LUCAS DOBIE, HUTCHINS ENGINEERING-This is a pretty simple project. There are two
old camps that have been rehabbed a little bit. They have cleaned up the property. To do the
right thing they are getting rid of the two leaching cesspools that are on the lakeside of the
parcels. They are approximately fifty to seventy five feet off the shore. There is not really good
space on the property to put an absorption field. We thought the simplest solution is a holding
tank system. Two, two thousand gallons concrete tanks. Water in is water hauled out. We will

re-plum the two houses on the lakeside. We will put a grinder pump station there to pump
around the house up to the holding tanks. The holding tanks have a high water alarm shut off on
it. It is a lake water supply for the homes. It is a pretty simple project. We believe it is a good
solution for the property and a nice improvement to the environment there. I would be happy to
answer any questions the Board may have. I am here to ask for your approval. We would like to
do the construction this spring.

WHEREAS, James DeNooyer (Applicant) filed an application for variances from provisions of the
Town of Queensbury On-Site Sewage Disposal Ordinance, Chapter 136, §136-11 which requires applicants to
obtain a variance for holding tanks as the Applicant wishes to install a holding tank system consisting of two
(2)holding tanks, each with a capacity of 2,000 gallons,for a total capacity of 4,000 gallons, and
WHEREAS, the Applicant has also applied for additional variances from Chapter 136 to allow
placement of the:
1. Grinder pump station to be 34' from the Lake George shoreline in lieu of the required 50'
setback; and
2. Force main to be 34' from the Lake George shoreline instead of the required 50' setback;

reasonable use of the land and are the minimum variances which would alleviate the specific
unnecessary hardship found by the Local Board of Health to affect the Applicant; and

LUCAS DOBIE, HUTCHINS ENGINNERING-The property has been in the family since the 1940's. It is
my understanding it is one of the older homes on Cleverdale. It is in pretty rough shape. It is on piers that are
leaning. It is really not financially viable to rehab the old place. We originally looked at doing the septic for it
last year and then decided to pursue doing a teardown. The proposed new house will be smaller in footprint
than what is there. This is quite rare. I do not think I have done that before. We are centering it more on the
lot. We are pulling it back from the shore a couple of feet of what is there. All the homes in that neighborhood
are pretty much tight right up to the shore generally within thirty-five feet or so. We understand we have to
pursue the area variances and site plan review. We needed to start with our septic. If we don't have a septic,

we don't have a project. We are proposing the Puraflow Enhanced Treatment System and Absorption Field.
This is a special peat fiber filled chamber that you pump up to from your septic tank. It is a liquid effluent
pump station. It is pumped to the pods where it trickles filters down through to get the enhanced treatment
before it gets into the stone absorption bed. It is a very reliable system. There are a lot of them around the lake.
I just spoke with their installer Chris Crandall. He has done several of them on the southern basin and around
Huletts Landing.In my opinion,it is probably the best Enhanced Treatment Absorption Field. I know that we
have talked about Aerobic Units and that sort of thing. I feel that this is a very reliable and nice clean system.
The amount of variances are a function of the geometry of the parcel. We feel we have the best layout of the
absorption field given to the west there is a well directly across the road. This is what is driving where we
locate the field. Our stone for the absorption bed is compliant to that well and to the shoreline setback. It is
right at a hundred feet on each of them. We have to count the fill because that is how it is with the Code. This
is what makes the variances more intrusive than they are in my opinion. The site soils are decent for Cleverdale.
The groundwater table is about three feet so we do have to level up the area behind the new house. It will be
the lawn area and you will see the three pods. This is our proposal. We have the neighbors support for the well
across the road. He did sign the application for the release. I feel that it is a nice project. A nice improvement
for the neighborhood. We are here to ask for your approval for the septic variances. We would like to pursue
our area variances and Planning Board submissions. I would be happy to answer any questions the Board may
have. Thank you for your time tonight.
SUPERVISOR STROUGH-Questions from the Board before we open the public hearing.
COUNCILMAN METIVIER-Do the units have to be cleaned out every few years?
MR.DOBIE-Every fifteen years is the manufacturer's guidelines.
COUNCILMAN METIVIER-Not that we are going hold you to this. How do you go about making sure that
it happens? Does the system just...what exactly occurs if you do not clean them out?
MR.DOBIE-I think that they would get built up with the biomass over time Tony. I think you would see it in
your pump running harder. To your point, the responsibility is on the homeowner. We do have one that is
about fifteen years old on Pilot Knob. It has been very reliable. We have another one on Rockhurst,which is
probably ten or twelve years old that there were not many problems with them.
SUPERVISOR STROUGH-Two concerns that I have expressed on the site. One is without exception we are
making almost everybody get an ETU in terms of the pretreatment before it goes to the absorption field.
Puraflow is a good absorption field. The other concern that we had was that would you rather have a variance
from the lake or a variance from the neighboring well. The neighboring well is almost at an even level with
this.I don't think there would be much flow in that direction. I think it would be towards the lake. This is the
proposed house, which you are using the same footprint as the older house, which is a violation. You would
have to get a variance from the setback for this new house. You are proposing to use the same footprint,but it
doesn't meet current standards and you are rebuilding the house. It is a new house. I would hate to see a
situation where the ZBA doesn't look at this favorably in terms of allowing a variance from the setback. Then
you might use an excuse that the absorption field is down the way as approved by the Town Board. I would
not want that to be the case. I would like to see a pretreatment and if we could move the absorption field back
a little bit closer to the road. Before I open the public hearing, Lucas is there, anything else you want to say
before we open the public hearing.
MR. DOBIE-I would like to clarify the new house is somewhat smaller than what is there. That is an
improvement. Pulling it back from the lake a little bit I understand the concern. To me,I would rather protect
the neighboring well than the lake for the setback.Professionally myself since that is...water right there. We
are kind of balancing the two if you will between the shoreline setback and the well. We are trying to sandwich
right in between the two as best we could. I would ask if you have a feel for us pulling the field closer to the
well if you had a magic number in mind?
SUPERVISOR STROUGH-The other thing I was concerned about is if the ZBA does not give you your
variance,you are going to have to move the structure. Is the field going to be in the way? I mean it is not as
likely to be in the way if the ZBA ask you to move it back to be more in line with Code. Let us see what the
public has to say. Any member of the public wish to speak to this the Sewage Disposal Variance Application
of Robert and Jean Tarrant?I will close the public hearing.

