SUPERVISOR STROUGH-Okay, so you are the future owner?
MR. STEINBACH-We are the owners of the property.
SUPERVISOR STROUGH- Okay and you bought the property from Joseph Riitano.
MR. STEINBACH-Yes.
SUPERVISOR STROUGH-Okay, is there any other details that you would like to give regarding
this matter?
MR. STEINBACH- No, no I do not think so unless there is any questions that the committee
has.
SUPERVISOR STROUGH- Alright, questions to the applicant from members of the Town
Board? Alright, there’s no questions. I will open up the public hearing on this matter. Is there
any member of the public that wishes to speak to this application tonight? Seeing none, I will
close the public hearing.

COUNCILMAN METIVIER-Do we have to update the resolution to reflect that he is now the
owner or does that really not matter at this point?
SUPERVISOR STROUGH-Well they are both applying for it, so it does not really make any
difference. The previous owner and the new owner are applying for the application so I do not
think that make a difference.
ROBERT HAFNER-It needs to be put in the public record that he has now closed and he is the
current owner.
MR. STEINBACH-Right, we submitted the application prior to the closing of the property.

(sale pending) filed an application for variances from provisions of the Town of Queensbury On-Site
Sewage Disposal Ordinance, Chapter 136 to install a new well on property located at 16 Sunset Lane
in the Town of Queensbury with the proposed setbacks to be as follows:
1. Well to be 88’ from the leach field instead of the required 100’ setback;
2. Well to be 88’ from lot no.: 226.19-1-13’s leach field instead of the required 100’
setback; and
3. Well to be 99’from lot no.: 226.19-1-10’s leach field instead of the required 100’

WHEREAS, the Town Clerk’s Office published the Notice of Public Hearing in the Town’s
official newspaper and the Local Board of Health duly conducted a public hearing concerning the

1. due to the nature of the variances, the Local Board of Health determines that the
variances would not be materially detrimental to the purposes and objectives of this
Ordinance or other adjoining properties nor otherwise conflict with the purpose and
objectives of any Town plan or policy; and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
Applicants; and
BE IT FURTHER,
RESOLVED, that the Local Board of Health hereby approves the application of Joseph
Riitano, current property owner and Frank Steinbach, property purchaser, for variances from the

1.2 PUBLIC HEARING- Sewage Disposal Variance Application of John and Margaret
Markert

DENISE MACELROY-Yes, thank you John. Dennis MacElroy from Enviromental Design
representing the Markert’s on this Board of Health Variance request. As you recall I was here a
month ago with a proposal for an in ground system an onsite system. You weren’t quite
comfortable with that proposal so we’ve come back with a holding tank proposal for service of
that residence. As indicated, there’s setback issues, setback requests for the location to the tank.
But it is a standard holding tank system, as you required by the Town meeting the capacity
requirements and the alarm system that is typically incorporated into the holding tank system.
I did have the discussion with the owners based on our, your meeting two weeks ago I guess it
was where another project with maybe some similarities were approved. They felt that they were
happy with, they were satisfied with going forward with a holding tank system, they didn’t
necessarily at this time want to change things again, they’re ok with the holding tank system. I
think they want to reserve their right, obviously in the future if they wanted to pursue an onsite
system.
SUPERVISOR STROUGH-Well of course.
MR. MACELROY-To do something different, they will have that right to come back.

