SUPERVISOR STROUGH reviewed the proposed nine variance requests.
LUCAS DOBIE-Thank you Mr. Supervisor. Good evening Board, for the record Lucas Dobie
with Hutchins Engineering and with me is my clients Bob and Jean Tarrant with the referred
property at 308 Cleverdale Road on Sandy Bay. And we discussed at quite at length in April at
the second meeting whether they proposed to do a tear down and a new build. You asked us to
make some changes to the system where we had a Puraflo Peat system, we've abandoned that
design and gone to the Fuji Clean Enhanced Treatment Unit. It's conventional stone absorption
bed up towards Cleverdale Road which is a shallow system with fill brought in and we've
reshaped the project a little bit with these changes to hold the absorption bed further to the west.

So it is now compliant with the shoreline setback, through our fill, our 100 foot shoreline
setback. So that variance is gone away as well as the previously proposed absorption field to
house variance, that is gone away as well. Where we need more relief is to the westerly
neighborly well where before we had 89 feet to the fill and now we are at 81 feet and again my
clients did meet with Mr. Eafrato across the road as well and he did sign a release and it's my
understanding he, that it was a good meeting and that he is on board with the project. That's my
understanding.
SUPERVISOR STROUGH-Alright thank you.
Mr. DOBIE-Also with this redesign we did pull the house a little farther back from the shoreline
based on some of the discussions.
SUPERVISOR STROUGH-Questions from the Board before I open the public hearing? Seeing

COUNCILMAN FERONE-I don't think there is anybody.
COUNCILMAN MCNULTY-Just us.
SUPERVISOR STROUGH-I don't see anybody either Tim, thank you. Alright, the one question
that I had is, I think you did a good job, redoing it. I think the, you know the Fuji Clean is a very
good system, anaerobic, aerobic. It requires a maintenance agreement with it, it says so on the
plans by the way, and as I know Harrison's always worried about the maintenance agreement but
Lucas put it right on the plan. So, if there's no further questions I will entertain a motion.

WHEREAS,the Town Clerk's Office has advised that it duly notified all property owners within 500
feet of the subject property,
NOW, THEREFORE, BE IT RESOLVED,that
1. due to the nature of the variances, the Local Board of Health determines that the variances
would not be materially detrimental to the purposes and objectives of this Ordinance or other
adjoining properties nor otherwise conflict with the purpose and objectives of any Town plan
or policy; and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the specific
unnecessary hardship found by the Local Board of Health to affect the Applicants; and
BE IT FURTHER, RESOLVED, that the Local Board of Health hereby approves the application of
Robert and Jean Tarrant for variances from the Town of Queensbury On-Site Sewage Disposal Ordinance to
install a new enhanced treatment system with its components to be located as follows:
1. Absorption field toe of fill to be 81'from the westerly well in lieu of the required 100'setback;

EXTENSION OF TIME TO COMPLETE INSTALLATION OF
NEW WASTEWATER SYSTEM ON PROPERTY
LOCATED AT 21, 25 DUNCAN COVE
SUPERVISOR STROUGH-They are unable to get the septic system in this year. They would
like to have an extension. They have the $2,000 escrow and it's been paid. They would like to
extend that until May 1st, 2023. Any thoughts?
COUNCILMAN MCNULTY-I have a question. What is the status of the current system?
SUPERVISOR STROUGH-It's a new build.
ALEXANDRA DAVIS-Attorney at Bartlett, Pontiff. I believe the question was, the correct
status of the system. There is an outdated system there. I believe when they inspected it at the
time it was purchased, our client bought the property in January, they marked it as failed. There
is no immediate issues happening at the property. It is just that because they plan to just
demolish it and rebuild and they knew the result would have to be incompliance with the new
structure, that they are going to go back and seek ... and the time to make sure that is all correct
with the new structure.
COUNCILMAN MCNULTY-So is the intent to use the failed system this summer? Or is the
house going to be vacant?
ATTORNEY DAVIS-I think they may use the property but they are demolishing by the end of
the summer, early fall.
COUNCILMAN MCNULTY-My point is, if it is a failed system, we're going to allow a failed
system to be used for another year. Is that what you are requesting?
ATTORNEY DAVIS-No, again, I think the plan is that they are moving forward to demolish the
property and have it rebuilt by next year.
COUNCILMAN MCNULTY-When are they going to demolish the property?
ATTORNEY DAVIS-In the fall.
COUNCILMAN MCNULTY-So it will be used this summer.
ATTORNEY DAVIS-Right, I don't know specifically if they, I don't think they are going to be
living there. In fact they are from out of town. They will probably visit the property but I ...
COUNCILMAN MCNULTY-So we're going to allow a new owner to move into a house and
use a failed system.