SUPERVISOR STROUGH-Any thoughts on this Town Board?

COUNCILMAN MCNULTY-I think we should give the Engineers and the owners a chance to talk about the
ETU and some of the suggestions you just made. Based on my limited knowledge. I think if the ETU was
added your concerns about the water going into the lake it would be screened one more time before it got to
the field. I think we should give them a chance to discuss it before making a decision.
SUPERVISOR STROUGH-I agree to that. Is everybody okay with the proposal as is because if there is enough
we can vote.
COUNCILMAN METIVIER-I am fine with it. I think what is ultimately going to happen you are probably
going to have to come back to us at some point with a modification after the house is designed correct. If that
is the case,is that a problem? I guess this is the cart before the horse type thing.
COUNCILMAN FERONE-It is unfortunate they have to get this done.
COUNCILMAN METIVIER-It is a terrible position for them to be in. I don't want to send a message to the
Planning Board or the Zoning Board that we are not willing to work with them. Send them with something. If
they have to come back to us with a modification or what have you can we do that?
TOWN COUNSEL, SCHACHNER-The answer is yes. Whether it is a result of our Planning Board or Zoning
Board of Appeals review or some other instance or occurrence or change an applicant is certainly allowed to
come back and seek modification of a Board of Health Septic System Variance Approval. Obviously,there is
no obligation to grant the modification assuming that the modification is a better treatment,better design, and
better location in furtherance of all of our goals. There is no reason an applicant could not seek a modification
and you would reasonably review that. You can also if you like in any of several fashions you can try to make
clear to the Zoning Board of Appeals that you do not necessarily feel that again if you are heading for approval.
I am not telling to do this I am just outlining options. You could tell the Zoning Board of Appeals that you are
not necessarily suggesting that this is the best location and that you would have to speak in the abstract,but you
would be willing to consider modification if a proposed modification results from the Zoning Board of Appeals
review.
SUPERVISOR STROUGH-Having said that,too in the past we almost require pretreatment.The Lake George
Park Commission one of the standards that they are putting before the public for their consideration has not
been approved yet. It is to make a pretreatment units ETD's standard for all shoreline properties. I am not so
sure I am comfortable with the exception here. We did receive a last minute email. I did forward it to you at
the last minute. I just received it, too. Chris Navitsky the Lake George Waterkeeper for the Lake George
Association does not favor this. He feels it does not need to have a setback from Lake George variance. In
other words moving it another eight feet he would be more comfortable with it. (Email received 4-5-2022 from
Chris Navitsky, P.E. Lake George Waterkeeper on file in Town Clerk's Office) We made so many others go
back and put a pretreatment unit in. Lucas is not here all the time so he does not know that. He does a good
job engineering it. I like Tim would be comfortable saying Luke can you at least give us a pretreatment unit
and come back. We will not act on this, George.
COUNCILMAN FERONE-I agree. I would feel much more comfortable.
SUPERVISOR STROUGH-Would you do that just fine tune this a little bit.
MR.DOBIE-Yes sir. Just table it and let us regroup.
SUPERVISOR STROUGH-We just will not act on it. Just resubmit a modify plan to us. We can do it as soon
as our next meeting if you can get it together.