SUPERVISOR STROUGH-Yes, they do.
MR. MACELROY-At this point they will stay with the holding tank proposal that I believe you
were comfortable with in our previous discussion.
SUPERVISOR STROUGH-Yes, I think it is probably the best thing for this site given the
constraints on this site and the preexisting building and the lack of parking, it’s just, it works
very well. Before I open the public hearing, any questions from the Town Board?
COUNCILMAN FREER-I have asked this question before, I’m not sure if it was to you Dennis
but this holding tank issue has been bubbling, pardon the pun. Is there an expected life for, that
we can establish for holding tanks like this?
MR. MACELROY-Yes, we did discuss that previously. It is a concrete tank so that, that lifetime
I’ve heard manufacturer
s give a conservative estimate of thirty year life for a concrete tank.
COUNCILMAN FREER-Ok.
MR. MACELROY-Certainly there are concrete tanks in the ground that are older than that.
COUNCILMAN FREER-Yes, so that’s kind of my, so the thirty years. Is sixty years ok? Or
had, then the question, the follow on question to that is, how do we test to make sure it is still
functioning at sixty years?
MR. MACELROY-Well I think particularly a holding tank which by the nature of its function
gets regularly maintained.
COUNCILMAN FREER-It gets pumped but nobody checks, what’s the, is there a procedure for
checking for leaks?
MR. MACELROY-Not anything that’s established.
SUPERVISOR STROUGH-If you got a leak you don’t need to pump it.
MR. MACELROY-Right.
SUPERVISOR STROUGH-There’s an indicator.
COUNCILMAN FREER-Well that’s not good enough for me. We have to establish some kind
of failure mode because we’re going to inspect on transfer of property there has to be a better
than that explanation of whether the holding tank is still functioning properly.
SUPERVISOR STROUGH-Well, when they pump them out they do get inspected, they’re
pumped dry. If there is any breaks or cracks they would appear at that time. I mean you
visually, you would be able to see it.
COUNCILMAN METIVIER-What causes a tank to go bad? I mean, my gosh there’s metal
tanks in the ground that are older than sixty years that are still working so why would a concrete?
MR. MACELROY-Well, a metal tank in the ground, I think you will find that the metal would
be circular tanks that generally it becomes eventually a soil wall.
COUNCILMAN METIVIER-Understood.
MR. MACELROY-The metal rusts away.
COUNCILMAN METIVIER-Well my point is, what makes a concrete.
MR. MACELROY-A concrete tank, well first of all, I would say a concrete septic tank made by
any reputable pre-caster nowadays is superior than the tanks made in the sixties, in the seventies,

tanks that are reaching some lifetime so we’ve got better products. There could be, this would
go maybe more to an extreme but at the time of installation, there could be a requirement for a
water test, a leakage test where you filled the tank and monitored it over twenty-four hour period
and see if there’s any drop, any significant drop in the tank. That would be upon installation.
COUNCILMAN FREER-Or upon pump out or inspection.
COUNCILMAN METIVIER-Well you are not going to pump it out and fill it up.
COUNCILMAN FREER-No, before you pump. So ok, well this is an issue, I wrote an email to
the group and I think is something as we move forward with inspections, we need to think about
how we inspect the integrity of all of the onsite wastewater treatments including holding tanks
and we don’t have a good answer about that right now. Because sixty years is not that long. I
mean you know so that’s sixty years will be something that was put in the sixties, right? And
there are plenty of onsite and potentially holding tanks that were put in the fifties and the sixties
and so they are twice their expected life course. Nobody will give me a straight answer of what
the expected life is but twice your expected life in my non-engineering mentality says warning,
Will Rogers, that we have to figure that out.
SUPERVISOR STROUGH-Ok, any other comments from the Town Board?
COUNCILMAN FERONE-John, in the last close to four years now I’ve seen a number of these
holding tank projects go through. To ducktail onto what Harrison was saying, we should
probably start keeping some type of record as to when these things are going in the ground. So I
don’t think there’s an issue before you hit maybe that thirty year mark where you say ok so and
so had their tank in the ground thirty years and then if we come up with some type of program
that said these tanks need to be tested, we implemented at that time, I don’t think we should
require someone who put in a tank five years ago or ten years ago to have to go through that.
COUNCILMAN FREER-I am happy to waive the lifetime, I’m happy to waive lifetime plus
fifty percent, I am not happy to waive forever. I think the twenty-four hour inspection is, I was
told a week to make sure nothing’s leaking out of it. But that’s not at a full, you know, that’s not
the house being used.
MR. MACELROY-I think the same thing applies though, that the holding tank is no different
than a septic tank. There are septic tanks that are in that same situation and that’s not required.
COUNCILMAN FREER-It’s not required for a holding tank either, I’m just suggesting that
there’s got to be some end of life.
MR. MACELROY-I’m not promoting this but if you are suggesting it for a holding tank
condition than the same concern should apply to the septic tank.
COUNCILMAN FREER-Ok.
SUPERVISOR STROUGH-Ok, and I’m very happy with holding tanks because given the
density on the Lake George peninsula’s especially but elsewhere as well, you have these small
lots, some a tenth of an acre, some even smaller, they’re preexisting and you know that putting a
traditional system in there certainly has a risk. I would say a high risk of having a plume that
reaches the Lake and brings the according pollutants. With a holding tank you know that’s
functioning Harrison, you know that where it is and then it goes to Lake George or Glens Falls’s
waste treatment center and not into Lake George for example. In any event, if there’s no further
questions, I will open the Public Hearing. Anybody from the public wishes to speak to John and
Margaret Markert for 390 Cleverdale Road, three variances being requested, installing holding
tanks? Any member of the public wish to speak to that? Seeing none, I will close the public
hearing.

