PUBLIC HEARING—Sewage Disposal Variance Application of Robert & Louise Gilchrist

SUPERVISOR STROUGH reviewed the proposed five variance requests.
NICK ZEGLEN-Good evening Nick Zeglen with Environmental Design Partnership here on
behalf of Robert and Louise Gilchrist of 2483 Ridge Road. Yea, so they are the sellers of the
property and as part of the Town of Queensbury property transfer law, the septic, the existing
septic system went through inspection, failed inspection so we came up with this new design. As
was mentioned there's five variances for the Enhanced Treatment Unit, UV Disinfection Unit to
a pump tank which would go to a raised pressure distributed absorption bed. We feel this design

fits this sight well, it's an improvement to what's there and I will turn it back over to the Board
for any questions.
SUPERVISOR STROUGH-Well, have we decided which kind of ETU we're going to use there
or?
NICK ZEGLEN-No, I kept it as just a,just an ETU. You know, a Norweco or a Fuji Clean or a
Clarus just because you know the different contractors have different kind of agreements with
the ETUs. And I didn't want to, you know pigeon hole them into one with just the way costs are
these days and everything, I just wanted to keep it kind of generic for now and then when we do
our building permit design we'll specify which ETU it is.
SUPERVISOR STROUGH-Okay. Questions from the Board?
COUNCILMAN FREER-Yea, this a break from what we've normally seen. For variances of
this kind with ETU's we normally, kind of know which system they were going to put in. Right?
SUPERVISOR STROUGH-Yea usually but, you know we can't tell them which system to put in
either.
COUNCILMAN FREER-Right.
SUPERVISOR STROUGH-But the ones that he mentioned are all good and there are others as
good. So, and the final plan will include the kind that they are going to include but.
COUNCILMAN FREER-Okay.
SUPERVISOR STROUGH-Alright, there is a public hearing on this tonight and I will open the
public hearing. Is there anybody present who would like to speak to this? Nick, if you will sit
down and I will call you back up in a minute. Sir would you please come to the table and
introduce yourself for the record and share your thoughts with us?
KENNETH SWEET-Good evening. Sure, I'm Kenneth Sweet. I'm a neighbor of the property.
I live on Hannaford Road. I don't have anything prepared which maybe to everyone's detriment
but anyway I am here to support it. Mr. and Mrs. Gilchrist have been there for a long time. I've
lived in my property for 22 years. They're nice people. I doubt very much that they've been
trying to do anything wrong and were it not for the fact that they were trying to sell the property,
I doubt that anybody would've known there was anything wrong. It seems to me that we've got
all these variances is the least of all evils and I think that's the best option that we have to go. If
they don't sell, my guess is that they, I don't know, if they have to do anything. In which case
it's not an acceptable system and I would hate for anybody to kind of, in the dark of the night to
go and do something that would make it acceptable or whatever it would pass some test but
wouldn't be an acceptable engineered system. I know they are hamstrung by a really weird set
of boundaries right there where the location is. They're good people. I've always stuck up for
the, I've always believed in the efforts of the little guy that's trying to do the right thing and I
think that's what we got going on right here. So I offer my support as a neighbor. The
intermittent stream runs through my property. Right now it's a dried up nothing, as it is several
months.

questions for Nick? Mr. Sweet, it's not the people we look at. They may be good people. We
don't know, but we look at the system. As going to be the right system, is it going to be
protective of the well water, protective of the wetlands and so forth and the system that Nick

designed here I think he did a good job with it. And that's me speaking though not the Board.

TOWN COUNSEL SCHACHNER-My question is, as Councilman Freer points out typically you
have a very specific proposal in front of you that even names which type of system is at issue. I
don't think we have that here so my question slash comment is, do we want the generic
Resolution of approval which approves installation of a wastewater replacement system with the
following five variances, do we want to characterize the wastewater replacement system right in
the Resolution approval without naming a particular brand or particular company?
SUPERVISOR STROUGH-It's on his plans.
TOWN COUNSEL SCHACHNER-Okay.
SUPERVISOR STROUGH-It's already there.
TOWN COUNSEL SCHACHNER-Yea, there's a description on the plans, I see that.
COUNCILMAN FREER-And it includes an advanced unit and UV which are sort of the two
things we've kind of looked for. But again, I just want to go on record in saying that we're kind
of taking the next step in dealing with these ETUs.
TOWN COUNSEL SCHACHNER-Right. So to rephrase my question it would basically be, do
you want the Resolved clause of the approval instead of just generically saying to install a
wastewater replacement system, to install an Enhanced Treatment Ultraviolet Treatment
wastewater replacement system? That's my question.
COUNCILMAN FREER-That would be fine, I would be happy to move that.
COUNCILMAN MCNULTY-I would support that as well.