PUBLIC HEARING—SEWAGE DISPOSAL VARIANCE APPLICATION OF JASON A.GOTTLIEB

DENNIS MACELROY,ENVIRONMENTAL DESIGN PARTNERSHIP-Just to reinforce what you have said
John. This is a three bedroom home out at the end of Cleverdale. We have designed a system that as a
replacement system to an older system that has been maintained over the years. The owners feels that it is
appropriate to step up to the new technology for the betterment for the property and the lake using an Enhanced
Treatment Unit a Fuji Clean CE5 in this case. Then in addition using an Infiltrator Chamber Disposal System,
which allows that system to be located. In this case,partially two of the three trenches would be located under
the driveway. Because all of that is pushed as far back on the property,it results in a bunch of variances as you

read off. The important one is the eighty-foot setback to the lake. There are others that involve setbacks to the
property lines both to the north and the south and the roadside. We tried to put together a proper design. One
that is not dissimilar from others that have been proposed and approved on Cleverdale and other locations
around the lake. I would be glad to answer any questions from you. I would mention there have been
discussions with an Engineering Representative from one of the neighbors. A neighbor to the south the
Davidsons. We have discussed a couple tweaks as it were to this design that would perhaps make their concerns
a little less. The installation of a liner wrapped around the south end of that dispersal field to help create a
barrier. That is one that has been discussed with the owner and he is certainly willing to go along with it. We
are also going to try to push the field ever so slightly. It really only amounts to two feet maximum that would
increase that separation on the south end to the property line of three feet. Those are the two further mitigations
measures that we have discussed with Mr. Jarrett in this case. It doesn't increase any variances. It may only
decrease the requested variance number two. We will change that from one foot to three feet.
SUPERVISOR STROUGH-Would that change anything to the north property line?
MR.MACELROY-No. Those tanks are the determining components that dictate that setback.
SUPERVISOR STROUGH-I understand that your neighbor would feel better if we did install that impermeable
barrier or liner on the south end of the absorption field. In order to do that you would have to move the
absorption field two feet so that the absorption bed would be three foot from the southerly property line instead
of the required ten-foot setback?
MR. MACELROY-Correct. As long as the liner is not considered a setback issue. In that case, I believe the
setback dimensions....the way they were.
SUPERVISOR STROUGH-Questions for the applicant or applicants Agent before I open the public hearing?
MR.MACELROY-Jason would like to say a few words.
SUPERVISOR STROUGH-Certainly.
MR. GOTTLIEB-I just wanted to add very quickly. Many of you might recall that Dennis came on my behalf
to the Town Board seeking a septic variance in October of 2015.Back then,as it is today,I am trying to upgrade
my system to make a difference for the lake and also to improve my property. For the past seven years, we
have maintained our system and have confidence in its ability to preserve water quality. It works fine,but it is
old and antiquated. My view has been and it continues to be that risk mitigation is a much better approach than
risk management. After the holes in the Lamberts approval Dennis and I discussed when visiting this
application similar to the holes are plans utilizes the best ETU technologies available and we are looking to do
this for the after mention reasons. I appreciate your consideration.

PAUL VERCESI, 391 CLEVERDALE ROAD-I think, I spoke the last time the Gottlieb's were putting in a
new type of system. I realize that things are changing. However, I have owned by house for fifty years or
more. Fifteen years ago,I retired so I spend a lot of time up there. I personally drink the water. My daughter
and son-in-law and my three granddaughters drink the water. They spend the whole time during COVID 19
drinking the water. We all drink water from the lake. My belief is never put anything in the water. These new
so-called septic systems,I am not against change. I have...technology,laptops and everything. Nobody knows
when you do these things how pure or how safe if the runoff is not monitored. If it whines up in the lake what
would be the consequences ten or twenty years from now for the life of the lake or the people drinking water?
Holding tanks are okay so they don't put anything in the water. Due process you have to pump them all the
time. I can understand any system especially the State and everyone wants to give bonuses to try to update the
systems. Apparently, the Town monitors my system. The Gottlieb's and Bill Davidsons system, I know John
Mason takes care of my house. Somebody comes and puts pellets to make sure it is working properly. The
big question is not for anyone that can guarantee what is the effect if the system works perfectly well and stays
in the three tanks, two tanks it is purified. How would you put it, I am not a technical person. I owned a
Hardware Home Center so I am not into technics. Whatever the technical aspirations of these systems even
though they seem very ideal nobody knows when there is an excessive amount of rain, absorption of other
water in the ground. Just like when the temperature changed so quickly to fifty-five, sixty degrees my ice