WHEREAS, by Resolution No.: 368, 2020, the Queensbury Town Board enacted Local Law
No.: 10 of 2020 which, in part, provides that the Town Board may make changes to sewer rents by
Resolution upon five (5) days’ Public Notice, and
WHEREAS, the Town of Queensbury previously established sewer rent rates for the Greater
Queensbury Consolidated Sanitary Sewer District (GQCSSD), and
WHEREAS, the Town Wastewater Director recommended that the Town Board amend the
GQCSSD sewer rents such that all residential properties with the Property Code Classifications
between 210 – 283 and Class 411 will be charged $5.50/1,000 gallons per quarter and all other
Property Code Classifications will be considered non-residential and will be charged $7.00/1,000
gallons per quarter, commencing with usage as of January 1, 2022, to be read in April 2022, and
appearing accordingly on the May, 2022 billings, and

WHEREAS, the Town Board duly held a public hearing on Monday, November 15, 2021
concerning this proposed sewer rent rate increase and heard all interested persons,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the amendment
to the Greater Queensbury Consolidated Sanitary Sewer District sewer rent rates such that all
residential properties with the Property Code Classifications between 210 – 283 and Class 411 will

SUPERVISOR STROUGH-Reviewed proposed local law. Before I open up the Public Hearing are
there any members of Town Board that wish to speak to this before I open this up to the Public?
COUNCILMAN MCNULTY-Yeah, John if Chris is there is this one hundred and twenty five dollars
going to cover our labor costs or is it just getting us closer?
CHRIS HARRINGTON-Yes, so Tim I believe this will cover our labor costs. When I look at it, our
maintenance supervisor who gets paid like twenty-six dollars an hour, fifty percent on you know his
benefits, vehicle time and then there’s some staff time so I think a hundred and twenty-five dollars
covers it. Most of these are pretty routine. We do this to make sure we have a record of course for
the private side. Also, we want to make sure we show the City’s, Glens Falls that we are checking
the private side. I do believe the hundred and twenty-five dollars should be good for a few years.
Actually, I have had people say it was a ten dollar fee, I didn’t think it was such an important thing.
We’ve had some issues over the summer where the ten dollars just doesn’t give you any gravity so I
think the hundred and twenty-five dollars, when somebody comes in they will pay a little more
attention to what they should do and hopefully less problems to cover our costs.

Local Law with the New York Secretary of State in accordance with the provisions of the Municipal
Home Rule Law and acknowledges that the Local Law will take effect immediately upon filing by
the Secretary of State, and

RESOLVED, that the Town Board establishes that the sewer permit and inspection fees per
136-53(B) of the Town Code shall be $125.00, and

LOCAL LAW AMENDING QUEENSBURY TOWN CODE
RELATING TO SEWER PERMIT FEES
Be it enacted by the Queensbury Town Board as follows:

