PUBLIC HEARING-NOTICE SHOWN
SUPERVISOR WALTER-The Public Hearing is relative to establishing the Peggy Ann
Road Water District, the idea of a new water district came forth with the advent of
a new Local Law in the Town of Queensbury, that :subdivisions within 2000 feet of an
existing public water supply needed to be connected to that water supply. The developers
of the Subdivision will be financing the construction of the water district. Asked for
further input, hearing none the Public Hearing was closed:

SUPERVISOR WALTER- Asked for public comments?
MR. DAVID KENNY-Asked the Town Board if they could address the problem regarding
traffic on Route 9. Asked if maybe sidewalks could be installed?
SUPERVISOR WALTER-Noted that several years ago, sidewalks were asked for by the
Town of Queensbury and the County of Warren around the Storytown area because of
the amount of pedestrian traffic we have in that particular area and the State indicated
they would put sidewalks and just recently they have notified the County that they have
run out of f unds.
DAVID KENNY-Noted that it was up to the people to follow it up with letters to the
State.
COU14CILDIAN PIONAHAN-Asked if there was any leverage with the Glens Falls Transportation
Counsel on this subject?
SUPERVISOR WALTER-Probably but they haven't met since March.
COUNCILMAN DIONAPAN-Suggested writing a letter to Mr. Robertson the Chairman
of that group.
MIKE O'CONNOR-Attorney from Glens Falls, representing the Dan and George Drellos
to submit an application for a Mobile Dome Park. Asked the Board to make a reference
to the Planning Board for Site Plan review which is provided for in the new ordinance,
then come back and set a public hearing...presented the Board with maps.
SUPERVISOR WALTER-Asked if the engineering work had been done as far as drainage
is concerned and water.
AIR. O CONNOR-Yes, it is on the maps and environmental impact statements also.
TOWN COUP;SEL-Noted that it gets filed with the Town Clerk.
SUPERVISOR WALTER-Asked for the information be left with the Tdwn Clerk and she
will make her determination and the Town Board will take action next Monday.
MR. O'CONNOR- Asked if it were necessary to issue to each owner a tax map and list
of each adjoining owner?

TOWN COUNSEL-Stated that the list was sufficient.
MR. O'CONNOR-Stated that he would like to reserve submitting a final set of rules
until they go through that with the Planning Board?
SUPERVISOR WALTER-OK.
COUNCILMAN MONAHAN-Asked if the Fire Chief has been notified to look at the road
for accessibility for emergency traffic.
F PERVISOR WALTER-Stated that there was a Special Town Board DZeeting next Monday
d if there is any action such as referral that needs to be taken by Resolution we can
v that at that time, if there is any question we will ask you to appear.
)UNCILDIAN MONAHAN-Asked if'this was a true render or a conceptual type of thing?
MR.O'CONNOR-Conceptual.
GEORGE STARK- Noted that the Town had grown in the last ten years and there is
a lot more commercialism in the town then there was ten years ago. I would like to
have the Sign Ordinance rewritten with some representation not only from the League
of Women Voters but also some Business men in the area and even a couple of Town Board
Members, as it stands now it is a very ambiguous law.
SUPERVISOR WALTER-Stated that the Town Board does not think it is ambiguous and
we are in the process now of enforcing. We have sent out notices of violation to those
businesses that are in violation with thirty days and we will be issuing appearance tickets
for business to appear in front of a judge and it really will be up to the courts to determine
whether the ordinance is ambiguous or not. The Town Board would be not changing the
intent of the Sign Ordinance other then editorial changes.
C:OU14CILDIAIT KUROSAKA-Stated that everybody assumes that this ten year moritorium
is going to abolish all non-conforming signs and that wasn't the intent. Ten years down
the line, we want the Zoning Board to take a look at the signs and also to give the Business
- -in a chance to write it off.
1PERVISOR WALTER-Stated that there was a variance procedure you can ask for and
rioted that he was on the agenda for a variance.
GEORGE STARK-I asked to withdraw.
SUPERVISOR WALTER-You do have a non-conforming sign and I understand that you
do not care to conform and we have very few signs that have variances in this town.
GEORGE STARK-Stated that he had received a letter back in June or July and it did
not spell out where we were in violation of the Sign Ordinance.
SUPERVISOR WALTER-Stated that that was a courtesy letter, not a notice of violation,
it was only to let business people know that the ten year moritorium was just about up.
Business that just come into the Town unless they got some kind of variance have been
conforming with the Ordinance since 1976.
COUNCILMAN MONAIIAN-The Ordinance had been put into effect after a lot of workshops
which the public and business men were welcomed to comment. There was also a Public
Hearing before it was adopted. The Ordinance was passed after a lot of input from the
iblic.
THOMAS IVARNER-Owner of French Mountain Motel - Stated that he had just gone
rough Warren County Planning Board today and stated that he did not think the Planning
.)ard know the Sign Ordinance. Stated that he wanted to conform to the Sign Ordinance
_A he still wanted to keep his location and I am within 15 feet of the road.
SUPERVISOR WALTER-Asked if Mr. Warner were scheduled to go before the Zoning
Board of Appeals. It was indicated that it was not proper for the Town Board to comment,
asked that lie reserve his comments for that Board.
THOMAS WARNER-Stated that the Sign Ordinance is very confusing and the people
who are enforcing the law do not know the law. I still do not know what the size of my
sign has to be.
SUPERVISOR WALTER-Stated that there were copies of the Sign Ordinance available