1. 74' from the well in lieu of the required 100' setback;
2. 10' from the foundation in lieu of the required 20' setback;
3. 8±' from the property line in lieu of the required 10' setback;
4. 37' from the intermittent stream in lieu of the required 100' setback; and
5. 90' from the wetland/MHWL in lieu of the required 100' setback;
on property located at 2483 Ridge Road(State Route 9L) in the Town of Queensbury, and
WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health duly conducted a public hearing concerning the
variance request on Monday, July 11'', 2022, and
WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners
within 500 feet of the subject property,

RESOLVED,that
1. due to the nature of the variances, the Local Board of Health determines that the
variances would not be materially detrimental to the purposes and objectives of this
Ordinance or other adjoining properties nor otherwise conflict with the purpose and
objectives of any Town plan or policy; and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
Applicants; and

direction a distance of 150'± and accordingly authorize the installation of certain no parking signage
in this specific area as well as the placement of a boulder to block unauthorized motor vehicles in
order to prevent unauthorized motor vehicles from entering the City of Glens Falls' Lower Watershed
at this point of entry, and
WHEREAS, such legislation is authorized in accordance with New York State Town Law,
Vehicle and Traffic Law§1660(18) and the Municipal Home Rule Law, and

WHEREAS,the Town also ordered equipment and hydraulic systems for these Plow Trucks
from Zwack Inc., and
WHEREAS, Zwack Inc. is requesting advance payment for this equipment and hydraulic
systems they have purchased even though they have not obtained the Town's Plow Trucks and know
when the Town will obtain these Plow Trucks,

Inc. agreeing to maintain insurance on the equipment and hydraulic systems, keeping the equipment
and hydraulic systems on the property and guaranteeing the equipment and hydraulic systems will be

amount of$1,586 per month to replace the current arrangement of$1,828.30 per month,thus saving
the Town approximately $243 per month as set forth in the Lease Agreement presented at this
meeting,

STUART ALLEN-Thanked the Town Board for simulcasting these Town Board Meetings. This is
an excellent use of technology at a very good time for the Country. I appreciate you doing this, it is
fantastic leadership on the part of Queensbury. I hope more municipalities will do this. Would like
to see in the future the Town codifying this into law so that people that sit in your seats in the future
cannot remove this transparency and public accountability and participation. Thank you.

6.0 TOWN BOARD DISCUSSIONS
COUNCILMAN MCNULTY(WARD IV)
• Announced upcoming meeting Wednesday with Spencer Montgomery regarding the West
Mountain expansion.
COUNCILMAN FERONE(WARD II1)
• Noted Cottage Hill traffic signal having malfunctioning issues and noted that he has been in
contact with Highway Superintendent David Duell. Stilsing Electrical should be coming to
replace the part so it will function appropriately.
• Recognized and thanked our Highway Department for dealing with many issues in a timely
manner in Ward III.
COUNCILMAN FREER(WARD II)
• Attended meeting today with Kathy Bozony and Barbara Tierney regarding transitioning to
LED lighting and our options.
• Mentioned interest/concern on where the Town is going with Cannabis.

• Referred to road work on Bay Rd and Quaker Rd, going to take some time and encouraged
people to avoid it if possible.
• Request for continued caution of COVID with new variant.
• Thanked Mr. Schachner for insights into septic variance Resolution.
• Attended the Warner Bay, LGA Bay by Bay meeting a couple of weeks ago and this
Wednesday at 4pm they will be having the Harris Bay, LGA Bay by Bay. The meeting was
informative and useful for anyone that is interested in preserving water quality in Lake
George.
COUNCILMAN METIVIER(WARD 1)
• Referred to road work in the Town on Bay Road and Ridge Road,recommended avoiding but
to remember it is Town progress.
SUPERVISOR STROUGH
• Noted his visit with Councilman Freer to the Mountainside Library, now on the National
Register of Historical Places.
• Received email from Bob Davis complimenting Town for putting together top notch network
of walking and Mountain Biking trails.
• Announced Warren County Household Hazardous Waste Disposal Day. Residents need to
register online at Warrencountyny.gov/resident/waste or by mail or in person at 4028 Main
Street, Warrensburg. The program is free of charge and will be held on Saturday August 13,
9a-lp at Queensbury Highway Department.
