SUPERVISOR WALTER-We have some old business regarding an amendment to the Zoning
Ordinance, Planned Unit Development (PUD)...There has been a Public Hearing on this and
the Board has looked at some minor changes clarifying some of the sections...
TOWN COUNSEL-Added language to PUD...Page one, item C, historical sites; Page three,
four changes...15.040 a, the open space area in a PUD if it exceed 25% instead of 15%; 15.050
b, to require 25% also; item C, strike out the words "not for profit", item 15.063 add "maintained
by a homeowners association; item 15.073, No.5 regarding storm water management, add words
"schematic setting forth" Page eight, 15.081 and survey prepared by a licensed land surveyor
Page 10, item 13, add "Protection of historical sites and /or buildings".
STUART MESINGER-These are a big improvement, the thing I was concerned about was the
density problems. Noted that the Town Board has flexibility regarding storm management
plan and the developer is getting a lot of flexibility as far as density is concerned.
The storm management could be resolved with Local Ordinance.
COUNCILMAN KUROSAKA-Noted that too much information was being asked for...the wording
should be schematic not details...
STUART MESINGER-Agreed.
SUPERVISOR WALTER-Asked the Town Board if they agreed with changes and did they want
to set a Public Hearing regarding the new changes.
RESOLUTION TO SET PUBLIC HEARING ON PROPOSED AMENDMENT TO THE QUEENSBURY
ZONING ORDINANCE, ARTICLE 15, PLANNED UNIT DEVELOPMENT (PUD)
RESOLUTION NO.322, Introduced by Mr. Ronald Montesi who moved for its adoption, seconded
by Mr. George Kurosaka.
WHEREAS the language has been changed by the Town Counsel regarding ARTICLE 15 OF
THE ZONING ORDINANCE, and
WHEREAS, the Town Board has received from the Town Counsel in writing the proposed change
in the language in Article 15 of the Planned Unit Development Provisions (PUD) and wishes
to hold a Public Hearing on such changes.
NOW, THEREFORE, BE IT ,
RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the Town Board
shall conduct a public hearing on January 13, 1987 at 7:30 P. M. at the Queensbury Town Office
Building, Bay at Haviland Roads, Queensbury, New York to consider an amendment to Article
15 of the Queensbury Zoning Ordinance and that the Town Clerk is hereby authorized and directed
to give proper notice of said public hearing.

�— TOM BARROWMAN-Cormus Road, asked to have Mr. Naylor present?
SUPERVISOR WALTER-Mr. Naylor is not required to be present at the public meetings.
COUNCILMAN BORGOS-Asked if Mr. Barrowman was going to present any information Mr.
Naylor did not know about?
MR. BARROWMAN-No...He is aware of the situation on top of the mountain. We are coming
to you with a few examples of the road condition that were present over the last storm, one
being that a vehicle went off the Luzerne Road down into the brook crossing Tuthill Road
and that there is another set of tracks where a vehicle ran into a snow bank, both in the exact
same place where it had been said there would be accidents. Christmas Eve the roads were
so bad one family could not get home until past midnight. Mr. Naylor is not following the
schedule he said he would follow, plows Sherman Avenue Extension when he has time and
because of this there is a lot of ice on the road. They have put up only two detour sign on
Twin Mountain Drive, detouring vehicles across Twin Mountain Drive and you have to make
a right turn and going back from West Mountain Road there are no signs at all. On the top
of the mountain the signs and barricades are now plowed under so that the blinking lights are
blinking into the snow bank and no one can see them. Mr. Naylor did say he would remove
a stop sign up there on the mountain so people could get up the mountain and this has not been
done. Mr. Naylor was asked if he checked with the families who live up there and he said yes,
he only checked with the two and both have plows. We met with two Board Members and three
representatives where we discussed opening the road legally and it was presented at the last
Board Meeting and before that meeting took place, Mr. Naylor called Mr. Rogge and said there
was no way he was going to open the road. Asked that the Board act upon these facts and
if the road is going to be closed next year, there should be an adjustment on our assessments...we
have had a decrease in our town services and this is going to decrease the value of our land.
There is one family who have stopped advertising their house because the road is closed. We
would like to have you review the false information supplied and carried out by Mr. Naylor
and direct Mr. Naylor to correct the problems, he created.
He did say this would be a trial and now we are reporting the proper situation and if the road
stays closed please make the necessary adjustment in our taxes.
SUPERVISOR WALTER-Asked Mr. Barrowman if he would like to have Mr. Naylor at the next
meeting on January 5, 1987.
MR. BARROWMAN-Yes, we would like to meet with him.
BILL COOK-Luzerne Mountain Road, expressed his frustration in coming to the Town Board
Meetings and voiced all the things as short comings with this road closing and it has made
no difference. What are our choices now, what kind of actions can we take, we could sue or
we could picket the town. We would like your help to make our concerns realized.
SUPERVISOR WALTER-We have been told that Highway Superintendent has the authority
to close roads by the law of the State of New York and as an elected Superintendent of the
Highway, you are his boss not the Town Board.
COUNCILMAN KUROSAKA-Asked if the sign could be covered as it is not serving a useful
purpose right now?

