WHEREAS, Sean Chant filed an application for a variance from provisions of the Town of
Queensbury On-Site Sewage Disposal Ordinance, Chapter 136 to install an Enhanced Treatment Unit
(ETU) septic leaching system as part of a replacement onsite wastewater treatment system (OSWTS)
approximately 50' from the existing well in lieu of the required 100' setback on property located at 22
North Lane in the Town of Queensbury, and
WHEREAS, by Local Board of Health Resolution No.: BOH 16,2011, a variance was granted
to the prior property owner to install an absorption field 0' from a watercourse (wet area) in lieu of the
required 100' setback as part of the prior owner's plan to replace the OSWTS, a permit was issued to
construct the system, and an Agreement was entered into with the Adirondack Park Agency(APA)to
implement the plan; however, the permit expired and therefore the Applicant is also applying for
written Town approval for the variance to install the replacement OSWTS design previously
authorized by Resolution No.: BOH 16,2011, i.e., to locate and install the OSWTS/absorption field 0'
from a watercourse(wet area) or within the wetland as a replacement area cannot be provided, and
WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health duly conducted a public hearing concerning the
variance requests on Monday, September 26t', 2022, and
WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners
within 500 feet of the subject property,
NOW, THEREFORE, BE IT
RESOLVED,that
1. due to the nature of the variances, the Local Board of Health determines that the
variances would not be materially detrimental to the purposes and objectives of this
Ordinance or other adjoining properties nor otherwise conflict with the purpose and
objectives of any Town plan or policy; and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
applicant; and
BE IT FURTHER,
RESOLVED, that the Local Board of Health hereby approves Sean Chant's application for a
variance from the Sewage Disposal Ordinance to install an Enhanced Treatment Unit (ETU) septic
leaching system as part of a replacement onsite wastewater treatment system(OSWTS) approximately
50' from the existing well in lieu of the required 100' setback on property located at 22 North Lane in
the Town of Queensbury and bearing Tax Map No.: 226.19-1-60, and
BE IT FURTHER,
RESOLVED, that the Local Board of Health further restates its approval of the variance
granted to the prior property owner to install an absorption field 0' from a watercourse (wet area) in
lieu of the required 100' setback as part of the prior owner's plan to replace the OSWTS, as was
previously authorized by Resolution No.: BOH 16,2011, and hereby approves Mr. Chant's variance to
locate and install the OSWTS/absorption field 0' from a watercourse (wet area) or within the wetland

as a replacement area cannot be provided, and
BE IT FURTHER,
RESOLVED, that the Enhanced Treatment Unit (ETU) shall be maintained by the property
owner in accordance with the manufacturer's recommendations for the life of the system, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Clerk to forward by
certified mail a certified copy of this Resolution to the Adirondack Park Agency for its review, and
BE IT FURTHER,
RESOLVED, that this approval Resolution shall not be effective until 30 days after such notice
to the Adirondack Park Agency and shall be subject to review by the Adirondack Park Agency during
such period.

WHEREAS
1. Pursuant to Executive Law Section 809 (2) (a) , a permit is
required from the Adirondack Park Agency prior to the
undertaking of any land use and development involving
wetlands in a Moderate Intensity Use land use area in the
Adirondack Park.
2. Pursuant to 9 NYCRR Part 578, a permit is required from the
Adirondack Park Agency prior to the excavation of, deposit
of fill in, or construction of any road or structure in a
wetland in the Adirondack Park.
3 . Tax Map Parcel 226.19-1-60 ("Lot 600) is an approximately
.34 acre pre-existing property located entirely within a
wetland in a Moderate intensity Use land use area. Lot 60
is improved by a pre-existing single family dwelling with
an 875 square foot footprint and a pre-existing wastewater
treatment system, both located in wetlands.
Respondent is the current owner of Lot 60, as described in
a deed recorded in Book 3133, Page 157, in the Warren
County Clerk's office.
4. Agency investigation reveals that, in 2008, Respondent's
agent replaced the pre-existing piers supporting the single
family dwelling on Lot .60 with a cement foundation,
constructed a-gravel driveway and footpath to the dwelling,
and filled wetlands surrounding the dwelling with topsoil.
This new land use and development resulted in the