melted and was not being absorbed in the ground you had mud around anywhere there was grass. Nobody can
predict when these systems are working whether Fourth of July,Labor Day,tons of people come then suddenly
there is an overflow. My question is what of a control do you have even though the overflow that comes out
of the supposedly tank goes into the lake? Is there alert systems that notifies the Town or anybody checking
or the owner? That okay your tanks for the system is not purifying the water the way it is supposed to do.
Nobody can predict what the overflow is going to be. I always worry about the liquid. I think I asked this
question three years ago when the Gottlieb's did this before. You go on certain places in certain Countries
where they put chemicals in the water. It is like when I used to drive down to Florida sixty years ago. There
was a horrendous taste of sulfur in South Carolina, Georgia and Florida. Then they come out with all new
systems you don't taste that. Nobody knows how they purify the water with the chemicals what it will do to
the body twenty years from now. Nobody can really be sure of that. With that thought,if a system apparently
my neighbors the Gottlieb system is working. Their complaint the last time because they pump a lot, but it
does work and it is not going in the lake. Since it is in such a small lot so close to the neighbor on the north
and to the south. If it was not working and it was really doing some damage to the lake, I would think fine. I
would be very apt to say we will try something like that. If it is working, why look for trouble by doing this.
It may seem like an idea to present so that you are into the wrong thing if your house....you are ecology safe
you are contributing a better potential to the lake. I personally would not most of these systems they say you
can drink the water that comes out. They put chemicals in to kill the bacteria. I personally would not want to
drink that. I don't think anyone here would either. Thirty years ago,the hottest thing in the houseware business
was Teflon pans. Then all of a sudden, the Teflon starting coming off. Then all of a sudden, they said it was
starting to cause cancer. You cannot buy Teflon pans now. I think I have a granite stone pan. Lee has a Le
Creuset pan that is not Teflon but it is coated so nothing sticks. Twenty years from now how do they know the
same thing as Teflon is going to come out again?We do not know what these consequences will be. Although
it sounds very safe now. Since I drink the water, I am not happy about that. Also the same thing of putting
barrier for the south side. I would think it should be on my south side to north side also. I don't know if the
septic is that far it is just the tank. Maybe the Board should entertain putting a barrier since I am only four,five
feet away. He is asking for a four-foot variance last time he asked for one foot. I don't know if it is not as
close or no potential or need for it. If there is any kind of a chance, I would ask for a barrier on the north side
so it doesn't go into my basement. I wouldn't want to have his overflow. Not that I am implying that he has a
lot of gatherings,but he has a lot of functions just like everybody on the lake. If it goes and overflows,I would
not want it in my basement. I would...that maybe we should look into if this is necessary.I am not an expert.
SUPERVISOR STROUGH-Are you in the old Ashley house?
MR. VERCESI-Yes the old Ashley house. I bought it from Jane and Fred Alexy. His mother lived in that
house.
SUPERVISOR STROUGH-Okay.
MR.VERCESI-They do test my septic system. I am very paranoid because I drink the water. I want to make
sure it is working.
SUPERVISOR STROUGH-We will ask the Agent to respond to your concerns. I have a list of them. I will
go through and make sure they are covered.
MR. VERCESI-I admire that there are new systems. It is like when you go on a Cruise Ship the water is
treated. Nobody knows what you drink in that water.That is why a lot of people drink bottle water. I personally
don't drink bottle water I drink the lake water. I do have a purifier that kills bacteria,but I drink the lake water.
In that sense,if his system was malfunctioning even though he likes to modernize he has more money than me.
He puts fancy danzy stuff and he wants to modernize the system if it is really working I don't see any benefit
for taking the chance of potentially putting something in the lake if it is not monitored properly or if portions
of these systems fail not only for his house,but the house across the street. I would like to keep drinking the
water. Especially for my three grandchildren. Two are in High School and one a freshman in College they
drink the water. I do not want to see that in fifteen years from now, they cannot have children or God forbid
they get some disease.