to the public in the Building and Zoning Office. Asked for further input.hearing none
the Open Forum is closed.

RESOLUTION ESTABLISHING LEAD AGENCY AND ADOPTING DETERMINATION
OF NON-SIGNIFICANCE OF ESTABLISHMENT OF PEGGY ANN ROAD WATER DITRICT
RESOLUTION NO. 227, Introduced by Mr. George Kurosaka, who moved for its adoption,

WHEREAS, Article 8 of the Environmental Conservation Law established the State Environmental
Quality Review Act, and
WHEREAS, such act requires environmental review of certain actions undertaken by
local governments, and
WHEREAS, the Town Board of the Town of Queensbury recognizes the need for the creation
of the Peggy Ann Road Water District to serve the current residents and to meet the
needs of future residents in an area of rapidly increasing growth and development in
the westerly portion of the Town of Queensbury and has conducted a public hearing on
the establishment of an improvement district in that area of the Town, and
WHEREAS, the Town Board of the Town of Queensbury is duly qualified as lead agency
with respect to the creation and establishment of said water district;
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Queensbury is hereby designated lead
agency for purposes of SEQRA compliance in the creation and establishment of the Peggy
Ann Road Water District, and be it
FURTHER RESOLVED, that the Town Board of the Town of Queensbury adopt the annexed
notice of determination of non-significance and that copies of this resolution be forwarded
to the Commissioner of the Department of Environmental Conservation and ,t}ie Region

plus 5 hydrbnts.
4. Reasons Supporting Determination: In response to request for water service from
Lwo developers of approximately 220 lots and in light of current pending proposals before
the Planning Board, the TownToard wishes to'ex'tend municipal water service to the
roposed district to serve future residents and tstrengthen the hydraulic capacity of
-che Town water system. Future development in the area must conform to SEQI?A and
site specific impacts of such projects would be addressed in the future by the Town of
Queensbury Planning Board.