COUNCILMAN BORGOS-Said he was very concerned about the road conditions, ice and snow
building up, lights aren't visible, and the barricades aren't visible.
SUPERVISOR WALTER-We will check with Paul and with Counsel regarding the liability and
the legality and I will call Mr. Barrowman.
JANICE HENKE-Cormus Road, since this road has been closed we expected improvement on
road service but roads are icy and if there is sliding on the portion of the road closed off, there
is going to be some liability problem. There is a continuing maintenance problem because
of the road closing.

COUNCILMAN MONAHAN-Asked if there were power lines running in the area that is blocked
off?
JANICE HENKE-Yes. The people on Tuthill are not only concerned about the increased traffic
on Tuthill but the speed they are going and with the snow build up, is a health and safety problem.

RESOLUTION AUTHORIZING SUPERVISOR TO EXECUTE AGREEMENT WITH THE QUEENSBURY
ECONOMIC DEVELOPMENT CORPORATION
RESOLUTION NO. 325, Introduced by Mrs. Betty Monahan who moved for its adoption, seconded
by Mr. George Kurosaka.
WHEREAS, the Town of Queensbury recognizes the need to relieve and reduce unemployment,
promote and provide for additional and maximum employment and to encourage the development
of industry within the Town, including but not limited to the development of the Queensbury
Technical Park, and
WHEREAS, the Queensbury Economic Development Corporation , a not-for-profit corporation
organized to further the aforesaid purposes by means set forth in §1411 of the not-for-profit
corporation law, including but not limited to the power to acquire by purchase, lease, gift,
bequest or devise or otherwise real or personal property or interests therein, to borrow money
and to issue negotiable bonds, notes and other obligations therefore and to make loans, provide
working capital, and otherwise invest in industrial, manufacturing and technical facilities within
the Town of Queensbury, NOW,THEREFORE BE IT
RESOLVED, that the Town of Queensbury shall pay the Queensbury Economic Development
Corporation $550,000. to further said purposes in accordance with the terms of the annexed
contract, and be it further
RESOLVED, that the Town Supervisor of the Town of Queensbury is authorized to sign such
contract.

DISCUSSION
SUPERVISOR WALTER-Noted that this was not a budgeted item, none of this money is raised
by taxes in the Town Of Queensbury, this is either excess revenues or surplus funds.
RESOLUTION TO AUTHORIZE CONTRACT WITH GLENS FALLS SENIOR CITIZENS CENTER,
INC.
RESOLUTION NO. 326, Introduced by Mrs. Betty Monahan who moved for its adoption, seconded
by Mr. Stephen Borgos.
WHEREAS, the Town of Queensbury has heretofore contracted with the Glens Falls Senior
Citizen Center, Inc. to provide for services for the elderly, and
WHEREAS, New York State Aid is available for the establishment, maintenance and expansion
of Senior Citizens Programs, which aid was expanded by the provision of Chapter 1001 of the
laws of New York, 1974, providing among other things that State Aid will be available for approved
expenditures for a municipal program, and
WHEREAS, the Town of Queensbury desires to continue its support of the Glens Falls Senior
Citizens Center, Inc. for the furnishing of services to the elderly residents of the Town of
Queensbury for the year 1987 and the payment Qf $5,500. therefore be approved, and the Supervisor
is hereby directed to execute the contract on behalf of the Town and a copy of such contract,
duly executed shall be filed with the Town Clerk.

SUPERVISOR WALTER-The reason we are authorizing the contract now is that we will be
filling out the application and sending it down and it does take quite some time for the State
to reimburse us.

RESOLUTION SETTING PUBLIC HEARING DESIGNATING RUSH POND AND ADJOINING
LANDS AS CRITICAL AREAS OF ENVIRONMENTAL CONCERN
RESOLUTION NO. 328, Introduced by Mr. Ronald Montesi who moved for its adoption , seconded
by Mrs. Betty Monahan
WHEREAS, the Town Board is authorized to designate specific geographic areas within the
Town of Queensbury as critical areas of environmental concern, and
WHEREAS, Rush Pond and all of that area of land and water associated with Rush Pond that
lies west of the Adirondack Northway below USGS (AMS 6270 I SW-Series V821) contour elevation
of 430 and that land within 500 feet of this area appears to be of exceptional and unique character, j
and
WHEREAS, the aforesaid area may meet the criteria contained in Section 617.4 0) of Title
w
6 of the New York Code of Rules and Regulations as a benefit to the public health and safety,
natural setting, cultural and /or recreational purposes, and has an inherent ecological and hydrolo``. al
sensitivity to change which could be adversely affected by any change, and
WHEREAS, the Town Board seeks additional public comment regarding the designation of this
area as a critical area of environmental concern,
NOW, THEREFORE BE IT
RESOLVED, that meetings of the Town Board of the Town of Queensbury shall be held at the
Town Office Building at Bay and Haviland Roads in the Town of Queensbury on Tuesday, January
13th and January 27th 1987 at 7:30 P.M. for the purpose of conducting a public hearing on the
proposal to designate Rush Pond and certain adjoining lands as critical areas of environmental
concern, and to hear all persons interested in the subject thereof, concerning the same, and
to take action as may be required and authorized by law, and it is further
RESOLVED, that the Town Clerk of the Town of Queensbury is hereby authorized and directed
to publish on two occasions a copy of this resolution in the official newspaper of the Town
of Queensbury and to post a copy of this Resolution on the sign board of the Town of Queensbury.

RESOLUTION AUTHORIZING PURCHASE OF FIRE PROTECTION VEHICLE