COUNCILMAN FREER-This is due to the Transfer Law, not as a necessarily failed system.
Yes, we've done that consistently.
COUNCILMAN MCNULTY-There is no report here that says what failed. I am concerned that
we have a failed system and it will be used for another year, another season.
ATTORNEY DAVIS-So my understanding is that the test failed but that it is not, there are not
any present issues with the system. It is just that,would it meet the standard of what is being
asked for now.
TOWN COUNSEL HAFNER-If that is the concern, we can postpone and bring back at the next
meeting.
COUNCILMAN MCNULTY-I would like to know what the status is of the system.
SUPERVISOR STROUGH-They are still good until the end of June.
COUNCILMAN MCNULTY-If it failed because it doesn't meet the standards but it is still
operating, that is fine. But if it has failed and the report is not included in the packet.
SUPERVISOR STROUGH-Okay, so we just won't act on it.
TOWN COUNSEL HAFNER-Since this is the concern, we can just extend until the next
meeting.
COUNCILMAN MCNULTY-I think we need a copy of the inspection to find out if it is a hard
fail or if it's just a failure to meet the new regulations.
TOWN COUNSEL HAFNER-You could ask Alexander and find out their intentions are during
the summer.
COUNCILMAN FREER-It's my issue on this topic that, one way or another, if we extend it, we
prohibit them from renting it.
ATTORNEY DAVIS-If there are restrictions on the approval, I am happy to convey that back.
SUPERVISOR STROUGH-Alright, we have another meeting June 131h, we'll know more and if
we're satisfied that it is okay, then we can give the extension of May, 2023.

PUBLIC HEARING — YEAR 2022 EMERGENCY AMBULANCE SERVICES
AGREEMENT BETWEEN TOWN OF QUEENSBURY AND NORTH QUEENSBURY
RESCUE SQUAD,INC.

SUPERVISOR STROUGH-Okay, I can't give enough credit to the volunteers of our three squads,
especially those here tonight,North Queensbury Rescue Squad and Bay Ridge Rescue Squad. Those
folks realizing that we've got to sit down and work out some solutions, and the Town Board,I've got
to thank you too for sitting down with everybody and working out solutions. So there's a public
hearing on this tonight and it's a resolution to approve year 2022 Emergency Ambulance Service
Agreement between the Town of Queensbury and North Queensbury Rescue Squad. That includes,
among other things, some expenses, operating expenses of$54,500, debt services of$14,600, paid
staffing at $235,500 and a paid staffing and collaboration agreement with Bay Ridge Rescue Squad
and this will start June 1st and go to the end of the year. And there is a public hearing on this tonight.
Anything before I open the public hearing, anything from the Town Board?
COUNCILMAN FERONE-No
SURPERVISOR STROUGH-Alright, I will open the public hearing on this matter. Any member of
the public present wish to speak to the proposed contract with North Queensbury Rescue Squad? I
don't see any attendees either. Alright, again I want to thank you guys, you've put in a lot of work.
COUNCILMAN FREER-I think we all feel the same way John.
SUPERVISOR STROUGH-Yeah, and the Town Board appreciates it.
CONNI TUCKER-I look forward to the next round of discussions.
SUPERVISOR STROUGH-Yeah we were already talking about that,you know George and I earlier
and we want to give this a chance to get some legs, see how it feels. Shane gave me, and I will share
that with the Board, a schedule that you have already worked out.

SUPERVISOR STROUGH-Fully staffed, as Shane points out, Shane Irwin. Fantastic, I mean you
guys have been so proactive, so on the spot and you're volunteers. So, OMG I guess as they say on
Facebook or whatever.
COUNCILMAN MCNULTY-John, if I can just for the record,I know you're busy,I sent you a note
about the Pilot Knob in Fort Ann I believe the neighboring town,I think we need to look at that again.
I saw that you sent several letters already but I don't want to lose focus of that, that the Town of
Queensbury tax payers are supporting Fort Ann up there and it would be nice to get some quid pro
quo.
SUPERVISOR STROUGH-And we'll follow that up with a letter and thank you for reminding me
and bringing that to my attention Tim. I'll send a letter to the new Supervisor of the Town of Fort

RESOLUTION APPROVING YEAR 2022 EMERGENCY AMBULANCE
SERVICES AGREEMENT BETWEEN TOWN OF QUEENSBURY
AND NORTH QUEENSBURY RESCUE SQUAD, INC.
RESOLUTION NO.: 187, 2022

WHEREAS, in accordance with Town Law §184 and General Municipal Law §122-b, the
Queensbury Town Board may contract with ambulance services certified or registered in accordance
with Public Health Law Article 30 for general emergency ambulance services within the Town, and
WHEREAS, the Town's Agreement with the North Queensbury Rescue Squad, Inc. expired
as of December 31, 2021, and
WHEREAS, in such Agreement the Town and the North Queensbury Rescue Squad, Inc.,
agreed that the terms and provisions of the existing Agreement may continue during the interim period
pending execution of a new Agreement, and
WHEREAS, by Resolution No.: 118, 2022, the Town Board authorized a revised, new 2022
Emergency Ambulance Services Agreement between the Town of Queensbury and the Bay Ridge
Rescue Squad, Inc., effective April 1st, 2022 through December 31", 2022, and
WHEREAS, the North Queensbury Volunteer Rescue Squad, Inc. and Bay Ridge Rescue
Squad, Inc. worked together and negotiated terms for a Paid Staffing and Collaboration Agreement
effective June 1st, 2022 in order to improve public safety and have provided the Town Board with a
copy of such Paid Staffing and Collaboration Agreement, and
WHEREAS, the Town and the North Queensbury Rescue Squad, Inc. have negotiated terms
for an Agreement for general emergency ambulance services effective June 1, 2022 through
December 31, 2022 and accordingly, in accordance with Town Law §184 and General Municipal
Law§209(b),on Monday,May 16th,2022 the Town Board duly conducted a public hearing and heard
all interested persons concerning the proposed Agreement,
NOW, THEREFORE, BE IT

