non-Col attached $49,573.00 using 4000 gal. tank Schenectady, N.Y. $47,706.00 using 2500 gal. tank COUNCILMAN MONTESI- What we found is that we should be talking about all four tanks primarily because in order to replace the two that are leaking, we have to put new cement pads down, so we decided that perhaps before we go to bid with two tanks, we should get a bid on all four tanks. RESOLUTION TO REJECT TANK BIDS RESOLUTION NO. 222,Introduced by Mr. Ronald Montesi who moved for its adoption, seconded by Mr. George Kurosaka. WHEREAS, the Town Board did advertise for bids on fuel tanks for the Town of Queensbury and WHEREAS, two bids were received and reviewed by the Buildings and Grounds Supt., and WHEREAS, it was the consensus of the Town Board that all the tanks should be replaced. NOW THEREFORE BE IT, RESOLVED, that the Town Board hereby rejects the bids as received and that new specifications for four tanks be advertised as soon as possible. SUPERVISOR WALTER-Stated that the Board had untill Friday to get around to inspect the junk yards. Also stated that meetings had been changed: Next Board meeting will be September 10, because of Primary Day on Sept. 9 - on September 15, 1986 at 4:OOP.M. there will be a special meeting to review the new bids on the tank. November 11 meeting is moved up to November 12.