excavation and filling of wetlands on Lot 60.
No permit was obtained from the Agency prior to this
excavation of, deposit of fill in, and construction of a
foundation and driveway in a wetland.
5. On March 22, 2011, Agency staff received from Respondent a
plan, entitled "Proposed Replacement Wastewater System for
the Poulos Residence, " prepared by Environmental Design
Partnership, LLP, and dated March 15, 2011, for replacement
of the wastewater treatment system located on Lot 60. On
July 6, 2011, the Town of Queensbury Town Board approved
implementation of this plan.
6. Respondent desires to resolve this matter and agrees to be
bound by the terms of this Settlement Agreement.
NOW, THEREFORE, THE AGENCY AND RESPONDENT AGREE AS FOLLOWS:
1. By December 31, 2013, Respondent shall implement the plan
described in Paragraph 5 above for replacement of the
wastewater treatment system on Lot 60. Within 30 days of
replacing this wastewater treatment system, Respondent
shall submit to the Agency written certification by a
design professional (i.e. licensed professional engineer,
licensed architect, exempt licensed land surveyor) that the
plan was implemented as approved.
2. By December 31, 2013, Respondent shall disconnect all pipes
associated with the pre-existing on-site wastewater
treatment system on Lot 60.
3. Respondent, her successors or assigns may replace the
single family dwelling on Lot 60 on the same footprint as
the existing structure without an Agency permit. Any
expansion in footprint of this dwelling or replacement
structure shall require a permit from the Agency.
4. The violations referenced herein shall be deemed to be
finally resolved with respect to Respondent upon the full
execution of this Settlement Agreement.

SIMILAR TO THE EXISTING SYSTEM, THE REPLACEMENT SYSTEM
CANNOT MEET THE CURRENT REQUIREMENTS FOR SEPARATION
FOR NEW SYSTEMS. THE PROPOSED SYSTEM IS TO BE A FILL
SYSTEM THAT IS CONSTRUCTED IN A WETLAND. THE
ENHANCED TREATMENT UNIT (ETU) IS BEING PROVIDED FOR
BETTER TREATMENT OF THE SEWAGE PRIOR TO DISCHARGE TO
THE WETLAND. THE SEPARATIONS THAT WE CANNOT MEET
ARE: DISTANCE FROM THE ETU SYSTEM TO THE ONSITE (OUR)
WELL, DISTANCE FROM THE ETU TO A WETLAND (AS WE ARE
BUILDING IT IN A WETLAND). IN ADDITION` THERE IS NO ROOM
TO PROVIDE A REPLACEMENT AREA FOR THE ETU WITHOUT
NEEDING MORE VARIANCES AND AFFECTING NEIGHBORS WELLS
AND DECREASING THE SEPARATION TO OUR WELL IT IS NOT
EXPECTED THAT ANY ISSUES WILL RESULT FROM THESE
VARIANCES, HOWEVER, WE RECOMMEND THAT THE ONSITE
WELL BE TESTED FOR TOTAL COLIFORM (TC) NOW AND AFTER
THE SYSTEM IS IN USE EVERY 4 MONTHS FOR THE FIRST
YEAR. THE SAMPLE RESULTS WOULD BE TAKEN TO INSURE
THAT THE WELL WILL NOT BE IMPACTED BY THE ONSITE
SYSTEM. AFTER ONE YEAR HAS PASSED WE RECOMMEND
THAT A TC SAMPLE BE TAKEN EACH YEAR. IF TC TEST IS
POSITIVE AT ANY TIME, OWNER SHOULD CONSIDER A UV