RESOLUTION NO.228, Introduced by Mr. George Kurosaka, who moved for its adoption

WHEREAS, the Town Board of the Town of Queessbury, Warren County, New York has
heretofore duly caused a general map, plan and report to be prepared and filed in the
Office of the Town Clerk of the said Town in relation to the establishment of a proposed
water district in said Town , to be known as the Peggy Ann Road Water District, and
WHEREAS, an order was duly adopted by the said Town Board on August 26, 1986 reciting
a description of the boundaries of said proposed district, the improvements,proposed,
the maximum amount proposed to be expended for said improvements, the proposed method
of financing to be employed, the terms of a letter of intent regarding the construction
and financing of such improvement, the fact that said map and plan were on file in the

Section 1. The establishment of a water district in the Town of Queensbury, Warren County,
New York to be known as the Peggy Ann Road Water District to be bounded and described
as hereinafter set forth, and the installation and construction of 3500 +- feet 8 inch ductile
;eater main and five hydrants in said district at a maximum estimated cost of One Hundred
4 end One Thousand Dollars ($101,000.00) is hereby approved and authorized. The method
f financing the cost of said improvement shall be in accordance with the letter of intent
incorporated into the order setting a public hearing'on said district which provides for
he construction and materials to be financed from private sources and which further
,—provides for future assessments to be payable in the first instance from the several lots
and parcels of land within the water district in the same manner and at the same time
as other town charges and as guaranteed by Thomas J. Farone and Son, Inc., Richard
E. McLenithan and Harry R. Baker pursuant to Section 277 of the Town Law.
Section 2. Said water district extension shall be bounded and described as is set forth
in Schedule "A" annexed hereto and made a part hereof.
Section 3. This resolution is subject to a permissive referendum as provided by Section
209-e of the Town Law.
Section 4. If after the expiration of the time for filing a petition requesting that the
matter be submitted to a referendum of eligible votes within the proposed extended
district, no such petition is timely filed with the Town Clerk, she shall file a certificate
stating such fact in the Office of The Warren County Clerk.

All that certain parcel of land situated in the Town of Queensbury, Warren County, New
York, being portions of Lots 63 and 70 in the First Division of the Queensbury Patent,
in said town, and which parcel is bounded and described as follows:
BEGINNING at a point in the northerly line of Peggy Ann Road where said northerly
line is intersected by the division line between Lot 63 in the First Division of the Queensbury
Patent on the west and Lot 56 of said patent on the east; running thence in a southerly
direction, along said division line and along the westerly line of the Queensbury Water
District, and along the westerly line of the Sherman Avenue Water District, for a distance
of approximately 1150 feet to the common corner of Lots 63, 56, 55 and 62 of said Queensbury
Patent; thence in a westerly direction, along the southerly line of Lot 63 and along the
northerly line of the Sherman Avenue Water District, and along the northerly line of

have to wait 30 days to see if a petition is presented for referendum.
RESOLUTION ESTABLISHING DOUBLE LINE TRAFFIC CONTROL DEVICE ON DIXON
ROAD
RESOLUTION NO.230, Introduced by Mrs. Betty Monahan who moved for its adoption,
seconded by Mr. Stephen Borgos.
WHEREAS, the Town Board of the Town of Queensbury has the authority to designate
the use of painted double lines as a traffic control device upon town roads, and
WHEREAS, the Town Board has been requested to designate Dixon Road from its intersection
with Aviation Road to the intersection with Old Forge Road for the use of a painted
double line, and
WHEREAS, the Town Board finds that it is in the best interest for the safety of the town
residents to utilize double painted lines as described above,
NOW, THEREFORE BE IT
RESOLVED, that Dixon Road from the intersection of Aviation Road to the intersection
with Old Forge Road is hereby designated for the use of a double painted line and be
it
FURTHER RESOLVED, that the Town Highway Superintendent be contacted and advised
of this designation and requested to arrange for the installation of the lines as soon as
practicable.

