MALE ASSOCIATES FOR PROVISION OF PROFESSIONAL SURVEY, ENGINEERING AND CONSTRUCTION PHASE SERVICES RELATED TO LUZERNE ROAD CULVERT PROJECT RESOLUTION NO.: ,2022 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, by Resolution No.: 153, 2021, the Queensbury Town Board authorized engagement of C.T. Male Associates for preparation of a 2021 New York State Department of Transportation(NYS DOT) Bridge NY Grant Funding Application regarding a culvert replacement project on Luzerne Road at Clendon Brook in the Town of Queensbury(Project), and WHEREAS, by Resolution No.: 65, 2022, the Town Board authorized acceptance of $839,212 in NYS DOT Bridge NY Grant Funds for the Project and establishment of the Luzerne Road Culvert Capital Project No. 242 (which Capital Project No. was amended to Capital Project No.: 243 per Resolution No.: 76,2022), and WHEREAS, the Town Board wishes to engage C.T. Male Associates,for professional survey, engineering and construction phase services for the Project for the lump sum not to exceed $173,600 as delineated in C.T. Male Associates' letter proposal dated April 15, 2022 presented at this meeting, and WHEREAS, there are times when Change Orders may become necessary related to such services and therefore the Town Board also wishes to authorize the Town Supervisor to approve and sign certain Change Orders up to a ten-percent (10%) contingency for Change Orders that he deems necessary or appropriate, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of C.T. Male Associates for professional survey, engineering and construction phase services for the Luzerne Road Culvert Replacement Capital Project for the lump sum not to exceed $173,600 as delineated in C.T. Male Associates' letter proposal dated April 15, 2022 substantially in the form presented at this meeting, and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes the Town Supervisor to approve and sign Change Orders pertaining to such Services up to a ten-percent 10% contingency or in the total amount not exceeding$17,360 that he deems necessary or appropriate, and BE IT FURTHER, RESOLVED, that expenses for this project shall be paid for from Luzerne Road Culvert Capital Project No. 243,and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute any needed Agreement with C.T. The following represents our understanding of the project along with a detailed work scope and fee relative to the culvert replacement work. Project Understanding The project entails the replacement of an existing corrugated metal pipe (CMP) culvert which conveys Clendon Brook beneath Luzerne Road, a Town-owned roadway. The culvert is deteriorated to a level that requires full replacement. The existing CMP pipe does not contain end sections or wingwalls at its inlet and outlet as it crosses under Luzerne Road. The initial basis-of-design, as described in the Bridge NY funding application, is the installation of a new precast concrete box culvert with wingwalls at its inlet and outlet. Sizing of the new box culvert will be determined during design upon completion of hydraulic modeling for the water shed tributary to this section of Clendon Brook. In addition to the culvert replacement,it is our understanding that the Town Water Department desires to install new isolation valves on the existing main upstream and downstream of the culvert replacement limits. Additionally, deteriorating guide rail will be replaced comprising a total length of approximately 950 if along the north and south sides of Luzerne Road. Finally, pavement will be replaced to include the limits of disturbance encountered by the construction. The scope of work detailed below will include SEQRA review and application for environmental permitting. Applicable NYS DOT standard details and specifications will be incorporated into the design documents. Our team will consult with NYS DOT as to the requirements of the Bridge NY funding program and will afford the State an opportunity to review the contract documents prior to advertising for bid. Additionally, C.T. Male's team will work with the DOT and Town staff in terms of adherence to applicable design procedures and grant reporting. Our understanding of the desired schedule is that the design and permitting will be completed by the fall of 2022, bidding and award will then follow in the winter of 2022/2023 and a construction start by the spring of 2023. A summary of the proposed work scope tasks is as follows: Civil Engineering • Environmental Services • Survey Services • Land Services •Architecture Energy&Building Systems Services • Electrical Engineering C.T. Completion of a partial boundary survey and topographic survey in accordance with the existing Code of Practice of the New York State Association of Professional Land Surveyors. The partial boundary survey includes Warren County Tax Map Parcel Nos.308.5-1-33,308.5- 1-34 and 308.09-1-22. 2. The survey will show above ground visible structures, utilities, and improvements on an approximately 50-foot-wide section of the Town of Queensbury right-of-way of Luzeme Road and extending westerly from its intersection with Laurel Lane approximately 800 to 900 feet. One (1)foot contour interval will be shown. 3. The topography will also include the culvert and extend 100 feet in each direction from the culvert pipe inlet and outlet. 4. Two (2) elevation benchmarks will be set at locations to be used for future construction. Horizontal Datum to be NAD83. Vertical Datum will be based on NAVD88. Base mapping will be prepared using AutoCAD Civil 3D 2019. 