Section 1: The name of this Local Law is: A Local Law to Amend Chapter 136-53(B) of
the Code of the Town of Queensbury Relating to Sewer Permit Fees.
Section 2: Chapter 136-53(B) of the Code of the Town of Queensbury is repealed in its
entirety and replaced with the following language:
“A permit and inspection fee for a residential/commercial use will be required, except for
initial hookups of existing structures within the time schedule allowed in 136-44, measured from
the completion date of the construction contract of the public sewer servicing the structure. Such
fee shall be detailed, from time to time, by Town Board Resolution and included in the Town’s
Wastewater Department fee schedule. The cost of an industrial permit shall be negotiated with the
Town of Queensbury at the time of application. This will depend on the volume of sewage, number
and size of connections and quality of discharge.”
Section 3: The invalidity of any clause, sentence, paragraph or provision of this Local Law
shall not invalidate any other clause, sentence, paragraph or part thereof.
Section 4. All Local Laws or Ordinances or parts of Local Laws or Ordinances in conflict
with any part of this Local Law are hereby repealed.
Section 5. This Local Law shall take effect upon filing in the office of the New York State
Secretary of State or as otherwise provided by law.

APPROVING THE USE OF LOT NO. 302.8-1-2, 275 BAY ROAD (AKA MULLEN
SITE) FOR THE PURPOSE PROVIDING A WARREN COUNTY BIKEWAY
AMENITY, A PEDESTRIAN/BICYCLE PARKING/PARK FACILITY
WHEREAS, Warren County is the current owner of lot number 302.8-1-2, 275 Bay Road,
Queensbury, New York, and
WHEREAS, Warren County has expended taxpayer monies to remove the parcels preexisting
building that posed multiple public hazards, asbestos presence among others, and
WHEREAS, Warren County is also the owner of the Warren County Bikeway, a paved 9.4
mile multi-use trail for bicycling, walking and running, and
WHEREAS, the Warren County Bikeway runs alongside and directly adjacent to this parcel’s
southwest property line, and
WHEREAS, this currently vacant lot provides a unique opportunity to provide a facility that
would better accommodate the users of the adjacent Bikeway, and
WHEREAS, this facility would benefit local residents and visitors for many generations to

come, and
WHEREAS, this approximately one-acre lot has a contamination history, is triangular
configuration, has the Town of Queensbury’s 30 foot setback requirements and Commercial Light
Industrial zoning; all of which could have potential negative impacts on this parcel’s value, and
WHEREAS, this site is uniquely located and would make for an excellent hub site; a
pedestrian/bicycle site that would provide parking (and possibly other amenities, like a butterfly
park) for residents and visitors who seek to use our trails and routes – access to Warren County
Bikeway, Coles Woods Trail, Feeder Canal Trail, Champlain Canal Trail, Halfway Brook Trail,
Rush Pond Trail and all their potential offshoots, and
WHEREAS, as a pedestrian/bicycle facility, this site could offer our residents and visitors
(who bring in tourism revenues) a parking area, park, interpretive signage, a bicycle repair station
and more, and this kind of infrastructure makes for a potential candidate for outside grant funding,
and be it
RESOLVED, that Warren County will maintain ownership of this lot with the intent of using it as a Warren
County Bikeway amenity, parking and park facility to be enjoyed by residents and visitors, bicyclists and
walkers, and be it further
RESOLVED, that the Warren County Planning and Community Development Department will work with
the Town of Queensbury and City of Glens Falls and the A/GFTC in researching potential design
developments and grant opportunities for this proposed Warren County Bikeway facility.
RESOLUTION AUTHORIZING ENGAGEMENT OF
DELAWARE ENGINEERING, D.P.C. FOR PROFESSIONAL
ENGINEERING SERVICES RELATED TO GLENWOOD AND HAVILAND
AVENUES WATER MAIN REPLACEMENT PROJECT

WHEREAS, the Queensbury Town Board duly established the Town of Queensbury
Consolidated Water District (the "District") in accordance with New York Town Law, and
WHEREAS, the Town Board wishes to improve the District’s water transmission facilities
by replacing approximately 2500 feet of 8" unlined cast iron water main on Glenwood Avenue
between Quaker and Bay Roads and approximately 900 feet of failing 6" ductile iron pipe on
Haviland Avenue between Richardson Street and Edgewater Road (Project), in accordance with
Town Law §202-b, and
WHEREAS, the Town’s Water Superintendent requested proposals for professional Design,
Bidding and Construction Phase Engineering Services (Services) related to the Project, and
WHEREAS, the Water Superintendent and Purchasing Agent have received and reviewed
two (2) proposals, with the lowest, most responsible submitted proposal submitted by Delaware
Engineering, P.C. (Delaware) and therefore the Water Superintendent and Purchasing Agent have

