1.4 WASTEWATER-SEWER\Set PH\Dineen—Holding Tank&Property Line Setbacks-9-12-2022 RESOLUTION SETTING PUBLIC HEARING ON SEWAGE DISPOSAL VARIANCE APPLICATION OF GORDON DINEEN RESOLUTION NO.: ,2022 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board serves as the Town's Local Board of Health and is authorized by Town Code Chapter 136 to issue variances from the Town's On-Site Sewage Disposal Ordinance, and WHEREAS, Gordon Dineen (Applicant) has applied to the Local Board of Health for variances from Chapter 136, §136-11 which requires applicants to obtain a variance for a holding tank system, as the Applicant wishes to install a holding tank system consisting of two (2) 1,250 gallon capacity precast concrete holding tanks for a total capacity of 2,500 gallons in lieu of the required total capacity of 3,500 gallons, and WHEREAS, the Applicant has also applied for additional variances from Chapter 136 to allow placement of the holding tank system: 1. 5' from the east property line instead of the required 10' setback; 2. 2' from the south property line instead of the required 10' setback; 3. 28.5' from the neighboring well instead of the required 50' setback; 4. 2'5" between the sewer force main and the south property line instead of the required 10' setback; and 5. 8' from the owner's well instead of the required 50' setback; on property located at 51 Fitzgerald Road in the Town of Queensbury, NOW, THEREFORE, BE IT RESOLVED, that the Town of Queensbury Local Board of Health will hold a public hearing on Monday, September 26t", 2022 at 7:00 p.m. at the Queensbury Activities Center, 742 Bay Road, Queensbury, to consider Gordon Dineen's sewage disposal variance application concerning property located at 51 Fitzgerald Road in the Town of Queensbury and bearing Tax Map No.: 289.14-1-2 and at that time all interested persons will be heard, and BE IT FURTHER, RESOLVED, that the Local Board of Health authorizes and directs the Queensbury Town Clerk to publish the Notice of Public Hearing presented at this meeting and send a copy of the Notice to neighbors located within 500 feet of the property as required by law. Duly adopted this 12t'day of September, 2022,by the following vote: AYES NOES ABSENT: 169 Haviland Road Queensbury, NY' 12804 Hutchins Engineering PLLC Phone: (518)745-0307 Fax:(518)745-0308 September 7, 2022 CO Town of Queensbury Local Board of Health (D x 742 Bay Road Queensbury NY 12804 Cn Re: Gordon Dineen —51 Fitzgerald Road —Glen Lake Septic Variances Tax Map ID: 289.14-1-2 Dear Supervisor Strough, and Town Board Members: This office represents the Gordon Dineen with respect to a proposed holding tank system and associated septic variances for his home at 51 Fitzgerald Road on Glen Lake. Presently, the camp has an old wastewater system, which is a seepage pit beneath the camp in a crawl space. The existing seepage pit must be pumped out through a trap door in the floor of a closet and has need to be frequently pumped out over the last year. It is proposed to disconnect from the existing system and install a grinder pump in the crawl space and pump to a holding tank system in the parking area. The force main will be heat traced for the entire length as portions of the piping will be above grade due to the force main traversing several existing retaining walls and a steep slope to the proposed holding tank location. Given the site constraints and well location, it is not possible to install a compliant absorption field or holding tank system upon the parcel, therefore six variance requests to the Local Board of Health are requested for the project. These requests are itemized on Sheet S2 of the project plans and consist of: 1,000 gallon capacity relief from the required 3,500 gallon holding tank requirement, 5 ft of relief from the east property line, 8 ft of relief from the south property line, 21.5 ft of relief from the neighboring well to the north, 7.5 ft of relief for the sewer force main from the south property line and 42 ft of relief from the owners well. It is our opinion that this proposed holding tank system is a vast improvement for the parcel and the neighborhood. We respectfully request that this application be placed upon the Local Board of Health's meeting agendas for the September meetings. Please contact me with any questions that you may have or if you would like to perform a site visit. Thank you for your assistance with the project. Best regards, Thomas R.Center Jr., P.E.