SUPERVISOR STROUGH-Who would like to go next?
WILLIAM F.DAVIDSON, 387 CLEVERDALE ROAD-I just want to say that I admire the intent to improve
the sewage treatment system,but I am not so sure this is the answer. We went through this on October 19,. I
would ask the Board Members to please reread the minutes of that meeting. Many valid concerns were raised
and I think they are still valid today. I am especially concerned, however, with the variances that they are
seeking especially within one foot of my property. I am concerned that the seepage will go into my property

off the property line. The building is also quite close. I had a conversation with the New York State Health
Department today in their schedule out of Appendix 75-A. Separation distances ten feet from the property line
is their recommendation or their rule. Twenty feet from the dwelling. They said even though they may give a
little variance to systems that are replacing antiquated systems they would never go below five feet. This
proposal is asking for one foot. That is too much. That is ninety percent reduction. It has to be more than that.
Even if there are other measures taken to abate the seepage on a good Fourth of July weekend or Labor Day
weekend or whenever the usage could be so intense it would seep into my property and into my basement,
those are essentially my concerns. The proximity and the tremendous percentage or reduction in the side or
the property line variance close to my property are my major concern. As was recommended back in 2015 I
personally think as Mr. Vercesi has pointed out holding tanks solve the problem completely. Holding tanks
are in affect for neighbors in that area. The Schille's across the street from me have holding tanks. I think that
is the ideal way. Thank you.

of their efforts to improve their septic system. I am a firm believer of progress over perfection. This is a good

treatment is the right one for residents of the lake. I am hopeful that others will continue to try and make these
improvements for their own properties. I appreciate their efforts and would ask the Board to consider. Thank

something to kill the bacteria in the water,which would be probably ultraviolet or something to that effect.
SUPERVISOR STROUGH-There is aerobic bacteria. They do their job. You do want them. Then there is
anaerobic bacteria without oxygen. They will do a different job. Your basic system just gets an anaerobic
treatment. This gets both anaerobic and aerobic. Then when they are done you are not killing those bacteria's
because you want them to do their job exiting the unit going to the infiltration bed then it gets treated for
pathogens. The water entering the infiltration bed is basically clean.
MR.VERCESI-I was just thinking if it wasn't chemical,it was ultraviolet.Then if there were,a ten-day outage
of power the system would not work.

• Corinth Road Traffic Study. We are getting close to the end. They have asked for some final
comments. I hope that by the next meeting I can present their draft comments.
COUNCILMAN FERONE(WARD III)
• Reminded everyone, that spring is here. Asked everyone to be mindful of their speed around Town.
Children are out riding their bikes doing more things on the road. There will be a lot more activity
around.
• Replaced one of our speed signs on Dixon Road due to an accident. I hope to talk to you regarding
purchasing a few more.

• Spoke regarding the press release by NYSERDA.
• Stu Baker, Senior Planner is putting together a Steering Committee to the firm that was awarded to
help in updating the Comprehensive Land Use Plan. We are looking for residents to volunteer. If you
would like to be on the Comprehensive Land Use Plan,submit an email to s! uai'�IY0 qu r i'�slsur'\,,net or
phone call of interest to(518)761-8222.
• Water Superintendent, Chris Harrington would like everyone to know they will be doing hydrant
flushing starting April 18, 2022. They are starting early this year because they do not want to be
flushing the system when people are trying to water their lawns.
• Attended the Bay Ridge Fire Department and Bay Ridge Rescue Squads Banquets. Thanked all the
volunteers who are there helping to give us fire protection and helping us with our emergency services.
These people are so dedicated to helping other people. I can say thank you a hundred times it will not
be enough. We are very lucky to have these teams in the Town of Queensbury working for us.
• There is going to be a Memorial Day Parade on May 30, 2022. The Remembrance Ceremony will
follow the Parade. It will be in front of the YMCA in Crandall Park in front of the Victory and Peace
Monument. Anyone who has an organization that wants to be part of that Parade you would have to
get in touch with me. I will send you an invitation. You send the invitation back to me. If you want
to be in the Parade,you have to produce a theme that is going to pay respect and homage to memorialize
those who lost their lives fighting for our freedoms.
• Volunteers are needed for the Homebound Seniors Meal Delivery Program. If you are interested,
please call(518)761-6347.
• Rabies Vaccination Clinics are scheduled for Saturday, May 14,2022 at the Queensbury Community
Center,742 Bay Road 10:00-Noon.Saturday,July 16th,2022 Chester Fire House,State Route 8 10:00-
Noon. Saturday, August 13, 2022 at the Queensbury Community Center, 10:00-Noon. Saturday,