recommended that the Town Board authorize engagement of Delaware for such Services in the
amount of $176,110 as delineated in Delaware’s October 21, 2021 Proposal presented at this
meeting, and
WHEREAS, the Water Superintendent has advised that there are times when Change
Orders may become necessary related to such Services and has requested that the Town Board also
authorize him to approve and sign certain Change Orders up to a ten-percent (10%) contingency
for Change Orders that he deems necessary or appropriate, and
WHEREAS, by Resolution No.: 261, 2021, the Town Board accepted a total of
$2,794,633.02 in American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Grant
Funds from the New York State Department of Budget, such Recovery Funds to be used in
accordance with the terms and conditions to be set forth by the New York State Department of
Budget and/or the Federal Government, and established the ARPA Coronavirus Local Fiscal
Recovery Capital Project No. 241 and the Town Board wishes to use these Recovery Funds for
this qualifying infrastructure investment Project,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of
Delaware Engineering, D.P.C. (Delaware) for professional Design, Bidding and Construction
Phase Engineering Services (Services) related to the Glenwood and Haviland Avenues Water Main
Replacement Project (Project) for the amount of $176,110 as delineated in Delaware’s October 21,
2021 Proposal in substantially the form presented at this meeting, and

approve and sign Change Orders pertaining to such Services up to a ten-percent (10%) contingency

Project up to a total amount of $193,721 shall be paid from the ARPA Coronavirus Local Fiscal

Purchasing Agent provided specifications to the New York State Office of General Services
Procurement Program for the purchase of a 2021 or 2022 Plug-In Hybrid or Fully-Electric All-Wheel
Drive Sport Utility Vehicle (Vehicle) as a replacement vehicle for the Department of Building and
Code’s 2012 Ford Escape (Town Asset #8962), as described in specifications prepared by the
Director of Building and Code’s (Director) and/or Purchasing Agent, and
WHEREAS, the Purchasing Agent received one bid for the Vehicle from the New York
State Pro Vehicle Market Place in the amount of $37,484, and
WHEREAS, the New York State Legislature adopted legislation allowing any political
subdivision in New York State to “piggyback” off an existing County/State Bid, and
WHEREAS, the Director has advised that National Auto Fleet Group, a participating
member of the cooperative, municipal purchasing program Sourcewell Contracting, is providing a
Sourcewell Contract #: 120716-NAF price for the Vehicle in the amount of $28,783.98 as set forth
in National Auto Fleet Group’s 11/2/2021 Quote ID: 18953 R1 and therefore in this instance, the
Town of Queensbury wishes to “piggyback” with Sourcewell Contracting, and
WHEREAS, the Director has requested authorization to purchase undercoating for the
Vehicle for an additional amount not to exceed $399, and
WHEREAS, the Town will adhere to all New York State Law bidding requirements,

RESOLVED, that the Queensbury Town Board hereby accepts and awards the bid for the
purchase of a 2022 Ford Escape (U9B) SE Hybrid AWD for use by the Department of Building
and Codes from the lowest, responsible bidder, National Auto Fleet Group, for an amount not to
exceed $28,783.98 in accordance with National Auto Fleet Group’s 11/2/2021 Quote ID: 18953 R1

Conservation (DEC) so that DEC may undertake its Site Characterization – Remedial
Investigation/Feasibility Study authorized by Town Board Resolution No.: 198, 2021, and
WHEREAS, DEC has advised that its Site Characterization activities will include the
following:
Sampling of surface water and sediment of Mud Pond;
Sampling of surface soil down gradient of the Landfill and north of Mud Pond;
Gauging of depth to water and depth to bottom of all existing Landfill monitoring wells;
Sampling of select existing Landfill monitoring wells;
Sampling of leachate, seeps, and/or surface water runoff from the Landfill (where found);
Sampling of select non-potable wells;
Survey all Landfill monitoring wells to tie everything to one common datum; and
WHEREAS, DEC anticipates that these activities will require light foot traffic through the
property, but it does not expect to materially alter the property in any way, and
WHEREAS, the Town of Queensbury wishes to gain access to certain information from DEC
relating to the site and DEC wishes for such information to remain confidential, and
WHEREAS, the Town Queensbury also wishes to collect construction details of certain
residential wells in the vicinity of the Site by way of a voluntary well survey to be sent to and
completed by certain property owners,