SUPERVISOR WALTER-Asked Air. Naylor if the designation of a double line for the entire
distance is sensible
PAUL NAYLOR- Highway Superintendent-Yes
GEORGE KUROSAKA-Noted that it was a fully populated residential area and the lines
on the road were essential and there should be no passing on that road.
COUNCILMAN MONTESI-Asked if this lining of the road could be done this fall?
PAUL NAYLOR-Highway Superintendent that the County's machine broke down and
they contracted with an out of state firm to do the job, the firm promised they would
be back
COUNCILMAN BORGOS-Stated that the white edges on the right side is most helpful
but the dotted lines seem to encourage passing.
RESOLUTION TO SET PUBLIC HEARING ON AMENDMENT TO FIRE CONTRACTS
RESOLUTION NO.231, Introduced by Mr. Stephen Borgos who moved for its adoption

WHEREAS, there has been duly established in the Town of Queensbury a Fire Protection
District embracing all of the territory of said Town of Queensbury and the Town Board

has provided for fire protection therein by contracts with five (5) volunteer fire companies,
and
WHEREAS, the Town Board deems it in the public interest of the residents of said town
to amend such contracts to provide for emergency snow removal service as additional
consideration, and
WHEREAS, Section 184 of the Town Law requires a public hearing upon the contract
provisions for such fire protection service,

_. IESOLVED, that a public hearing on said proposed contract terms will be held by the
Town Board of said town at the Town Office Building, Bay and Haviland Roads in said

DUSCUSSION-held before Resolution voted upon
COUNCILMAN BORGOS-Stated that the Fire Contracts were going to be amended to
permit the Town Highway Dept. to get involved with some snow removal as they go by
the fire houses, and rescue buildings during a snow storm. As they go by push the snow
and ice out of the way of the main doors and parking spaces up to six cars. Stated that
in the Spring because of a heavy snow fall it took almost 40 minutes to get the Fire Chief's
r car out of the snow as he was attempting to get into the fire house. Noted also that
these were volunteers and they do not stay at the building, they first have to get to the
building.
Ltrs.- Thomas Flaherty and Mr. Ralph VanDusen-requesting permission to attend the
AWWA Fall Meeting on file.
DISCUSSION HELD-The reason why deputies were hired was to be on hand when the
Superintendent of Highway and Water were not available and last year there was a situation
where permission was asked for both the Superintendent and the Deputy to be out of
Town and the former Town Board determined it would be their policy that one or the
other would be in Town. Asked the Board to take this in consideration before voting
on the Resolution.

RALPH VANDUSEN-Noted that the Maintenance Supervisor would be in Town and it
s; is only a three hour drive and if anything really important came up he or the Superintendent
could be back in Town within that time.

Fall Meeting on September 23rd through the 26 at Kerhonkson, New York, and be it further

DISCUSSION
Councilman Montesi-Gave a verbal report to the Town Board on the street light needs
on Aviation Road...describing the lighting districts as then now, exist...it was agreed
to by the entire Town Board to put more street lights in the existing district soon as
feasible.
SUPERVISOR WALTER-Requested Town Counsel to research the new lighting district
and get back to them, noted that it was the plan of the Board to put additional lighting
pending the outcome of the Attorneys research.
RESOLUTION TO INSTALL STREET LIGHTS
RESOLUTION NO.234, Introduced by Mr. Ronald Montesi who moved for its adoption,
seconded by Air. Stephen Borgos:
RESOLVED, high pressure Sodium Lamps be installed on Aviation Road on the following
poles:

RESOLVED, that a High Pressure Sodium Lamp be placed on Northup Drive on pole number
6-1 and be it further
RESOLVED, that a certified copy of this resolution be sent to Niagara Plohawk Corporation.

COUNCILMAN MONAHAN-Noted the great job done by Chris Bergeron on the Summer
Playground Program. She did a thorough report on how they upgraded them this year
on the strengths and weaknesses and how to improve them. Noted they still need a map
of Queensbury to do further work in South nueensbury...gave report of new pool and
how well it has been used over the summer. Stated that the Recreation Comm. has received
the permit from EnCon to go forth with the work on the Hovey Pond Park and they would
like the Town to take another look at these recommendations and inform them as to

e4000 how we would like them to continue on Hovey Pond Park.
