HAULING & DEMO, INC. REGARDING DEMOLITION OF STRUCTURE
ON PROPERTY LOCATED AT 32 HOMER AVENUE

WHEREAS, by Resolution No.: 304,2021, the Queensbury Town Board accepted and
awarded the bid for the demolition of the structure on property located at 32 Homer Avenue from the
lowest responsible bidder, Dan’s Hauling & Demo, Inc., (Dan’s Hauling) for the bid amount of
$31,500, and
WHEREAS, the Town’s Addendum #1 to the Bid Award provided that the Town would
sign a New York State Department of Labor Notification Fee Waiver (Waiver) and therefore,
Dan’s Hauling accordingly did not include the notification fee in its bid, and
WHEREAS, upon further review, a waiver is inappropriate where, as here, the cost of
demolition is less than the resulting value of the land at issue and the Town is therefore not in a position
to sign the Fee Waiver form, and
WHEREAS, the Town Board therefore wishes to authorize a Change Order with Dan’s
Hauling to cover this additional expense which is expected to be $4,000,
NOW THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes a Change Order with
Dan’s Hauling & Demo, Inc., as delineated in the preambles of this Resolution in the amount not
to exceed $4,000, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute a Change Order in a form acceptable to the Town Supervisor, Acting Director of
Building and Codes Enforcement and Town Counsel and/or any other needed documentation, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs that payment shall be
paid from Account No.: 001-3650-4400 Demolition – Misc. Contractual and assessed by the
Town Board against the real property, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer
to transfer up to $4,000 from the General Fund Undesignated, Unappropriated Fund Balance to
Account No.: 001-3650-4400 Demolition – Misc. Contractual, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Acting Director of Building and Codes, Town Purchasing Agent, Town Budget Officer and/or
Town Counsel to take any and all action necessary to effectuate the terms of this Resolution.

RESOLUTION AUTHORIZING AWARD OF BID FOR DEMOLITION OF
STRUCTURE ON PROPERTY LOCATED AT 32 HOMER AVENUE

WHO MOVED ITS ADOPTION

WHEREAS, a fire occurred at a structure on property located at 32 Homer Avenue in the
Town of Queensbury (Property) and the Town's Director of Building and Codes Enforcement
(Director) viewed the damaged structure and found it to be a hazard, in disrepair, unusable and
unsafe, and
WHEREAS, after the owner failed to voluntarily raze the structure, the Town duly
commenced a State Supreme Court Action to compel compliance with all applicable Town and
State Code provisions and by Judgment dated May 4, 2021, Supreme Court authorized the Town
to remove the structure if the property owner failed to do so, and
WHEREAS, the Director advised that the property owner did not remove the structure
within the time specified by the Court and therefore recommended Town Board authorization to
advertise for bids to demolish the structure in accordance with the terms of the Judgment, and
WHEREAS, by Resolution No.: 240,2021, the Town Board authorized and directed the
Town's Purchasing Agent to publish an advertisement for bids for demolition of the structure as
were more clearly specified in bid specifications prepared by the Spectrum Environmental
Associates, Inc.,the Town Purchasing Agent, Director and/or Town Counsel and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder meeting New York State statutory requirements and

the requirements set forth in the Town's bid documents and specifications, and
WHEREAS, the Purchasing Agent published such advertisement for bids and on
September 1, 2021, duly received and opened all bids, and
WHEREAS, the Director and Purchasing Agent have recommended that the Town Board
authorize the bid award to the lowest responsible bidder, Dan's Hauling & Demo, Inc., for the
bid amount of$31,500,
NOW, THEREFORE, BE IT
RESOLVED that award of the bid at issue and the subsequent demolition constitute an
Unlisted Action pursuant to the State Environmental Quality Review Act and, after conducting
uncoordinated review, the Queensbury Town Board hereby finds that there are likely to be no
significant adverse environmental impacts resulting from this'Action and issues a SEQRA
Negative Declaration, and
BE IT FURTHER,
RESOLVED that the Town Board hereby accepts and awards the bid for the demolition of
the structure on property located at 32 Homer Avenue from the lowest responsible bidder, Dan's
Hauling& Demo, Inc., for the bid amount of$31,500, and
BE IT FURTHER,
RESOLVED, that Dan's Hauling & Demo, Inc., shall provide the Town Budget Officer
with all required certificates of insurance in form acceptable to the Town before commencement
of the demolition work, and
BE IT FURTHER,

RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute any needed agreement and/or documents related to the bid award in a form acceptable to
the Town Supervisor, Director of Building and Codes Enforcement, Town Budget Officer,
Purchasing Agent and/or Town Counsel, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs that payments for such
demolition shall be paid from Account No.: 001-3650-4400 Demolition—Misc. Contractual and
assessed by the Town Board against the real property in accordance with the Warren County
Supreme Court Judgment dated May 4, 2021, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer
to transfer $31,500 from the General Fund Undesignated, Unappropriated Fund Balance to
Account No.: 001-3650-4400 Demolition—Misc. Contractual, and
BE IT FURTHER,

Dan's Hauling is pleased to provide the following price quote:
Demolition and removal of existing building as controlled demolition with asbestos in place 31,500.00
-Customer to provide condemnation letter and NYSDOL approved variance. Price quote is based upon acceptance
of condemnation letter and NYSDOL variance approvals for controlled demolition with asbestos in place. Price quote
based upon all foundation, brick, mortar, stone, concrete block, terra cotta and concrete being rinsed and left on
site in foundation hole 2' below grade. Any changes due to disposal costs of these items would be an additional
cost to the Customer over and above this contract price.
-Includes backfill for final grading of foundation area
-Includes topsoil for final restoration of foundation area
-Includes NYSDOL prevailing wage rates
-Customer to sign NYSDOL asbestos notification fee waiver
-Contractor to request disconnects prior to demolition
- Unless specified in proposal, the following are EXCLUDED: Foundation, slab or footing removals; brick, stone,
concrete, mortar or terra cotta removals; tree removals; saw cutting;shoring or bracing; compaction; CFC removals;
asbestos survey; asbestos abatement; air monitoring; lead testing; lead abatement;tank removal or remediation;
lift work; removal of tires; sheet piles; rodent and pest inspection/control; permits; traffic control; patching or repair
work; temporary chain link fence; temporary utilities; hammering; excavation of any shale, hard pan or rock;
hazardous waste remediation and/or disposal; asphalt removal or repair; sealing up of any openings or water tight
barriers; variances; dewatering; glue adhesive,tar, mastic or vermiculite removals; ACM paint removals; ACM
foundation removals.

All Ferrous and Non-Ferrous scrap within the work area to become the property of Dan's Hauling. Dan's Hauling will not be held
responsible for any damage that may occur in the demolition area as well as the entrance to the demolition area due to access of the
demolition equipment or the demolition process. Not responsible for time delays or damage due to poor weather conditions. All work
will be performed in a timely workman-like manner. This proposal may be withdrawn if not accepted within 30 days.
Any alteration or deviation from specifications involving extra costs will be executed only upon written orders and will become an extra charge over
and above the estimated price. Dan's Hauling reserves the right to place a lien on this property if necessary. If legal means are necessary to collect,
customer agrees to pay all legal fees and associated collection charges.Dan's Hauling will only be responsible for the removal of the items listed in this
proposal. The above price specification and conditions are satisfactory and are hereby accepted. Dan's Hauling is hereby authorized to perform the
work as specified.