Chazen Companies for Mechanical (HVAC), Electrical and Plumbing (MEP) engineering and
construction phase services and Chazen accordingly prepared bid documents and specifications, and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder meeting New York State statutory requirements and
the requirements set forth in the Town’s bid documents and specifications, and
WHEREAS, the Town Purchasing Agent advertised for bids for the Storage Building’s
Electrical, Mechanical (HVAC) and Plumbing Contracts in the official newspaper for the Town of
Queensbury and following such advertisement and receipt of bids, the bids were duly opened and

reviewed on November 5, 2021, and
WHEREAS, the Purchasing Agent and Chazen have reviewed the bids for the Electrical
and Plumbing Contracts and have recommended that the Town Board award the bids to the lowest,
responsible bidders meeting all bid requirements in each category as follows:
Electrical - Harold Clune, Inc. - $ 55,900.
Plumbing - R. F. Gordon Mechanical, LLC - $ 53,207
and
WHEREAS, only one (1) bid was received bid for the Mechanical (HVAC) Contract and
therefore, the Purchasing Agent and Chazen have recommended that the Town Board reject the
bid as only one such bid was received and by re-advertising for bids in the future, it is hoped that
the Town will receive additional, favorable bids, and
WHEREAS, the Town Board accordingly wishes to reject the one bid received for the
Mechanical (HVAC) Contract and re-advertise for bids in the future, and
WHEREAS, the Town Board concurs with these bid recommendations, and
WHEREAS, the Town Board wishes to authorize a withdrawal and expenditure in the amount
of $109,107 from Capital Reserve No. 64 toward this Capital Project, and

Received call from a constituent today regarding Glen Lake Benefit District and the
reduction by twenty dollars, feels it is a bad idea. The constituent recommended instead
investing in measurement equipment to keep track of temperatures and better data. The
constituent stated that there has been HAV’s, he had pictures. I believe Sunnyside had also
HAV’s so it’s not just Lake George.
Referred to the septic issues and recommended that the Town Board really think going

Referred to the Glen Lake Aquatic Plan Control District and noted that the Town Board is
the decision authority based on the advice of the Advisory Committee. The Advisory
Committee is appointed by the Town Board and separate from the Glen Lake Protective
Association.

Noted that the Glen Lake Protective Association is an advisory group. These are
landowners along Glen Lake who are part of this Advisory Committee. The Town Board
approved of an Advisory Board separate from the Advisory Committee and we vote on

Recognized and thanked Bill and Beverly Osborne for the 10 Annual Baskets for Ben,
held Friday. They work very hard to do positive things for the community on behalf of
Ben and I am sure Ben is overlooking this, is very proud of his parents and his community
that supports the whole cause. Thank you Bill and Beverly Osborne.
Recognized Deanna Park, Director of the Warren Hamilton Counties Office of the Aging,
NY Connects Program and the Home Delivered Meals Program. She needs volunteer
drivers for the Glens Falls, Queensbury area. If you are interested you can call the main

Announced that the town’s bikeway trails usage is growing. Steve Lovering, Director of
our Parks and Recreation Department is using portable trail counters and have some
estimated counts to share. Gurney Lane-25,000; Gurney Lane South-Rush Pond area-
10,000; Rush Pond Trail- 30,000; Hudson Pointe Preserve Trail- 14,000; Half-way Brook
Trail- 18,000. We are seeing bicyclers more and more so if you want to prepare our
communities for the future then I think you want to make the best use of the Mullen site.

Announced the J. Walter Juckett Community Service Award given to Mark Behan recently
at the Adirondack Regional Chamber of Commerce 2021 Annual Dinner. Mark Behan is
so well deserved and he gave a wonderful speech. Would like to thank all those who helped
organize the ARCC annual dinner which was held up at the Sagamore Resort.
