Dear Phil,-
Since w&,ve issued a permit,for the renovations at 10 Holden Avenue,we've had no correspondence from
you or any contact regarding compliance with the Building Code in order to issue a Certificate of
Occupancy for occupying the building.
The Fire Marshals Office conducted an inspection of the premises and found the following violations
that exist at this time, on top of the fact that you are currently operating your business there with no
Certificate of Occupancy.
1. Both stairways appear to be in disrepair and need to be brought up to Code as shown on your
plans.
2. There are no fire extinguishers on site.
3. There's open wiring throughout the building.
4. There are holes in the stair treads.
5. There is temporary lighting provided upstairs with no exit lights or emergency lights provided.
As you are also aware,a condition of your occupying the building and being issued a variance by the State
of New York was the fact that a fire alarm system would be installed in the building.
All the above items must be addressed immediately, and if necessary,. a temporary Certificate of
Occupancy will be issued for your business until such time as the addition is complete.
As it stands right now,you are currently occupying the building in violation of the Building Code,with
several Building Code violations,as well as a violation of the variance that you were granted to occupy
the building and conduct business from that building.
The rest of the building outside of your space must be brought up to Code as far as exit lights,emergency
lights,exit doors and fire separations, otherwise, at some point in time in the near future, the Town of
Queensbury will take action to have the violations corrected.

As I made you aware previously,you.are not to undertake any construction until you have a proper
zoning approval from the Plannin Board.
Two visits.to the site have.shown that you have continued.to construct and alter the facility, in
violation of.the New York State Uniform Building Code and Chapter 88 of the Local.Town Law.
You are proposing to'use.a metal fabricating shop and Volt Landscaping-is,proposing to put a repair
shop for their equipment,along--storage facilities located in this building;occupied*By other tenants.
This.would be considered a mixed use in.a wood frame building-and therefore.not.allowed ISy the
building code. f
In order to have these uses allowed by the building code,you.must submit,to the State.of New York
fora"variance to allow,mixed•use in-a wood frame building. Until such time as a variance is granted.
by the State of New York, you could not.occupy, nor could I issue building permits for the two
proposed industrial use in this facility.
This letter will serve as an official Stop Work.order to any construction or future construction.at this
site: Should you undertake any work, you do,so.at your own risk, and it-may involve removal or
modifications to the work you have undertaken:
This also means,that none of your tenants, including Volt Landscaping or your own business, can
-legally occupy this building until such time as building permits have been issued and certificates of
occupancies.granted. .
Failure-to comply with the above would:result in a court summons being issued for doing work
: without building permits and occupying these Buildings without certificates of occupancies.