5. Prepare base mapping at a scale of 1" =20'for use in design document preparation and with environmental permitting. Task B. Design Phase 1. Conduct a kick-off meeting with NYS DOT, selected Town staff and the local NYS DEC representative to define the project intent and schedule 2. Complete a hydraulic (HECRAS) analysis of the Clendon Brook watershed tributary to the crossing at Luzerne Rd. Based on the assumption that the new culvert will need to carry a 50 year storm, the box structure will be sized appropriately. 3. Consult with the local NYS DEC representative early in the design process to discuss inlet conditions,culvert invert requirements and bypass flow options. 4. Prepare preliminary plans, details and sections of the replacement culvert. Provide to Town and DEC for review and comment. Plans required for a joint permit application(TPA)will be prepared also in this phase. 5. Complete a preliminary opinion of probable cost for the culvert,guide rail and related items. 6. Complete a traffic control plan for construction. It is assumed that a road detour plan will be established in coordination with the Town and Warren County DPW for the duration of the project. 7. Proceed to final design document preparation. Final design plans, details, sections and permit plans will be prepared at the construction level. 8. Detail sheets expected would include erosion control measures, structural details of the culvert and wing walls along with foundation requirements, water valve placement, guide rail installation and roadway pavement. 9. Complete technical specifications, bid and contract documents to allow the project to be bid publicly. Provide documents to the Town and NYSDOT for review and comment prior to C.T. MALE ASSOCIATES April 15,2022 Supervisor John Strough Page-3 bidding. 10. Based on the expected area of disturbance, a SWPPP Plan and SPDES permit will not be required from the NYS DEC. 11. Assist the Town with bidding the project. Provide electronic files to prospective bidders and prepare/distribute addenda as needed. 12. Attend bid opening,analyze bids and recommend award to lowest responsible bidder. Task C. Environmental Permits and Approvals Clendon Brook is a New York State Department of Environmental Conservation(NYSDEC)Class C(T) stream and falls under NYSDEC Protection of Waters regulations. The stream is also assumed to be Waters of the U.S. and under the jurisdiction of the U.S.Army Corps of Engineers (Corps). In addition, NYSDEC Freshwater Wetland (FWW) GF-2 is mapped around Clendon Brook in the vicinity of the project site. As such, the replacement of the culvert will likely require the following environmental permits/authorizations: • Article 15 Stream Disturbance Permit(NYSDEC Region 5) • Article 24 Freshwater Wetland Permit(NYSDEC Region 5) • Nationwide Permit#3,Maintenance(U.S.Army Corps of Engineers,New York District) • Section 401 Water Quality Certification(Blanket Certification,NYSDEC) C.T.Male will prepare and submit a Joint Permit Application(JPA)package to gain authorization under the above referenced permits for work in Clendon Brook and the adjacent State wetlands. This task includes one (1) site visit to characterize site conditions and to delineate appropriate stream or wetland boundaries in the project area to fulfill requirements of the joint permit application. This task also includes the preparation of a Short Environmental Assessment Form (SEAF),which will be submitted with the application package. Task D. Subsurface Investigation 1. A minimum of two (2) soil borings will be conducted by a subcontractor for the purposes of providing an understanding of the subsurface soils and for the design of the new box culvert foundation. Our geotechnical engineer will provide recommendations as to the best practices in terms of the foundation system. Task E. Easements 1. Based on a preliminary review of tax mapping in the vicinity of the culvert replacement work limits, it is anticipated that at total of two (2) temporary easements and one (1) permanent easement will be required. Our team will prepare, for signature, easement maps and descriptions of each location. The Town would be responsible for actual acquisition of said easements from the parcel owners. C.T. MALE ASSOCIATES April 15,2022 Supervisor John Strough Page-4 Task F. Construction Administration 1. Compile contract documents for signature by the General Contractor and Town. 2. Review contractor submittals. 3. Coordinate and participate in a pre-construction meeting. 4. Review Contractor payment requests. 5. Interpret the plans and specifications and address field questions/issues. 6. With our field representative,resolve disputes as appropriate. 7. Coordinate and attend regular job meetings. It is assumed biweekly meetings will occur. 8. Review change order requests and advise Town as to acceptance. 9. Certify completed portions of the work as appropriate. 10. Perform a final inspection and punch list. 11. Prepare record drawings for the Towri s use. Task G. Construction Observation 1. Provide a full-time construction representative to observe the work and report progress and deviations from the plans and specifications. 2. Construction observer to obtain record information of the installed culvert and appurtenances. 3. Function as a liaison between the General Contractor,Town staff and the public. Questions that arise from the public will be addressed by the field representative. 4. Construction observer to review Contractor's payment requests for accuracy prior to acceptance by the Project Manager. 5. Construction Observer will prepare daily reports with photos, testing results and measurements of installed items. C.T.