SUPERVISOR STROUGH reviewed proposed resolutions 4.1 through 4.30.
ATTORNEY DAVIS referred to resolution 1.3 on the agenda and noted that she reviewed the
paperwork,the current requirement is to have the system replaced by June 1st. Would like to request
to extend that time period past June 13th.
TOWN COUNSEL HAFNER-My suggestion was to extend it to your next meeting.
ATTORNEY DAVIS-I am not sure that decision was made.

WHEREAS, the Town of Queensbury's Water Superintendent advised that soda ash hardened up on
the inside of the Town Water Department's soda ash silo thereby preventing the proper operation of the
soda ash feed system and resulting in the Water Department having to rely on its backup system in order to
maintain its corrosion control capability, and

WHEREAS, the Water Superintendent therefore arranged for Precision Industrial to remove the
hardened soda ash as soon as possible, such work requiring confined space entry and the use of an industrial
vactor truck, and on an emergency basis for public health and safety reasons as time would not allow for
the receipt of bids, and
WHEREAS,the Town Board hereby determines that such repair/hardened soda ash removal services
constituted an emergency procurement needed to best serve the Town's residents and such repairs needed to
be completed immediately to protect public health and safety,
NOW, THEREFORE, BE IT
RESOLVED, due to the emergency nature of the above-described repairs/hardened soda ash removal
services,the Queensbury Town Board hereby waives its requirement under General Municipal Law §103 and
the Town of Queensbury's Purchasing Policy and authorizes, confirms and ratifies the Town Water
Superintendent's engagement of Precision Industrial for the provision of emergency water system
repairs/hardened soda ash removal services at the Town's soda ash silo, as such emergency repairs/services
were needed to maintain public health and safety to best serve the Town's residents and should have been made
as soon as possible, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs that payment for such services in the total
amount of$11,445 be made from Account No.: 040-8320-4350, and
BE IT FURTHER,
RESOLVED,that the Town Board authorizes and directs the Town Budget Officer to amend the 2022
Town Budget to transfer $11,445 from Fund Balance Account No.: 040-0000-0909 to Account No.: 040-

previously used with the Project without soliciting multiple vendors, and
WHEREAS, the Town Board therefore wishes to engage the services of Invasive Solutions
Dive Company, LLC for Glen Lake in 2022 by Invasive Solutions Dive Company, LLC providing
four, 40-hour work weeks between May and October for an amount not to exceed $7,605 per one
hardvest week per crew, and not to exceed a total amount of $30,420 for four harvest weeks in
accordance with Invasive Solutions Dive Company, LLC's Aquatic Invasive Plant Removal
Agreement presented at this meeting, and

• Referred to the recent accidents with pedestrians being hit by cars and made a plea for people
to be careful and slow down.
COUNCILMAN MCNULTY(WARD IV)
• Announced the draft traffic study on Corinth Road has been completed. I am not happy with
the results. They failed to address one of the major issues that was requested;the school bus
traffic on Corinth Road. I have asked them to revisit that and believe there is a briefing next
week which I will attend.
• Referred to the discussions earlier of the short term rental concerns and the importance of all
Board members treating people "the way we would like to be treated." Stated further the
importance of encouraging people to come and speak.
SUPERVISOR STROUGH
• Announced that as of Wednesday, May 18th, the intersections of both West Mountain Road
and Luzerne Road and West Mountain Road and Aviation Road will go to four-way stop
intersections.
• Noted there has been a request by the residents of Gentry Road to use speed radar signs.
• Announced the media release in Post Star today with overview of Memorial Day Parade for
May 30th starting at 10am as well as the Memorial Day outreach program for young people to
learn the true meaning,theme being "Our Freedom, Their Sacrifice."

• Announced volunteers still needed to help deliver meals for homebound seniors. If you have
spare time to help, call 518-761-6347.
• Announced travel advisory Route 9L Ridge Road, 3.5-mile stretch between Quaker Road and
Sunnyside Road. It will be a single lane for repaving between 6 am and 5pm.
• Noted that he is working on developing some bikeway rules and will share with Board.
• Announced registration is open for Warren County households who may have hazardous
waste. Residents need to register, the program is free of charge and will be on Saturday
August 13 at Queensbury Highway department.
• Announced the Warren County Historical Society will try to put together a facility that will
give Joseph Warren the respect that he's earned. Warren County was named after Joseph
Warren who died at the battle of Bunker Hill. An exhibit is planned for Tuesday June 7 from
4-7 at the Warren County Historical Society Headquarters, 50 Gurney Lane.
